2 | | AMENDMENT NO. ______. Amend Senate Bill 2031 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Nursing Home Care Act is amended by |
5 | | changing Section 1-123 as follows:
|
6 | | (210 ILCS 45/1-123) (from Ch. 111 1/2, par. 4151-123)
|
7 | | Sec. 1-123.
"Resident's representative" means a person |
8 | | other than the
owner not related to the resident, or an agent |
9 | | or employee of a facility not related to the resident,
|
10 | | designated in writing by a resident to be his representative, |
11 | | or the resident's
guardian. "Resident's representative" |
12 | | includes:
|
13 | | (1) an individual chosen by the resident to act on |
14 | | behalf of the resident in order to support the resident in |
15 | | decision-making; access medical, social, or other personal |
16 | | information of the resident; manage financial matters; or |
|

1 | | receive notifications; |
2 | | (2) a person authorized by State or federal law, |
3 | | including, but not limited to, agents under power of |
4 | | attorney, representative payees, and other fiduciaries, to |
5 | | act on behalf of the resident in order to support the |
6 | | resident in decision-making; access medical, social, or |
7 | | other personal information of the resident; manage |
8 | | financial matters; or receive notifications; |
9 | | (3) a legal representative, as used in Section 712 of |
10 | | the federal Older Americans Act (42 U.S.C. 3058g); or |
11 | | (4) the court-appointed guardian or conservator of a |
12 | | resident. |
13 | | Nothing in this definition is intended to expand the scope of |
14 | | authority of any resident's representative beyond that |
15 | | authority specifically authorized by the resident, State or |
16 | | federal law, or a court of competent jurisdiction. |

18 | | Section 99. Effective date. This Act takes effect upon |
19 | | becoming law.".
