1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
514-1.09a and by adding Sections 10-20.60 and 34-18.53 as
6follows:
 
7    (105 ILCS 5/10-20.60 new)
8    Sec. 10-20.60. School social worker. A school board may
9employ school social workers who have graduated with a master's
10or higher degree in social work from an accredited graduate
11school of social work and have such additional qualifications
12as may be required by the State Board of Education and who hold
13a Professional Educator License with a school support personnel
14endorsement for school social work pursuant to Section 21B-25
15of this Code. Only persons so licensed and endorsed may use the
16title "school social worker". A school social worker may
17provide individual and group services to the general student
18population and to students with disabilities pursuant to
19Article 14 of this Code and rules set forth in 23 Ill. Adm.
20Code 226, Special Education, adopted by the State Board of
21Education and may provide support and consultation to
22administrators, teachers, and other school personnel
23consistent with their professional qualifications and the

1provisions of this Code and other applicable laws. School
2districts may employ a sufficient number of school social
3workers to address the needs of their students and schools and
4may maintain the nationally recommended student-to-school
5social worker ratio of 250 to 1. A school social worker may not
6provide such services outside his or her employment to any
7student in the district or districts that employ the school
8social worker.
 
9    (105 ILCS 5/14-1.09a)  (from Ch. 122, par. 14-1.09a)
10    Sec. 14-1.09a. School social worker. "School Social
11Worker" means a social worker who has graduated with a master's
12or higher degree in social work from an accredited graduate
13school of social work and who has such additional
14qualifications as may be required by the State Board of
15Education and who holds a Professional Educator License with a
16school support personnel endorsement for school social work
17pursuant to Section 21B-25 School Service Personnel
18Certificate endorsed for school social work issued pursuant to
19Section 21-25 of this Code. Only persons Persons so licensed
20and endorsed certified may use the title "school social
21worker". A social worker and may offer school social work
22services as provided in this Code and other applicable laws and
23as which are limited to those services set forth in 23 Ill.

1Education, governing the provision of special education and
2related services to children with disabilities and
3requirements for the treatment of children with disabilities
4between the ages of 3 and 21. School social workers may make
5evaluations, recommendations or interventions regarding the
6placement of children in educational programs or special
7education classes. However, a school social worker shall not
8provide such services outside his or her employment to any
9student in the district or districts which employ such school
10social worker.

12    Section 99. Effective date. This Act takes effect upon
13becoming law.
