| 2 | | AMENDMENT NO. ______. Amend House Bill 5783 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 1. Short title. This Act may be cited as the | 5 | | Illinois State Fairgrounds Foundation Act. | 6 | | Section 5. Creation of Illinois State Fairgrounds | 7 | | Foundation. | 8 | | (a) The General Assembly authorizes the Department of | 9 | | Agriculture, in accordance with Section 10 of the State Agency | 10 | | Entity Creation Act, to create the Illinois State Fairgrounds | 11 | | Foundation. Under this authority, the Department of | 12 | | Agriculture shall create the Illinois State Fairgrounds | 13 | | Foundation as a not-for-profit foundation. The Department | 14 | | shall file articles of incorporation as required under the | 15 | | General Not For Profit Corporation Act of 1986 to create the | 16 | | Foundation. |

| 1 | | (b) The Foundation's Board of Directors shall be appointed | 2 | | as follows: | 3 | | (1) 2 by the President of the Senate, 1 for a 2-year | 4 | | term and 1 for a 4-year term; | 5 | | (2) 2 by the Minority Leader of the Senate, 1 for a | 6 | | 2-year term and 1 for a 4-year term; | 7 | | (3) 2 by the Speaker of the House of Representatives, 1 | 8 | | for a 2-year term and 1 for a 4-year term; | 9 | | (4) 2 by the Minority Leader of the House of | 10 | | Representatives, 1 for a 2-year term and 1 for a 4-year | 11 | | term; and | 12 | | (5) 4 by the Governor, 2 for a 2-year term each and 2 | 13 | | for a 4-year term each. | 14 | | (c) At the expiration of the 2-year terms and the 4-year | 15 | | terms, each successive appointment shall be for a 4-year term. | 16 | | Vacancies shall be filled by the official who made the prior | 17 | | appointment. The Director of Agriculture shall chair the Board | 18 | | of Directors of the Foundation. No member of the Board of | 19 | | Directors may receive compensation for his or her services to | 20 | | the Foundation. | 21 | | Section 10. Foundation purposes. The purposes of the | 22 | | Foundation are: to promote, support, assist, sustain, and | 23 | | encourage the charitable, educational, scientific, and | 24 | | agricultural programs, projects, and policies of the | 25 | | Department of Agriculture and the Illinois State Fair; to |

| 1 | | solicit and accept aid or contributions consistent with the | 2 | | stated intent of the donor and the goals of the Foundation, | 3 | | including, but not limited to, capital funding for the | 4 | | improvement, maintenance, or construction of buildings and | 5 | | facilities at the Illinois State Fairgrounds located in | 6 | | Springfield and DuQuoin; to accept grants for the acquisition, | 7 | | construction, improvement, and development of potential | 8 | | Foundation projects; to solicit and generate private funding | 9 | | and donations that assist in enhancing and preserving Illinois' | 10 | | agricultural heritage and State Fairgrounds, both in | 11 | | Springfield and DuQuoin, and the infrastructure, including | 12 | | roads, buildings, permanent exhibits, grounds, and facilities | 13 | | at both Fairgrounds; and to engage generally in other lawful | 14 | | endeavors consistent with the foregoing purposes. The | 15 | | Foundation shall operate within the provisions of the General | 16 | | Not For Profit Corporation Act of 1986. | 17 | | Section 15. Organization, powers, and duties of the | 18 | | Foundation. | 19 | | (a) As soon as practical after the Foundation is created, | 20 | | the Board of Directors shall meet, organize, and designate, by | 21 | | majority vote, a treasurer, secretary, and any additional | 22 | | officers that may be needed to carry out the activities of the | 23 | | Foundation, and shall adopt bylaws of the Foundation. The | 24 | | Department of Agriculture may adopt other rules deemed | 25 | | necessary to govern Foundation procedures. |

| 1 | | (b) The Foundation may accept gifts or grants from the | 2 | | federal government, its agencies or officers, or from any | 3 | | person, firm, or corporation, and may expend receipts on | 4 | | activities that it considers suitable to the performance of its | 5 | | duties under this Act and consistent with any requirement of | 6 | | the grant, gift, or bequest. Funds collected by the Foundation | 7 | | shall be considered private funds, except those received from | 8 | | public entities, and shall be held in an appropriate account | 9 | | outside of the State Treasury. Private funds collected by the | 10 | | Foundation are not subject to the Public Funds Investment Act. | 11 | | The treasurer of the Foundation shall be custodian of all | 12 | | Foundation funds. The Foundation's accounts and books shall be | 13 | | set up and maintained in a manner approved by the Auditor | 14 | | General; and the Foundation and its officers shall be | 15 | | responsible for the approval of recording of receipts, approval | 16 | | of payments, and the proper filing of required reports. The | 17 | | Foundation may be assisted in carrying out its functions by | 18 | | personnel of the Department of Agriculture. The Department | 19 | | shall provide reasonable assistance to the Foundation to | 20 | | achieve the purposes of the Foundation. The Foundation shall | 21 | | cooperate fully with the boards, commissions, agencies, | 22 | | departments, and institutions of the State. The funds held and | 23 | | made available by the Illinois State Fairgrounds Foundation | 24 | | shall be subject to financial and compliance audits by the | 25 | | Auditor General in compliance with the Illinois State Auditing | 26 | | Act. |

