AMENDMENT TO HOUSE BILL 4370

2    AMENDMENT NO. ______. Amend House Bill 4370 by replacing
3everything after the enacting clause with the following:
 
4    "(20 ILCS 2310/2310-685 rep.)
5    Section 5. The Department of Public Health Powers and
6Duties Law of the Civil Administrative Code of Illinois is
7amended by repealing Section 2310-685 (as added by Public Act
899-315).
 
9    Section 10. The Illinois Health Facilities Planning Act is
10amended by changing Section 5.3 as follows:
 
11    (20 ILCS 3960/5.3)
12    (Section scheduled to be repealed on December 31, 2019)
13    Sec. 5.3. Annual report of capital expenditures.
14    (a) In addition to the State Board's authority to require
15reports, the State Board shall require each health care

1facility to submit an annual report of all capital expenditures
2in excess of $200,000 (which shall be annually adjusted to
3reflect the increase in construction costs due to inflation)
4made by the health care facility during the most recent year.
5This annual report shall consist of a brief description of the
6capital expenditure, the amount and method of financing the
7capital expenditure, the certificate of need project number if
8the project was reviewed, and the total amount of capital
9expenditures obligated for the year. Data collected from health
10care facilities pursuant to this Section shall not duplicate or
11overlap other data collected by the Department and must be
12collected as part of the State Board's Annual Questionnaires or
13supplements for health care facilities that report these data.
14    (b)(1) For the purposes of this subsection (b), "capital
15expenditures" means only expenditures required under
16subsection (a) for the erection, building, alteration,
17reconstruction, modernization, improvement, extension, or
18demolition of or by a hospital.
19    (2) If a hospital under the University of Illinois Hospital
20Act or Hospital Licensing Act that has more than 100 beds
21reports capital expenditures at or above the amount required
22under subsection (a), then the hospital shall also meet the
23reporting requirements under this subsection (b) for
24female-owned, minority-owned, veteran-owned, and small
25business enterprises with respect to those reported capital
26expenditures.

1    (3) Each hospital shall include the following information
2in its annual report:
3        (A) The hospital's capital expenditure spending goals
4    for female-owned, minority-owned, veteran-owned, and small
5    business enterprises. These goals shall be expressed as a
6    percentage of total capital expenditures reported by the
7    hospital submitting the report.
8        (B) The hospital's actual capital expenditure spending
9    for female-owned, minority-owned, veteran-owned, and small
10    business enterprises. These actual expenditures shall be
11    expressed as a percentage of total capital expenditures
12    reported by the hospital submitting the report. The report
13    may include actual spending on female-owned,
14    minority-owned, veteran-owned, and small business
15    enterprises that is less than the capital expenditure
16    threshold required to be reported under subsection (a) of
17    this Section.
18        (C) The type or types of capital expenditure for which
19    the hospital shall be actively seeking supplier diversity
20    in the next year.
21        (D) An outline of the plan developed to alert and
22    encourage female-owned, minority-owned, veteran-owned, and
23    small business enterprises providing the type or types of
24    services identified in subparagraph (C) to seek business
25    from the hospital.
26        (E) An explanation of the challenges faced in finding

1    quality vendors and any suggestions for what the Health
2    Facilities and Services Review Board could do to be helpful
3    to identify those vendors.
4        (F) A list of the certifications the hospital
5    recognizes.
6        (G) The point of contact for any potential vendor who
7    wishes to do business with the hospital and an explanation
8    of the process for a vendor to enroll with the hospital as
9    a female-owned, minority-owned, veteran-owned, or small
10    business enterprise.
11        (H) Any particular success stories to encourage other
12    hospitals to emulate best practices.
13    (4) A health care system may develop a system-wide annual
14report that includes all hospitals in order to comply with the
15requirements of this subsection (b). Each annual report shall
16include as much State-specific data as possible. If the
17submitting entity does not submit State-specific data, then the
18hospital shall include any national data it does have and
19explain why it could not submit State-specific data and how it
20intends to do so in future reports, if possible.
21    (5) Subject to appropriation, the Department of Central
22Management Services shall hold an annual workshop open to the
23public in 2017 and every year thereafter on the state of
24supplier diversity to collaboratively seek solutions to
25structural impediments to achieving stated goals, including
26testimony from subject matter experts.

1    (6) The Health Facilities and Services Review Board shall
2publish a database on its website of the point of contact for
3each hospital for supplier diversity, along with a list of
4certifications each hospital recognizes from the information
5submitted in each annual report. The Health Facilities and
6Services Review Board shall publish each annual report on its
7website and shall maintain each annual report for at least 5
8years.
9    (7) Notwithstanding any other provision of law, the Health
10Facilities and Services Review Board shall not inquire about,
11review, obtain, or in any other way consider the information
12provided in this Section when reviewing an application for a
13permit or exemption or in taking any other action under this
14Act.
15    (8) The annual report required under this subsection (b)
16shall be submitted by each hospital for its fiscal years that
17begin at least 6 months after the effective date of this
18amendatory Act of the 99th General Assembly.

20    Section 99. Effective date. This Act takes effect upon
21becoming law.".
