AMENDMENT TO SENATE BILL 695

2    AMENDMENT NO. ______. Amend Senate Bill 695 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Counties Code is amended by changing
5Section 3-7002 as follows:
 
6    (55 ILCS 5/3-7002)  (from Ch. 34, par. 3-7002)
7    Sec. 3-7002. Cook County Sheriff's Merit Board. There is
8created the Cook County Sheriff's Merit Board, hereinafter
9called the Board, consisting of 7 members appointed by the
10Sheriff with the advice and consent of three-fifths of the
11county board, except that on and after the effective date of
12this amendatory Act of 1997, the Sheriff may appoint 2
13additional members, with the advice and consent of three-fifths
14of the county board, at his or her discretion. Of the members
15first appointed, one shall serve until the third Monday in
16March, 1965 one until the third Monday in March, 1967, and one

1until the third Monday in March, 1969. Of the 2 additional
2members first appointed under authority of this amendatory Act
3of 1991, one shall serve until the third Monday in March, 1995,
4and one until the third Monday in March, 1997. Of the 2
5additional members first appointed under the authority of this
6amendatory Act of the 91st General Assembly, one shall serve
7until the third Monday in March, 2005 and one shall serve until
8the third Monday in March, 2006.
9    Upon the expiration of the terms of office of those first
10appointed (including the 2 additional members first appointed
11under authority of this amendatory Act of 1991 and under the
12authority of this amendatory Act of the 91st General Assembly),
13their respective successors shall be appointed to hold office
14from the third Monday in March of the year of their respective
15appointments for a term of 6 years and until their successors
16are appointed and qualified for a like term. As additional
17members are appointed under authority of this amendatory Act of
181997, their terms shall be set to be staggered consistently
19with the terms of the existing Board members.
20    Notwithstanding any provision in this Section to the
21contrary, the term of office of each member of the Board is
22abolished on the effective date of this amendatory Act of the
23100th General Assembly. Of the 7 members first appointed after
24the effective date of this Act of the 100th General Assembly, 2
25shall serve until the third Monday in March 2019, 2 shall serve
26until the third Monday in March 2021, and 3 members shall serve

1until the third Monday in March 2023. The terms of the 2
2additional members first appointed after the effective date of
3this Act of the 100th General Assembly shall be staggered
4consistently with the terms of the other Board members.
5Successors shall be appointed to hold office from the third
6Monday in March of the year of their respective appointments
7for a term of 6 years. Each member of the Board shall hold
8office until his or her successor is appointed and qualified.
9    In the case of a vacancy in the office of a member prior to
10the conclusion of the member's term, the Sheriff shall, with
11the advice and consent of three-fifths of the county board,
12appoint a person to serve for the remainder of the unexpired
13term.
14    No more than 3 members of the Board shall be affiliated
15with the same political party, except that as additional
16members are appointed by the Sheriff under authority of this
17amendatory Act of 1997 and under the authority of this
18amendatory Act of the 91st General Assembly, the political
19affiliation of the Board shall be such that no more than
20one-half of the members plus one additional member may be
21affiliated with the same political party. No member shall have
22held or have been a candidate for an elective public office
23within one year preceding his or her appointment.
24    The Sheriff may deputize members of the Board.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.".
