1 | AN ACT concerning regulation.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Illinois Plumbing License Law is amended by | |||||||||||||||||||
5 | changing Section 14 as follows:
| |||||||||||||||||||
6 | (225 ILCS 320/14) (from Ch. 111, par. 1113)
| |||||||||||||||||||
7 | Sec. 14. License renewal; continuing education. All | |||||||||||||||||||
8 | plumber's licenses
and apprentice plumber's licenses
issued
| |||||||||||||||||||
9 | under this Act shall expire on April 30 next
following date of | |||||||||||||||||||
10 | issuance.
The term for retired plumber's licenses shall be | |||||||||||||||||||
11 | prescribed by Department
rule
after consultation with the Board | |||||||||||||||||||
12 | of Plumbing Examiners.
| |||||||||||||||||||
13 | An apprentice plumber's license shall also expire the date | |||||||||||||||||||
14 | that the licensed
plumber sponsor of such licensed apprentice | |||||||||||||||||||
15 | plumber
severs his or her sponsor status with the licensed | |||||||||||||||||||
16 | apprentice
plumber. The licensed plumber sponsor shall | |||||||||||||||||||
17 | immediately
notify the Department of the severance of his or | |||||||||||||||||||
18 | her relationship with the
licensed apprentice plumber. Such | |||||||||||||||||||
19 | apprentice plumber
may, on forms provided by the Department, | |||||||||||||||||||
20 | apply for reinstatement of his or
her
apprentice license by | |||||||||||||||||||
21 | submitting to the Department a new
application and new | |||||||||||||||||||
22 | apprentice plumber's license fee. The application shall
verify | |||||||||||||||||||
23 | that the applicant for
reinstatement of his or her apprentice |
| |||||||
| |||||||
1 | plumber's license is sponsored
by an Illinois licensed plumber. | ||||||
2 | If the applicant is employed by a firm,
the application
shall | ||||||
3 | contain the name and license number of an Illinois licensed | ||||||
4 | plumber
employee of the firm or name and license number of an | ||||||
5 | Illinois licensed
plumber member of the firm, or name and | ||||||
6 | Illinois plumber's license number
of an officer of a | ||||||
7 | corporation who is the sponsor. Licensed apprentice
plumbers | ||||||
8 | shall not accumulate more than 6 years as a licensed apprentice
| ||||||
9 | plumber.
| ||||||
10 | Upon the recommendation of the Board, the Department may | ||||||
11 | require by rule
that each licensed plumber annually complete a | ||||||
12 | minimum number of hours of
classroom
instruction and provide | ||||||
13 | evidence of attending the classes before
receiving a renewal | ||||||
14 | plumber license. A continuing education requirement
| ||||||
15 | established by the Department for all licensed plumbers shall | ||||||
16 | not exceed 15
hours per year. In addition, the Department shall | ||||||
17 | by rule establish guidelines
for additional continuing | ||||||
18 | education to be required for licensed plumbers found
to have | ||||||
19 | committed repeated Plumbing Code violations. In support of | ||||||
20 | these
requirements, the Department shall by rule establish | ||||||
21 | curricula for continuing
education and requirements for | ||||||
22 | instructors and may certify instructors and
training
programs | ||||||
23 | and schools for continuing education.

24 | A plumber's license and an apprentice plumber's license may | ||||||
25 | be renewed for a
period
of one year from each succeeding May | ||||||
26 | 1st upon payment prior to May 1st of
the required renewal fee

