AMENDMENT TO SENATE BILL 730

2    AMENDMENT NO. ______. Amend Senate Bill 730 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Regulatory Sunset Act is amended by
5changing Section 4.28 and adding Section 4.38 as follows:
 
6    (5 ILCS 80/4.28)
7    Sec. 4.28. Acts repealed on January 1, 2018. The following
8Acts are repealed on January 1, 2018:
9    The Illinois Petroleum Education and Marketing Act.
10    The Podiatric Medical Practice Act of 1987.
11    The Acupuncture Practice Act.
12    The Illinois Speech-Language Pathology and Audiology
13Practice Act.
14    The Interpreter for the Deaf Licensure Act of 2007.
15    The Nurse Practice Act.
16    The Clinical Social Work and Social Work Practice Act.

13    (5 ILCS 80/4.38 new)
14    Sec. 4.38. Act repealed on January 1, 2028. The following
15Act is repealed on January 1, 2028:
16    The Illinois Petroleum Education and Marketing Act.
 
17    Section 10. The Illinois Petroleum Education and Marketing
18Act is amended by changing Sections 10, 15, and 45 as follows:

21    Sec. 10. Illinois Petroleum Resources Board.
22    (a) There is hereby created until January 1, 2018, the
23Illinois Petroleum Resources Board, which shall be subject to

1the provisions of the Regulatory Sunset Act. The purpose of the
2Board is to coordinate a program designed to demonstrate to the
3general public the importance of the Illinois oil and gas
4exploration and production industry, to encourage the wise and
5efficient use of energy, to promote environmentally sound
6production methods and technologies, to develop existing
7supplies of State oil and gas resources, and to support
8research and educational activities concerning the oil and gas
9exploration and production industry, and to support oilfield
10environmental remediation and restoration activities.
11    (b) The Board shall be composed of 12 members to be
12appointed as follows:
13        (1) Through December 31, 2006, the Governor shall make
14    appointments from a list of names submitted by qualified
15    producer associations, of which 10 shall be oil and gas
16    producers.
17        (2) Beginning January 1, 2007, all appointments shall
18    be made by the qualified producer associations.
19    (c) A member of the Board shall:
20        (1) be at least 25 years of age;
21        (2) be a resident of the State of Illinois; and
22        (3) have at least 5 years of active experience in the
23    oil industry.
24    (d) Members shall serve for a term of 3 years, except that
25of the initial appointments, 4 members shall serve for one
26year, 4 members for 2 years, and 4 members for 3 years.

1    (e) Vacancies shall be filled for the unexpired term of
2office in the same manner as the original appointment.
3    (f) The Board shall, at its first meeting, elect one of its
4members as chairperson, who shall preside over meetings of the
5Board and perform other duties that may be required by the
6Board. The first meeting of the Board shall be called by the
7Governor.
8    (g) No member of the Board shall receive a salary or
9reimbursement for duties performed as a member of the Board,
10except that members are eligible to receive reimbursement for
11travel expenses incurred in the performance of Board duties.

15    Sec. 15. Board powers and duties. The Board shall have the
16following powers and duties:
17        (1) To administer and enforce the provisions of this
18    Act.
19        (2) To establish an office for the Board within the
20    State of Illinois.
21        (3) To elect a chairperson and any other officers that
22    may be necessary to direct the operations of the Board.
23        (4) To employ personnel as shall be deemed necessary to
24    carry out the purpose and provisions of this Act and to
25    prescribe their duties and fix their compensation.

1        (5) To receive and administer all assessments,
2    donations, grants, contributions, and gifts received by
3    the Board pursuant to this Act and to deposit them into
4    accounts maintained by the Board.
5        (6) To annually establish priorities and approve a
6    prepared budget consistent with estimated resources.
7        (7) To adopt rules as it deems necessary to carry out
8    the provisions of this Act.
9        (8) To enter into contracts or agreements for studies,
10    research projects, experimental work, supplies, or other
11    services to carry out the purposes of this Act and to incur
12    those expenses necessary to carry out those purposes. A
13    contract or agreement entered into under this item shall
14    provide that:
15            (A) the person entering the contract or agreement
16        on behalf of the Board shall develop and submit to the
17        Board a plan or project together with a budget that
18        shows estimated costs to be incurred for the plan or
19        project; and
20            (B) the person entering the contract or agreement
21        shall keep accurate records of all of its transactions,
22        account for funds received and expended, and make
23        periodic reports to the Board of activities conducted
24        and other reports that the Board may require.
25        (9) To keep accurate records of all financial
26    transactions performed pursuant to this Act. These records

1    shall be audited annually by an independent auditor who is
2    a certified public accountant and has been selected by the
3    Board, and an annual report shall be compiled and made
4    available to any interest owner and filed with the
5    Department within 60 days after the close of the Board's
6    fiscal year.
7        (10) To cooperate with any private, local, state, or
8    national commission, organization, agency, or group and to
9    make contracts and agreements for joint programs
10    beneficial to the oil and gas industry.
11        (11) To accept donations, grants, contributions, and
12    gifts from any public or private source and deposit them
13    into accounts maintained by the Board.
14        (12) To keep an accurate record of all assessments
15    collected.
16        (13) To enter into voluntary agreements with the
17    Department to support oilfield environmental remediation
18    and restoration activities.

22    Sec. 45. Use of funds.
23    (a) All interest earned on moneys received by the Board
24shall be the property of the Board.
25    (a-5) The Board may expend funds only as provided for by

1law.
2    (b) The Board shall not utilize any funds collected under
3Section 30 of this Act for the purpose of influencing
4government action or policy, with the exception of recommending
5amendments to this Act.
6    (c) None of the moneys collected under Section 30 and not
7refunded under Section 35 of this Act shall be used for travel
8expenses of any member of the Illinois General Assembly.

10    Section 99. Effective date. This Act takes effect upon
11becoming law.".
