SYNOPSIS AS INTRODUCED:

225 ILCS 60/22.6 new

Amends the Medical Practice Act of 1987. Exempts physicians from disciplinary action by the Department of Financial and Professional Regulation based solely upon the licensee's recommendation or provision of a treatment method for Lyme disease or other tick-borne disease if specified criteria are met. Effective immediately.

A BILL FOR

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Medical Practice Act of 1987 is amended by adding Section 22.6 as follows:

(225 ILCS 60/22.6 new)

Sec. 22.6. Discipline exemption for Lyme disease treatment.

(a) A person licensed by the Department to practice medicine under this Act shall not be subject to disciplinary action based solely upon the licensee's recommendation or provision of a treatment method for Lyme disease or other tick-borne disease if the recommendation or provision of the treatment meets all of the following criteria:

(1) the treatment is provided after an examination is performed and the patient has given informed consent;

(2) the licensee identifies a medical reason for recommending or providing the treatment;

(3) the treatment is provided after the licensee informs the patient about other recognized treatment options and describes to the patient the licensee's education, experience, and credentials regarding the treatment of Lyme disease or other tick-borne disease;

(4) the licensee uses the licensee's own medical judgment based on a thorough review of all available clinical information on Lyme disease or other tick-borne disease literature to determine the best course of treatment for the individual patient; and

(5) the treatment will not, in the opinion of licensee, result in the direct and proximate death of or serious bodily injury to the patient.

Section 99. Effective date. This Act takes effect upon becoming law.
