| 1 | | AN ACT concerning animals.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Animal Control Act is amended by changing | 5 | | Sections 8 and 13 as follows:
| 6 | | (510 ILCS 5/8) (from Ch. 8, par. 358)
| 7 | | Sec. 8. Rabies inoculation. Every owner of a dog 4 months | 8 | | or more of age shall have each dog
inoculated against rabies
by | 9 | | a licensed veterinarian. Every dog shall
have a second rabies | 10 | | vaccination within one year of the first. Terms of
subsequent
| 11 | | vaccine administration and duration of immunity must be in | 12 | | compliance with USDA
licenses of vaccines used. A veterinarian | 13 | | immunizing a dog, cat, or ferret against rabies shall provide | 14 | | the Administrator of the county in which the dog, cat, or | 15 | | ferret resides with a certificate of immunization. Evidence of | 16 | | such rabies
inoculation shall be entered on a certificate the | 17 | | form of which shall be
approved by the Board and which shall | 18 | | contain the microchip number of the dog, cat, or ferret animal | 19 | | if it has one and which shall be signed by the licensed
| 20 | | veterinarian administering the vaccine. Only one dog, cat, or | 21 | | ferret shall be included on each certificate. Veterinarians who | 22 | | inoculate a dog
shall procure from the County Animal

| 1 | | tags, one to be issued with each inoculation certificate. Only | 2 | | one dog
shall be included on each certificate. The veterinarian | 3 | | immunizing or
microchipping an animal
shall
provide the
| 4 | | Administrator of the county in which the animal resides with a | 5 | | certificate of immunization and microchip number. The
Board | 6 | | shall cause a rabies
inoculation tag to be issued, at a fee | 7 | | established by the Board
for each
dog inoculated against | 8 | | rabies.
| 9 | | Rabies vaccine for use on animals shall be sold or | 10 | | distributed only to
and used only by licensed veterinarians. | 11 | | Such rabies vaccine shall be
licensed by the United States | 12 | | Department of Agriculture.
| 13 | | If a licensed veterinarian determines in writing that a | 14 | | rabies inoculation would compromise an animal's health, then | 15 | | the animal shall be exempt from the rabies inoculation shot | 16 | | requirement, however, but the owner is must still be | 17 | | responsible for the tag fees.
| 18 | | If a bite occurs from an exempt animal, the exempt animal | 19 | | shall be treated as an unvaccinated animal. If the animal is | 20 | | exempt, the animal shall be re-examined by a licensed | 21 | | veterinarian on no less than an annual basis and be vaccinated | 22 | | against rabies as soon as the animal's health permits. | 23 | | (Source: P.A. 93-548, eff. 8-19-03; 94-639, eff. 8-22-05.)

| 1 | | (a) Except as otherwise provided in subsections subsection | 2 | | (b) and (c) of this Section, when
the Administrator or, if the | 3 | | Administrator is not a veterinarian, the Deputy
Administrator | 4 | | receives information that any person has been
bitten by an | 5 | | animal, the Administrator or, if the
Administrator is not a | 6 | | veterinarian, the Deputy Administrator, or his or
her | 7 | | authorized
representative, shall have such dog or other animal | 8 | | confined
under the
observation of a licensed veterinarian for a | 9 | | period of 10 days . The confinement shall be for a period of not | 10 | | less than 10 days from the date the bite occurred and shall | 11 | | continue until the animal has been examined and released from | 12 | | confinement by a licensed veterinarian. The Administrator or, | 13 | | if the Administrator is not a veterinarian, the Deputy | 14 | | Administrator
Department may permit such confinement to be | 15 | | reduced to a
period of less than 10 days. | 16 | | (a-5) The owner, or if the owner is unavailable, an agent | 17 | | or caretaker of an animal documented to have bitten a person | 18 | | shall present the animal to a licensed veterinarian within 24 | 19 | | hours. A veterinarian presented with an animal documented to | 20 | | have bitten a person shall make a record of report the
clinical
| 21 | | condition of the animal immediately . , with confirmation in
| 22 | | writing to the Administrator or, if the Administrator is not a | 23 | | veterinarian,
the
Deputy Administrator within 24 hours after | 24 | | the animal
is presented for examination, giving the owner's | 25 | | name, address, the date of
confinement, the breed, description, | 26 | | age, and sex of the
animal, and whether the animal has been |

or neutered, on appropriate
forms approved by the | 2 | | Department. The Administrator or, if the Administrator
is not
a | 3 | | veterinarian, the Deputy Administrator shall notify the | 4 | | attending physician
or responsible health agency. At the
end of | 5 | | the confinement period, the animal shall be examined by a | 6 | | licensed veterinarian, inoculated against rabies, if eligible, | 7 | | and microchipped, if the dog or cat has not been already, at | 8 | | the expense of the owner. The veterinarian shall submit a | 9 | | written
report listing the owner's name, address, dates of | 10 | | confinement, dates of examination, species, breed, | 11 | | description, age, sex, and microchip number of the animal to | 12 | | the Administrator or, if the Administrator is not a | 13 | | veterinarian,
the Deputy
Administrator advising him or her of | 14 | | the clinical condition and the final disposition of
the animal | 15 | | on appropriate forms approved by the Department. The | 16 | | Administrator shall notify the person who has been bitten, and | 17 | | in the case of confirmed rabies in the animal, the attending | 18 | | physician or responsible health agency advising of the clinical | 19 | | condition of the animal. When
evidence is presented that the | 20 | | animal was inoculated
against
rabies within the time prescribed | 21 | | by law, it shall be confined in
a house, or in a manner which | 22 | | will prohibit it from biting any person
for a period of 10 | 23 | | days, if a licensed veterinarian adjudges such confinement | 24 | | satisfactory. The Department may permit such confinement to be | 25 | | reduced to a period of less
than 10 days. At the end of the | 26 | | confinement period, the
animal shall be examined by a licensed

