AMENDMENT TO SENATE BILL 1668

2    AMENDMENT NO. ______. Amend Senate Bill 1668 by replacing
3everything after the enacting clause with the following:

"Article 5. Department of Natural Resources.

 
5    Section 5-5. The Director of the Department of Natural
6Resources, on behalf of the State of Illinois, is authorized to
7execute and deliver to the Fox Waterway Agency, a
8special-purpose unit of local government organized and
9existing under the laws of this State, for and in consideration
10of $1 paid to the Department, a quit claim deed to the
11following described real property:

23    (a) The conveyances of real property authorized by Section

15-5 shall be made subject to: (1) existing public utilities,
2existing public roads, and any and all reservations, easements,
3encumbrances, covenants and restrictions of record; (2) the
4express condition that within one year after conveyance, the
5Fox Waterway Agency shall: sell the real property for no less
6than fair market value; use any proceeds from the sale to
7purchase of an alternate dredge material disposal site or sites
8for no more than fair market value; and transfer any proceeds
9remaining after the purchase of an alternate dredge material
10disposal site or sites to the Department of Natural Resources
11for deposit into the General Revenue Fund; and (3) the
12requirements of subsection (b) of this Section.
13    (b) If, after one year following the conveyances of the
14real property under Section 5-5, the Fox Waterway Agency has
15failed to comply with the express condition set forth in item
16(2) of subsection (a), the real property shall revert to the
17State of Illinois, Department of Natural Resources, or, if
18applicable, the proceeds from the sale of the conveyed property
19shall be immediately transferred to the Department of Natural
20Resources for deposit into the General Revenue Fund. If any
21property purchased with proceeds from the sale of the conveyed
22property is not used as a dredged material disposal site within
232 years following the conveyances under Section 5-5 or if at
24any time the property ceases to be used for public purposes,

13violation or to require the restoration or mitigation of

17    5. The Grantee agrees that the Illinois Department of
18Natural Resources may, at its sole discretion and without prior
19notice to the Grantee, convey and assign all or part of its
20rights and responsibilities contained herein to a third party.

24    6. This covenant is binding on the Grantee, its successors