1 | and submission of required evidence of successful completion of | ||||||
2 | any required
continuing education courses. Application for | ||||||
3 | renewal shall be on forms
provided by
the Department.
An | ||||||
4 | application
for renewal of licenses received by the Department | ||||||
5 | after May 1st shall include
the annual renewal fees plus | ||||||
6 | reinstatement
fees, provided that the apprentice plumber's | ||||||
7 | application is received
by November 1 of the same year.
| ||||||
8 | A plumber licensed pursuant to this Act whose license has | ||||||
9 | been expired
for a period of less than 5 years may apply to the | ||||||
10 | Department for reinstatement
of his or her
plumber's license. | ||||||
11 | The Department shall issue such license renewal provided
the | ||||||
12 | applicant
pays to the Department all lapsed renewal fees, plus | ||||||
13 | the reinstatement fee.
A plumber licensed pursuant to this
Act | ||||||
14 | who has permitted
his or her license to expire for more than 5 | ||||||
15 | years may apply, in writing,
to the
Department for
restoration | ||||||
16 | of his or her license. The Department shall restore his or
her
| ||||||
17 | license provided
he or she
pays to the Department the required | ||||||
18 | restoration fee and shall successfully pass
the
examination for | ||||||
19 | an Illinois plumber's license. The restoration fee includes
the
| ||||||
20 | applicant's examination fee. Failure by the applicant to | ||||||
21 | successfully pass the
plumber's license examination shall be | ||||||
22 | sufficient grounds for the Department to
withhold issuance of | ||||||
23 | the requested restoration of the applicant's plumber's
| ||||||
24 | license. The
applicant may retake the examination in accordance | ||||||
25 | with the provisions of this
Act.

26 | A retired plumber licensed under this Act who has

| |||||||
| |||||||
1 | surrendered his or her plumber's license for a period of less | ||||||
2 | than 5 years may
apply to
the Department for
reinstatement of | ||||||
3 | his or her plumber's license. The Department shall renew the
| ||||||
4 | license provided the applicant pays to the Department any | ||||||
5 | reinstatement fee
required by Department rule. A retired | ||||||
6 | plumber licensed under this Act who has
surrendered his or her | ||||||
7 | plumber's license for a period of more than 5 years may
apply
| ||||||
8 | in writing to the Department for restoration of his or her | ||||||
9 | license. The
Department shall restore his or her license | ||||||
10 | provided he or she pays to the
Department the restoration fee | ||||||
11 | required by Department rule and successfully
passes the | ||||||
12 | examination for an Illinois plumber's license. The restoration | ||||||
13 | fee
includes the applicant's examination fee. Failure by the | ||||||
14 | applicant to
successfully pass the plumber's license | ||||||
15 | examination shall be sufficient grounds
for the Department to | ||||||
16 | withhold issuance of the requested restoration of the
| ||||||
17 | applicant's plumber's license. The applicant may retake the | ||||||
18 | examination in
accordance with the provisions of this Act.

19 | Illinois licensed professional engineers and licensed | ||||||
20 | environmental practitioners who provide continuing education | ||||||
21 | for licensed plumbers are not required to have oversight of | ||||||
22 | their continuing education sponsorship or courses by any other | ||||||
23 | licensed profession or Illinois licensed plumbers, have their | ||||||
24 | programs reviewed by another licensed professional or Illinois | ||||||
25 | licensed plumber, or have another licensed professional or | ||||||
26 | Illinois licensed plumber attend or provide oversight of their |

| |||||||
1 | continuing education courses or programs. | ||||||
2 | Illinois licensed professional engineers and licensed | ||||||
3 | environmental practitioners who provide continuing education | ||||||
4 | for plumbers are not required to provide a licensed plumber of | ||||||
5 | record when submitting sponsorship or continuing education | ||||||
6 | course approval. The oversight and approval of the Department's | ||||||
7 | Plumbing Inspector shall be sufficient oversight for sponsor or | ||||||
8 | course approval submitted by Illinois licensed professional | ||||||
9 | engineers and licensed environmental practitioners. No | ||||||
10 | additional requirements for the approval for the Illinois | ||||||
11 | licensed professional engineers and licensed environmental | ||||||
12 | practitioners as a sponsor or for approval of a continuing | ||||||
13 | education course shall be mandated. | ||||||

15 | Section 99. Effective date. This Act takes effect upon | ||||||
16 | becoming law.