| 1 | | veterinarian.
| 2 | | (a-10) When the Administrator or, if the Administrator is | 3 | | not a veterinarian, the Deputy Administrator or his or her | 4 | | authorized representative receives information that a person | 5 | | has been bitten by an animal and evidence is presented that the | 6 | | animal at the time the bite occurred was inoculated against | 7 | | rabies within the time prescribed by law, the animal may be | 8 | | confined in a house, or in a manner which will prohibit the | 9 | | animal from biting a person, if the Administrator, Deputy | 10 | | Administrator, or his or her authorized representative | 11 | | determines the confinement satisfactory. The confinement shall | 12 | | be for a period of not less than 10 days from the date the bite | 13 | | occurred and shall continue until the animal has been examined | 14 | | and released from confinement by a licensed veterinarian. The | 15 | | Administrator or, if the Administrator is not a veterinarian, | 16 | | the Deputy Administrator may instruct the owner, agent, or | 17 | | caretaker to have the animal examined by a licensed | 18 | | veterinarian immediately. The Administrator or, if the | 19 | | Administrator is not a veterinarian, the Deputy Administrator | 20 | | may permit the confinement to be reduced to a period of less | 21 | | than 10 days. At the end of the confinement period, the animal | 22 | | shall be examined by a licensed veterinarian and microchipped, | 23 | | if the dog or cat is not already, at the expense of the owner. | 24 | | The veterinarian shall submit a written report listing the | 25 | | owner's name, address, dates of examination, species, breed, | 26 | | description, age, sex, and microchip number of the animal to |

| 1 | | the Administrator advising him or her of the clinical condition | 2 | | and the final disposition of the animal on appropriate forms | 3 | | approved by the Department. The Administrator shall notify the | 4 | | person who has been bitten and, in case of confirmed rabies in | 5 | | the animal, the attending physician or responsible health | 6 | | agency advising of the clinical condition of the animal. | 7 | | (a-15) Any person having knowledge that any person has been
| 8 | | bitten by an animal shall
notify the
Administrator or, if the | 9 | | Administrator is not a veterinarian, the Deputy
Administrator | 10 | | within 24 hours
promptly . | 11 | | (a-20) It is unlawful for the owner of the animal
to | 12 | | conceal the whereabouts,
euthanize, sell, give away, or | 13 | | otherwise dispose of any
animal known to have bitten a person, | 14 | | until it is examined and released from confinement by the
| 15 | | Administrator or, if the Administrator is not a veterinarian, | 16 | | the Deputy
Administrator, or licensed veterinarian or his or | 17 | | her authorized representative . It is unlawful
for
the
owner of | 18 | | the animal to refuse or fail to immediately comply with
the
| 19 | | reasonable written or printed instructions made by the | 20 | | Administrator or,
if
the Administrator is not a veterinarian, | 21 | | the Deputy Administrator, or
his or her
authorized | 22 | | representative. If such instructions cannot be delivered in
| 23 | | person, they shall be mailed to the owner of the
animal by
| 24 | | regular mail. Any expense incurred in the
handling of an animal | 25 | | under this Section and Section
12 shall
be borne by the owner. | 26 | | The owner of a biting animal must also remit to the Department |

| 1 | | of Public Health, for deposit into the Pet Population Control | 2 | | Fund, a $25 public safety fine within 30 days after notice.
| 3 | | (b) When a person has been bitten by a police dog that is | 4 | | currently vaccinated against rabies,
the police dog may | 5 | | continue to perform
its duties for the peace officer or law | 6 | | enforcement agency and any period
of
observation of the police | 7 | | dog may be under the
supervision of a peace officer.
The | 8 | | supervision shall consist of the dog being locked in a kennel,
| 9 | | performing its official duties in a police vehicle, or | 10 | | remaining under the
constant supervision of its police handler.
| 11 | | (c) When a person has been bitten by a search and rescue | 12 | | dog that is currently vaccinated against rabies, the search and | 13 | | rescue dog may continue to perform its duties for the handler | 14 | | or owner or agency and any period of observation of the dog may | 15 | | be under the supervision of its handler or owner. The | 16 | | supervision shall consist of the dog being locked in a kennel, | 17 | | performing its official duties in a vehicle, or remaining under | 18 | | the constant supervision of its handler or owner. | 19 | | (d) Any person convicted of violating subsection (a-20) of | 20 | | this Section is guilty of a Class A misdemeanor for a first | 21 | | violation. | 24 | | Section 99. Effective date. This Act takes effect upon | 25 | | becoming law.
