5 | | This annual report shall consist of a brief description of the |
6 | | capital
expenditure, the amount and method of financing the |
7 | | capital expenditure,
the certificate of need project number if |
8 | | the project was reviewed, and the
total amount of capital |
9 | | expenditures obligated for the year.
Data collected from health |
10 | | care facilities pursuant to this Section shall
not duplicate or |
11 | | overlap other
data collected by the Department and must be |
12 | | collected as part of the State Board's
Annual
Questionnaires or |
13 | | supplements for health care facilities that report these
data.

14 | | (b)(1) For the purposes of this subsection (b), "capital |
15 | | expenditures" means only expenditures required under |
16 | | subsection (a) for the erection, building, alteration, |
17 | | reconstruction, modernization, improvement, extension, or |
18 | | demolition of or by a hospital. |
19 | | (2) If a hospital under the University of Illinois Hospital |
20 | | Act or Hospital Licensing Act that has more than 100 beds |
21 | | reports capital expenditures at or above the amount required |
22 | | under subsection (a), then the hospital shall also meet the |
23 | | reporting requirements under this subsection (b) for |
24 | | female-owned, minority-owned, veteran-owned, and small |
25 | | business enterprises with respect to those reported capital |
26 | | expenditures. |

1 | | (3) Each hospital shall include the following information |
2 | | in its annual report: |
3 | | (A) The hospital's capital expenditure spending goals |
4 | | for female-owned, minority-owned, veteran-owned, and small |
5 | | business enterprises. These goals shall be expressed as a |
6 | | percentage of total capital expenditures reported by the |
7 | | hospital submitting the report. |
8 | | (B) The hospital's actual capital expenditure spending |
9 | | for female-owned, minority-owned, veteran-owned, and small |
10 | | business enterprises. These actual expenditures shall be |
11 | | expressed as a percentage of total capital expenditures |
12 | | reported by the hospital submitting the report. The report |
13 | | may include actual spending on female-owned, |
14 | | minority-owned, veteran-owned, and small business |
15 | | enterprises that is less than the capital expenditure |
16 | | threshold required to be reported under subsection (a) of |
17 | | this Section. |
18 | | (C) The type or types of capital expenditure for which |
19 | | the hospital shall be actively seeking supplier diversity |
20 | | in the next year. |
21 | | (D) An outline of the plan developed to alert and |
22 | | encourage female-owned, minority-owned, veteran-owned, and |
23 | | small business enterprises providing the type or types of |
24 | | services identified in subparagraph (C) to seek business |
25 | | from the hospital. |
26 | | (E) An explanation of the challenges faced in finding |

1 | | quality vendors and any suggestions for what the Health |
2 | | Facilities and Services Review Board could do to be helpful |
3 | | to identify those vendors. |
4 | | (F) A list of the certifications the hospital |
5 | | recognizes. |
6 | | (G) The point of contact for any potential vendor who |
7 | | wishes to do business with the hospital and an explanation |
8 | | of the process for a vendor to enroll with the hospital as |
9 | | a female-owned, minority-owned, veteran-owned, or small |
10 | | business enterprise. |
11 | | (H) Any particular success stories to encourage other |
12 | | hospitals to emulate best practices. |
13 | | (4) A health care system may develop a system-wide annual |
14 | | report that includes all hospitals in order to comply with the |
15 | | requirements of this subsection (b). Each annual report shall |
16 | | include as much State-specific data as possible. If the |
17 | | submitting entity does not submit State-specific data, then the |
18 | | hospital shall include any national data it does have and |
19 | | explain why it could not submit State-specific data and how it |
20 | | intends to do so in future reports, if possible. |
21 | | (5) Subject to appropriation, the Department of Central |
22 | | Management Services shall hold an annual workshop open to the |
23 | | public in 2017 and every year thereafter on the state of |
24 | | supplier diversity to collaboratively seek solutions to |
25 | | structural impediments to achieving stated goals, including |
26 | | testimony from subject matter experts. |

1 | | (6) The Health Facilities and Services Review Board shall |
2 | | publish a database on its website of the point of contact for |
3 | | each hospital for supplier diversity, along with a list of |
4 | | certifications each hospital recognizes from the information |
5 | | submitted in each annual report. The Health Facilities and |
6 | | Services Review Board shall publish each annual report on its |
7 | | website and shall maintain each annual report for at least 5 |
8 | | years. |
9 | | (7) Notwithstanding any other provision of law, the Health |
10 | | Facilities and Services Review Board shall not inquire about, |
11 | | review, obtain, or in any other way consider the information |
12 | | provided in this Section when reviewing an application for a |
13 | | permit or exemption or in taking any other action under this |
14 | | Act. |
15 | | (8) The annual report required under this subsection (b) |
16 | | shall be submitted by each hospital for its fiscal years that |
17 | | begin at least 6 months after the effective date of this |
18 | | amendatory Act of the 99th General Assembly. |

20 | | Section 99. Effective date. This Act takes effect upon |
21 | | becoming law.".
