| 1 | | AN ACT concerning transportation.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 1. Short title. This Act may be cited as the | 5 | | Springfield High Speed Railroad Oversight Act. | 6 | | Section 5. Definitions. For purposes of this Act: | 7 | | "Department" means the Department of Transportation. | 8 | | "Minority owned business", "business owned by a person with | 9 | | a disability", and "female owned business" shall have the | 10 | | meanings provided in Section 2 of the Business Enterprise for | 11 | | Minorities, Females, and Persons with Disabilities Act. | 12 | | "High Speed Rail Project" means the Illinois High Speed | 13 | | Rail Program, led by the Illinois Department of Transportation | 14 | | and the Federal Railroad Administration, which is designed to | 15 | | enhance the passenger transportation network in the | 16 | | Chicago-St. Louis corridor. | 17 | | Section 10. Diversity program; purposes. The Department, | 18 | | the City of Springfield, and Sangamon County shall establish | 19 | | and maintain a diversity program to ensure environmental | 20 | | justice, as well as local involvement and non-discrimination, | 21 | | in all contracts related to the High Speed Rail Project in the | 22 | | City of Springfield and Sangamon County. The program shall do |

| 1 | | each of the following: | 2 | | (1) Guarantee equal employment opportunities for socially | 3 | | and economically disadvantaged workers, particularly in areas | 4 | | affected by the High Speed Rail Project. | 5 | | (2) Increase participation by minorities, women, and | 6 | | persons with disabilities in employment opportunities. | 7 | | Contracts related to the High Speed Rail Project shall meet a | 8 | | goal of at least 25% minority hiring. | 9 | | (3) Increase participation by small businesses, minority | 10 | | owned businesses, businesses owned by a person with a | 11 | | disability, and female owned businesses in contracting. | 12 | | Contracts related to the High Speed Rail Project shall meet the | 13 | | Department's existing 22.77% Disadvantaged Business Enterprise | 14 | | participation goal for competitively let construction | 15 | | projects. | 16 | | (4) Provide new funds equal to 1/2 of 1% of the project | 17 | | budget to local job training and support programs. | 18 | | (5) Engage the full and fair participation of all | 19 | | potentially affected communities in the transportation | 20 | | decision making process concerning the construction of the High | 21 | | Speed Rail Project. | 22 | | (6) Ensure compliance with all State and federal hiring | 23 | | regulations, including, but not limited to, goals for hiring | 24 | | women and minorities, and prohibitions on discrimination. | 25 | | (7) Ensure proper support and adequate resources are | 26 | | available for the appointed rail relocation ombudsman. |

| 1 | | If the implementation of any of the provisions of this | 2 | | Section 10 would negatively affect the receipt of federal | 3 | | funding, then the provisions of Section 10 shall not apply. | 4 | | Section 15. Springfield High Speed Railroad Oversight | 5 | | Commission. The Springfield High Speed Railroad Oversight | 6 | | Commission ("Commission") is created to monitor, review, and | 7 | | report on contracting and employment related to the planning, | 8 | | organization, and construction of the High Speed Rail Project. | 9 | | The Commission shall consist of 13 members who shall be | 10 | | appointed, within 90 days of the effective date of this Act, as | 11 | | follows: | 12 | | (1) One member of the Senate appointed by the President of | 13 | | the Senate, who shall serve as a Co-Chairperson of the | 14 | | Commission. | 15 | | (2) One member of the House of Representatives appointed by | 16 | | the Speaker of the House, who shall serve as a Co-Chairperson | 17 | | of the Commission. | 18 | | (3) One member of the Senate appointed by the Minority | 19 | | Leader of the Senate. | 20 | | (4) One member of the House appointed by the Minority | 21 | | Leader of the House of Representatives. | 22 | | (5) One member appointed by the Speaker of the House of | 23 | | Representatives representing the community surrounding the | 24 | | Springfield High Speed Railroad project area. | 25 | | (6) One member appointed by the Governor representing |

| 1 | | community organizations operating within the community | 2 | | surrounding the High Speed Rail Project area in Springfield. | 3 | | (7) One member appointed by the President of the Senate | 4 | | representing a minority chamber of commerce. | 5 | | (8) One member appointed by the Minority Leader of the | 6 | | Senate who is a minority or female and a licensed professional | 7 | | engineer. | 8 | | (9) One member appointed by the Minority Leader of the | 9 | | House of Representatives representing the City of Springfield. | 10 | | (10) One member appointed by the President of the Senate | 11 | | representing Sangamon County. | 12 | | (11) One member appointed by the Speaker of the House of | 13 | | Representatives representing a statewide labor organization. | 14 | | (12) One member appointed by the Governor representing the | 15 | | Illinois Department of Transportation. | 16 | | (13) The independent ombudsman for the 10th Street Rail | 17 | | Corridor. | 18 | | Section 20. Commission meetings; authority; reporting. The | 19 | | Commission shall meet quarterly. The Commission shall have the | 20 | | authority to convene City, County, and Department officials to | 21 | | ensure compliance with the above stated goals. | 22 | | On January 1, 2016, and on the first of each quarter | 23 | | thereafter until the completion of the High Speed Rail Project, | 24 | | the Commission shall issue a written report to the Governor, | 25 | | President of the Senate, Speaker of the House of |

| 1 | | Representatives, Minority Leader of the Senate, Minority | 2 | | Leader of the House of Representatives, Mayor of Springfield, | 3 | | Springfield City Council, Sangamon County Board, and the | 4 | | Department describing in detail the Project's compliance with | 5 | | the requirements of Section 10 of this Act. If in any reporting | 6 | | period any portion of the Project is not in compliance with its | 7 | | respective obligations, each entity that is not in compliance | 8 | | shall, by the end of the first month of the reporting period, | 9 | | file with the Commission a written explanation setting forth | 10 | | the reason or reasons for noncompliance. The Commission shall | 11 | | then meet within one week after receiving the written | 12 | | explanations to discuss the stated reason or reasons for | 13 | | noncompliance. | 14 | | Section 25. Home rule. The requirements of this Act are | 15 | | exclusive powers and functions of the State. This Act is a | 16 | | denial and limitation of home rule powers and functions under | 17 | | subsection (h) of Section 6 of Article VII of the Illinois | 18 | | Constitution.
| 19 | | Section 99. Effective date. This Act takes effect upon | 20 | | becoming law.
