AMENDMENT TO SENATE BILL 1453

2    AMENDMENT NO. ______. Amend Senate Bill 1453 by replacing
3everything after the enacting clause with the following:
 
4    "(20 ILCS 3970/Act rep.)
5    Section 5. The Interagency Coordinating Council Act is
6repealed.
 
7    Section 10. The Persons with Disabilities on State Agency
8Boards Act is amended by changing Section 10 as follows:
 
9    (20 ILCS 4007/10)
10    Sec. 10. Definitions. As used in this Act, unless the
11context requires otherwise:
12    "Disability" means a physical or mental characteristic
13resulting from disease, injury, congenital condition of birth,
14or functional disorder, the history of such a characteristic,
15or the perception of such a characteristic, when the

1characteristic results in substantial functional limitations
2in 3 or more of the following areas of major life activity:
3self care, fine motor skills, mobility, vision, respiration,
4learning, work, receptive and expressive language (hearing and
5speaking), self direction, capacity for independent living,
6and economic sufficiency.
7    "State human services agency" means the following:
8        (1) The Citizens Council on Mental Health and
9    Developmental Disabilities created under Article 11A of
10    the Legislative Commission Reorganization Act of 1984.
11        (2) Advisory councils created by the Department of
12    Human Rights under Section 7-107 of the Illinois Human
13    Rights Act.
14        (3) The Guardianship and Advocacy Commission created
15    under the Guardianship and Advocacy Act.
16        (4) (Blank). The Interagency Coordinating Council
17    created under the Interagency Coordinating Council Act.

19    Section 15. The Employment and Economic Opportunity for
20Persons with Disabilities Task Force Act is amended by changing
21Sections 10 and 15 as follows:

23    Sec. 10. Employment and Economic Opportunity for Persons
24with Disabilities Task Force.

1    (a) The Employment and Economic Opportunity for Persons
2with Disabilities Task Force is created.
3    (b) The Employment and Economic Opportunity for Persons
4with Disabilities Task Force shall be appointed and hold its
5first meeting within 90 days after the effective date of this
6Act, be convened by the Governor, and operate with
7administrative support from the Illinois Department of Human
8Services.
9    (c) The Task Force shall be comprised of the following
10representatives of State Government: a high-ranking member of
11the Governor's management team, designated by the Governor;
12representatives of each division of the Department of Human
13Services, designated by the Secretary of Human Services; the
14Director of Healthcare and Family Services, or his or her
15designee; the Director of Veterans' Affairs or his or her
16designee; the Director of Commerce and Economic Opportunity or
17his or her designee; the Director of Employment Security or his
18or her designee; the Director of Central Management Services or
19his or her designee; the Director of Juvenile Justice or his or
20her designee; the Executive Director of the Board of Higher
21Education or his or her designee; the Executive Director of the
22Illinois Community College Board or his or her designee; the
23Executive Director of the Illinois Council on Developmental
24Disabilities or his or her designee; and the State
25Superintendent of Education or his or her designee.
26    (d) The Task Force shall also consist of no more than 15

1public members who shall be appointed by the Governor and who
2represent the following constituencies: statewide
3organizations that advocate for persons with physical,
4developmental and psychiatric disabilities, entities with
5expertise in assistive technology devices and services for
6persons with disabilities, advocates for veterans with
7disabilities, centers for independent living, disability
8services providers, organized labor, higher education, the
9private sector business community, entities that provide
10employment and training services to persons with disabilities,
11and at least 5 persons who have a disability.
12    (e) The Task Force shall be co-chaired by the
13representative of the Governor and a public member who shall be
14chosen by the other public members of the Task Force.
15    (f) The Task Force members shall serve voluntarily and
16without compensation. Persons with disabilities serving on the
17Task Force shall be accommodated to enable them to fully
18participate in Task Force activities.
19    (g) The co-chairs of the Task Force shall extend an
20invitation to chairs and minority spokespersons of appropriate
21legislative committees to attend all meetings of the Task
22Force, and may invite other individuals who are not members of
23the Task Force to participate in subcommittees of the Task
24Force or to take part in discussions of topics for which those
25individuals have particular expertise.
26    (h) The Task Force shall coordinate its work with existing

1State advisory bodies whose work may include employment and
2economic opportunity for persons with disabilities.

4    (20 ILCS 4095/15)
5    Sec. 15. Task Force Responsibilities. The Task Force shall
6analyze programs and policies of the State to determine what
7changes, modifications, and innovations may be necessary to
8remove barriers to competitive employment and economic
9opportunity for persons with disabilities, including barriers
10such as transportation, housing, program accessibility, and
11benefit structure. The Task Force shall also analyze State
12disability systems, including the mental health, developmental
13disabilities, veterans' assistance, workforce investment, and
14rehabilitation services systems, and their effect on
15employment of persons with disabilities. The Task Force shall
16review and analyze applicable research and policy studies,
17innovations used in other states, and any federal policy
18initiatives such as customized employment, and federal funding
19opportunities that would increase competitive employment and
20economic opportunity for persons with disabilities in
21Illinois.
22    With regard to the post-secondary transition of youth with
23disabilities to employment, post-secondary education and
24training, community living, and other adult activities, the
25Task Force shall:

1        (1) design a process for collecting, analyzing,
2    coordinating, and sharing data;
3        (2) be a resource for sharing information with State
4    and local agencies involved in the delivery of services to
5    youth with disabilities;
6        (3) assist local transition planning committees by
7    developing model interagency agreements to ensure that
8    necessary services are available;
9        (4) review and evaluate annual transition outcome data
10    from information collected by State agencies that are
11    members of the Task Force from local transition planning
12    committees, school districts, and other appropriate
13    sources. Data indicators under this paragraph (4) shall
14    include:
15            (A) high school graduation or passage of high
16        school equivalency testing;
17            (B) participation in post-secondary education,
18        including continuing and adult education;
19            (C) involvement in integrated employment,
20        supported employment, vocational training, and
21        work-based learning activities;
22            (D) independent living, community participating
23        adult services, and other adult services; and
24            (E) enrollment in the Prioritization of Urgency of
25        Need for Services (PUNS) program;
26        (5) evaluate and report on the State's progress with

1    regard to the implementation of the post-secondary
2    transition requirements of the federal Workforce
3    Innovation and Opportunity Act; and
4        (6) develop periodic in-service training programs to
5    consumers and families in improving understanding and
6    awareness of post-secondary transition services.

8    Section 99. Effective date. This Act takes effect upon
9becoming law.".
