AMENDMENT TO HOUSE BILL 4370

2    AMENDMENT NO. ______. Amend House Bill 4370 by replacing
3everything after the enacting clause with the following:
 
4    "(20 ILCS 2310/2310-685 rep.)
5    Section 5. The Department of Public Health Powers and
6Duties Law of the Civil Administrative Code of Illinois is
7amended by repealing Section 2310-685.
 
8    Section 10. The Illinois Health Facilities Planning Act is
9amended by changing Section 5.3 as follows:
 
10    (20 ILCS 3960/5.3)
11    (Section scheduled to be repealed on December 31, 2019)
12    Sec. 5.3. Annual report of capital expenditures.
13    (a) In addition to the State Board's authority to require
14reports, the State Board shall require each health care
15facility to submit an annual report of all capital expenditures

1in excess of $200,000 (which shall be annually adjusted to
2reflect the increase in construction costs due to inflation)
3made by the health care facility during the most recent year.
4This annual report shall consist of a brief description of the
5capital expenditure, the amount and method of financing the
6capital expenditure, the certificate of need project number if
7the project was reviewed, and the total amount of capital
8expenditures obligated for the year. Data collected from health
9care facilities pursuant to this Section shall not duplicate or
10overlap other data collected by the Department and must be
11collected as part of the State Board's Annual Questionnaires or
12supplements for health care facilities that report these data.
13    (b)(1) For the purposes of this subsection (b), "capital
14expenditures" means only expenditures required under
15subsection (a) for the erection, building, alteration,
16reconstruction, modernization, improvement, extension, or
17demolition of or by a hospital.
18    (2) If a hospital under the University of Illinois Hospital
19Act or Hospital Licensing Act that has more than 100 beds
20reports capital expenditures at or above the amount required
21under subsection (a), then the hospital shall also meet the
22reporting requirements under this subsection (b) for
23female-owned, minority-owned, veteran-owned, and small
24business enterprises with respect to those reported capital
25expenditures.
26    (3) Each hospital shall include the following information

1in its annual report:
2        (A) The hospital's capital expenditure spending goals
3    for female-owned, minority-owned, veteran-owned, and small
4    business enterprises. These goals shall be expressed as a
5    percentage of total capital expenditures reported by the
6    hospital submitting the report.
7        (B) The hospital's actual capital expenditure spending
8    for female-owned, minority-owned, veteran-owned, and small
9    business enterprises. These actual expenditures shall be
10    expressed as a percentage of total capital expenditures
11    reported by the hospital submitting the report. The report
12    may include actual spending on female-owned,
13    minority-owned, veteran-owned, and small business
14    enterprises that is less than the capital expenditure
15    threshold required to be reported under subsection (a) of
16    this Section.
17        (C) The type or types of capital expenditure for which
18    the hospital shall be actively seeking supplier diversity
19    in the next year.
20        (D) An outline of the plan developed to alert and
21    encourage female-owned, minority-owned, veteran-owned, and
22    small business enterprises providing the type or types of
23    services identified in subparagraph (C) to seek business
24    from the hospital.
25        (E) An explanation of the challenges faced in finding
26    quality vendors and any suggestions for what the Health

1    Facilities and Services Review Board could do to be helpful
2    to identify those vendors.
3        (F) A list of the certifications the hospital
4    recognizes.
5        (G) The point of contact for any potential vendor who
6    wishes to do business with the hospital and an explanation
7    of the process for a vendor to enroll with the hospital as
8    a female-owned, minority-owned, veteran-owned, or small
9    business enterprise.
10        (H) Any particular success stories to encourage other
11    hospitals to emulate best practices.
12    (4) A health care system may develop a system-wide annual
13report that includes all hospitals in order to comply with the
14requirements of this subsection (b). Each annual report shall
15include as much State-specific data as possible. If the
16submitting entity does not submit State-specific data, then the
17hospital shall include any national data it does have and
18explain why it could not submit State-specific data and how it
19intends to do so in future reports, if possible.
20    (5) Subject to appropriation, the Department of Central
21Management Services shall hold an annual workshop open to the
22public in 2017 and every year thereafter on the state of
23supplier diversity to collaboratively seek solutions to
24structural impediments to achieving stated goals, including
25testimony from subject matter experts.
26    (6) The Health Facilities and Services Review Board shall

1publish a database on its website of the point of contact for
2each hospital for supplier diversity, along with a list of
3certifications each hospital recognizes from the information
4submitted in each annual report. The Health Facilities and
5Services Review Board shall publish each annual report on its
6website and shall maintain each annual report for at least 5
7years.
8    (7) Notwithstanding any other provision of law, the Health
9Facilities and Services Review Board shall not inquire about,
10review, obtain, or in any other way consider the information
11provided in this Section when reviewing an application for a
12permit or exemption or in taking any other action under this
13Act.
14    (8) The annual report required under this subsection (b)
15shall be submitted by each hospital for its fiscal years that
16begin at least 6 months after the effective date of this
17amendatory Act of the 99th General Assembly.

19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