| 1 | | (c) The Foundation shall not have any power of eminent | 2 | | domain. | 3 | | (d) The Foundation shall be considered a public body under | 4 | | the Prevailing Wage Act. Any project, including but not limited | 5 | | to improvement, maintenance, and construction of | 6 | | infrastructure, that is funded in whole or in part by the | 7 | | Foundation shall be considered a public work as defined by the | 8 | | Prevailing Wage Act. | 9 | | Section 20. Disclosure to donors of exemption from Public | 10 | | Funds Investment Act. The Foundation must provide a written | 11 | | notice to any entity providing a gift, grant, or bequest to the | 12 | | Foundation that the Foundation is not subject to the provisions | 13 | | of the Public Funds Investment Act which places limitations on | 14 | | the types of securities in which a public agency may invest | 15 | | public funds. | 16 | | Section 105. The Department of Natural Resources Act is | 17 | | amended by changing Sections 20-5 and 20-15 as follows:

| 19 | | Sec. 20-5. State Museum. The State shall operate an | 20 | | Illinois State Museum in Springfield and at branch sites at | 21 | | Dickson Mounds, Lockport, Rend Lake, and the James R. Thompson | 22 | | Center. The Illinois State Museum and all branch sites shall be | 23 | | open to the public. The Illinois State Museum shall operate a |

| 1 | | research and collections center to research, preserve, and | 2 | | maintain access to the extensive Illinois State Museum | 3 | | collections. The Department of Natural Resources
shall have | 4 | | within it the office of the Illinois State Museum. The
Board of | 5 | | the Illinois State Museum is retained as the advisory governing
| 6 | | board for the State Museum.

Entrance fee. | 10 | | The Department may set , by the Director, by administrative | 11 | | rule an entrance fee for visitors to the Illinois State Museum. | 12 | | A different fee may be charged for different classes of | 13 | | visitors. The fee assessed by this Section shall be deposited | 14 | | into the Illinois State Museum Fund for the Department to use | 15 | | to support the Illinois State Museum. The monies deposited into | 16 | | the Illinois State Museum Fund under this Section shall not be | 17 | | subject to administrative charges or chargebacks unless | 18 | | otherwise authorized by this Act.

| 1 | | Sec. 10. Employment and Economic Opportunity for Persons | 2 | | with Disabilities Task Force. | 3 | | (a) The Employment and Economic Opportunity for Persons | 4 | | with Disabilities Task Force is created. | 5 | | (b) The Employment and Economic Opportunity for Persons | 6 | | with Disabilities Task Force shall be appointed and hold its | 7 | | first meeting within 90 days after the effective date of this | 8 | | Act, be convened by the Governor, and operate with | 9 | | administrative support from the Illinois Department of Human | 10 | | Services Employment Security . | 11 | | (c) The Task Force shall be comprised of the following | 12 | | representatives of State Government: a high-ranking member of | 13 | | the Governor's management team, designated by the Governor; | 14 | | representatives of each division of the Department of Human | 15 | | Services, designated by the Secretary of Human Services; the | 16 | | Director of Healthcare and Family Services, or his or her | 17 | | designee; the Director of Veterans' Affairs or his or her | 18 | | designee; the Director of Commerce and Economic Opportunity or | 19 | | his or her designee; the Director of Employment Security or his | 20 | | or her designee; the Executive Director of the Illinois Council | 21 | | on Developmental Disabilities or his or her designee; and the | 22 | | State Superintendent of Education or his or her designee. | 23 | | (d) The Task Force shall also consist of no more than 15 | 24 | | public members who shall be appointed by the Governor and who | 25 | | represent the following constituencies: statewide | 26 | | organizations that advocate for persons with physical, |

| 1 | | developmental and psychiatric disabilities, entities with | 2 | | expertise in assistive technology devices and services for | 3 | | persons with disabilities, advocates for veterans with | 4 | | disabilities, centers for independent living, disability | 5 | | services providers, organized labor, higher education, the | 6 | | private sector business community, entities that provide | 7 | | employment and training services to persons with disabilities, | 8 | | and at least 5 persons who have a disability. | 9 | | (e) The Task Force shall be co-chaired by the | 10 | | representative of the Governor and a public member who shall be | 11 | | chosen by the other public members of the Task Force. | 12 | | (f) The Task Force members shall serve voluntarily and | 13 | | without compensation. Persons with disabilities serving on the | 14 | | Task Force shall be accommodated to enable them to fully | 15 | | participate in Task Force activities. | 16 | | (g) The co-chairs of the Task Force shall extend an | 17 | | invitation to chairs and minority spokespersons of appropriate | 18 | | legislative committees to attend all meetings of the Task | 19 | | Force, and may invite other individuals who are not members of | 20 | | the Task Force to participate in subcommittees of the Task | 21 | | Force or to take part in discussions of topics for which those | 22 | | individuals have particular expertise. | 23 | | (h) The Task Force shall coordinate its work with existing | 24 | | State advisory bodies whose work may include employment and | 25 | | economic opportunity for persons with disabilities.

| 1 | | Section 999. Effective date. This Act takes effect upon | 2 | | becoming law.".
