SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/8.52 new

    Amends the State Finance Act. Authorizes transfers from the designated funds into the Commitment to Human Services Fund for the sole purpose of providing funding for domestic violence programs funded by the Department of Human Services through the end of fiscal year 2017. Effective immediately.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Section 8.52 as follows:
 
6    (30 ILCS 105/8.52 new)
7    Sec. 8.52. Special fund transfers.
8    (a) In order to maintain the integrity of special funds and
9improve the stability in the Commitment to Human Services Fund,
10the following transfers are authorized from the designated
11Funds into the Commitment to Human Services Fund:
12    Death Penalty Abolition Fund...................$1,000,000
13    Statewide 911 Fund.............................$1,000,000
14    Public Health Special State Projects Fund......$1,000,000
15    Solid Waste Management Fund....................$1,000,000
16    Trauma Center Fund.............................$1,000,000
17    Used Tire Management Fund......................$1,000,000
18    Violent Crime Victims Assistance Fund..........$1,000,000
19    Lobbyist Registration Fund.......................$500,000
20    Motor Vehicle Theft Prevention Fund..............$500,000
21    Vehicle Inspection Fund..........................$500,000
22    Illinois Power Agency Renewable Energy Fund......$500,000

1    (b) On and after the effective date of this amendatory Act
2of the 100th General Assembly through the end of State fiscal
3year 2017, when any of the funds listed in subsection (a) has
4insufficient cash from which the State Comptroller may make
5expenditures properly supported by appropriations from the
6fund, then, at the direction of the Director of the Governor's
7Office of Management and Budget, the State Treasurer and State
8Comptroller shall transfer from the Commitment to Human
9Services Fund to the fund only such amount as is immediately
10necessary to satisfy outstanding expenditure obligations on a
11timely basis, subject to the provisions of the State Prompt
12Payment Act. All or a portion of the amounts transferred from
13the Commitment to Human Services Fund to a fund pursuant to
14this subsection (b) from time to time may be re-transferred by
15the State Comptroller and the State Treasurer from the
16receiving fund into the Commitment to Human Services Fund as
17soon as and to the extent that deposits are made into or
18receipts are collected by the receiving fund.
19    (c) The State Treasurer and State Comptroller shall
20transfer the amounts designated under subsection (a) of this
21Section as soon as may be practicable after receiving the
22direction to transfer from the Director of the Governor's
23Office of Management and Budget. If the Director of the
24Governor's Office of Management and Budget determines that any
25transfer authorized by this Section from a special fund under
26subsection (a) either (i) jeopardizes federal funding based on

1a written communication from a federal official or (ii)
2violates an order of a court of competent jurisdiction, then
3the Director may order the State Treasurer and State
4Comptroller, in writing, to transfer from the Commitment to
5Human Services Fund to that listed special fund all or part of
6the amounts transferred from that special fund under subsection
7(a).
8    (d) Notwithstanding any provision of law to the contrary,
9the transfers in this Section shall be made through the end of
10State fiscal year 2017 for the sole purpose of providing
11funding for domestic violence programs funded by the Department
12of Human Services.
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.
