AMENDMENT TO HOUSE BILL 623

2    AMENDMENT NO. ______. Amend House Bill 623 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Findings. Identity theft is a major concern for
5the State of Illinois and its employees in both the receipt and
6management of personal funds. Easy access to salary information
7by identity thieves makes it easier for them to open new lines
8of credit in their victims' names. Preventing reporting of the
9exact amount of State employee salaries preserves employee
10privacy by lessening the ease with which identity thieves
11obtain information and helps protect State employees from
12identity theft.
 
13    Section 5. The State Comptroller Act is amended by changing
14Sections 20 and 27 as follows:

1    Sec. 20. Annual report. The Comptroller shall annually, as
2soon as possible after the close of the fiscal year but no
3later than December 31, make out and present to the Governor,
4the President of the Senate, the Speaker of the House of
5Representatives, the Minority Leader of the Senate, and the
6Minority Leader of the House of Representatives a report,
7showing the amount of warrants drawn on the treasury, on other
8funds held by the State Treasurer and on any public funds held
9by State agencies, during the preceding fiscal year, and
10stating, particularly, on what account they were drawn, and if
11drawn on the contingent fund, to whom and for what they were
12issued. He or she shall, also, at the same time, report to the
13Governor, the President of the Senate, the Speaker of the House
14of Representatives, the Minority Leader of the Senate, and the
15Minority Leader of the House of Representatives the amount of
16money received into the treasury, into other funds held by the
17State Treasurer and into any other funds held by State agencies
18during the preceding fiscal year, and stating particularly, the
19source from which the same may be derived, and also a general
20account of all the business of his office during the preceding
21fiscal year. The report shall also summarize for the previous
22fiscal year the information required under Section 19.
23    Within 60 days after the expiration of each calendar year,
24the Comptroller shall compile, from records maintained and
25available in his office, a list of all persons including those
26employed in the Office of the Comptroller, who have been

1employed by the State during the past calendar year and paid
2from funds in the hands of the State Treasurer.
3    The list shall be arranged according to counties and shall
4state in alphabetical order the name of each employee, the
5address in the county in which he votes, except as specified
6below, the position and the total salary paid to him or her
7during the past calendar year, rounded to the nearest hundred
8dollar. For persons employed by the Department of Corrections,
9Department of Children and Family Services, Department of
10Juvenile Justice, Office of the State's Attorneys Appellate
11Prosecutor, and the Department of State Police, as well as
12their spouses, no address shall be listed. The list so compiled
13and arranged shall be kept on file in the office of the
14Comptroller and be open to inspection by the public at all
15times.
16    No person who utilizes the names obtained from this list
17for solicitation shall represent that such solicitation is
18authorized by any officer or agency of the State of Illinois.
19Violation of this provision is a Business Offense punishable by
20a fine not to exceed $3,000.

23    Sec. 27. Comptroller's online ledger. The Comptroller
24shall establish and maintain an online repository of the
25State's financial transactions, to be known as the

1Comptroller's "Online Ledger". The Comptroller shall establish
2rules and regulations pertaining to the establishment and
3maintenance of the "Online Ledger". Any listing of an
4immediately preceding year's amount of State employee salaries
5on the "Online Ledger" shall list the total amount paid to a
6State employee during that past calendar year, or a monthly
7reporting of a State employee's salary from that past calendar
8year, as rounded to the nearest hundred dollar. Any monthly
9reporting of a State employee's salary for the current year
10shall also be listed as rounded to the nearest hundred dollar.
11The Comptroller, in his or her discretion, may list the
12unadjusted total salary amount paid to a State employee for any
13previous year other than the rounded salary amount for the
14immediately preceding calendar year.
