| 1 | | AN ACT concerning State government.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Identification Card Act is amended | 5 | | by changing Sections 8 and 12 as follows:
| 6 | | (15 ILCS 335/8) (from Ch. 124, par. 28)
| 7 | | Sec. 8. Expiration.
| 8 | | (a) Except as otherwise provided in this Section: | 9 | | (1) Every identification card issued hereunder,
except | 10 | | to persons who have reached their 15th birthday, but are | 11 | | not yet 21
years of age, persons who are 65 years of age or | 12 | | older, and persons who are
issued an Illinois Person with a | 13 | | Disability Identification Card, shall
expire 5 years from | 14 | | the ensuing birthday of the
applicant and a renewal
shall | 15 | | expire 5 years thereafter. | 16 | | (2) Every original or renewal identification
card | 17 | | issued to a person who has reached his or her 15th | 18 | | birthday, but is
not yet
21 years of age shall expire 3 | 19 | | months after the person's 21st birthday.
| 20 | | (b) Except as provided elsewhere in this Section, every | 21 | | original, renewal, or duplicate: (i) non-Real ID | 22 | | identification card issued prior to July 1, 2017,
to a
person | 23 | | who has reached his or her 65th birthday shall be permanent and |

not be renewed; (ii) REAL ID compliant identification card | 2 | | issued on or after July 1, 2017, to a person who has reached | 3 | | his or her 65th birthday shall expire 8 years thereafter; (iii) | 4 | | non-Real ID Illinois Person with a Disability Identification | 5 | | Card issued prior to July 1, 2017, to a qualifying person shall | 6 | | expire 10 years
thereafter; and (iv) REAL ID compliant Illinois | 7 | | Person with a Disability Identification Card issued on or after | 8 | | July 1, 2017, shall expire 8 years thereafter. The Secretary of | 9 | | State shall promulgate rules setting forth the
conditions and | 10 | | criteria for the renewal of all Illinois Person with a | 11 | | Disability Identification Cards.
| 12 | | (c) Every identification card or Illinois Person with a | 13 | | Disability Identification Card issued under this Act to an | 14 | | applicant who is not a United States citizen or permanent | 15 | | resident shall be marked "Limited Term" and shall expire on | 16 | | whichever is the earlier date of the following: | 17 | | (1) as provided under subsection (a) or (b) of this | 18 | | Section; | 19 | | (2) on the date the applicant's authorized stay in the | 20 | | United States terminates; or | 21 | | (3) if the applicant's authorized stay is indefinite | 22 | | and the applicant is applying for a Limited Term REAL ID | 23 | | compliant identification card, one year from the date of | 24 | | issuance of the card. | 25 | | (Source: P.A. 99-305, eff. 1-1-16; 99-511, eff. 1-1-17; | 26 | | 100-248, eff. 8-22-17.)

| 23 | | All fees collected under this Act shall be paid into the | 24 | | Road Fund of the State treasury, except that the following | 25 | | amounts shall be paid into the General Revenue Fund:
(i) 80% of | 26 | | the fee for an original, renewal, or duplicate Illinois |

| 1 | | Identification Card issued on or after January 1, 2005;
and | 2 | | (ii) 80% of the fee for a corrected Illinois Identification | 3 | | Card issued on or after January 1, 2005.
| 4 | | An individual, who resides in a veterans home or veterans | 5 | | hospital
operated by the State or federal government, who makes | 6 | | an application for an
Illinois Identification Card to be issued | 7 | | at no fee, must submit, along
with the application, an | 8 | | affirmation by the applicant on a form provided by
the | 9 | | Secretary of State, that such person resides in a veterans home | 10 | | or
veterans hospital operated by the State or federal | 11 | | government. | 12 | | The application of a homeless individual for an Illinois | 13 | | Identification Card to be issued at no fee must be accompanied | 14 | | by an affirmation by a qualified person, as defined in Section | 15 | | 4C of this Act, on a form provided by the Secretary of State, | 16 | | that the applicant is currently homeless as defined in Section | 17 | | 1A of this Act. | 18 | | For the application for the first Illinois Identification | 19 | | Card of a youth for whom the Department of Children and Family | 20 | | Services is legally responsible or a foster child to be issued | 21 | | at no fee, the youth must submit, along with the application, | 22 | | an affirmation by his or her court appointed attorney or an | 23 | | employee of the Department of Children and Family Services on a | 24 | | form provided by the Secretary of State, that the person is a | 25 | | youth for whom the Department of Children and Family Services | 26 | | is legally responsible or a foster child. |

| 1 | | The fee for any duplicate identification card shall be | 2 | | waived for any person who presents the Secretary of State's | 3 | | Office with a police report showing that his or her | 4 | | identification card was stolen. | 5 | | The fee for any duplicate identification card shall be | 6 | | waived for any person age 60 or older whose identification card | 7 | | has been lost or stolen. | 8 | | As used in this Section, "active-duty member of the United | 9 | | States Armed Forces" means a member of the Armed Services or | 10 | | Reserve Forces of the United States or a member of the Illinois | 11 | | National Guard who is called to active duty pursuant to an | 12 | | executive order of the President of the United States, an act | 13 | | of the Congress of the United States, or an order of the | 14 | | Governor. | 15 | | (Source: P.A. 99-607, eff. 7-22-16; 99-659, eff. 7-28-17; | 16 | | 99-907, eff. 7-1-17; 100-201, eff. 8-18-17.)
| 17 | | Section 99. Effective date. This Act takes effect upon | 18 | | becoming law.
