| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Promotion Act is amended by | 5 | | changing Section 8b as follows: | 6 | | (20 ILCS 665/8b) | 7 | | Sec. 8b. Municipal convention center and sports facility | 8 | | attraction grants. | 9 | | (a) The Until July 1, 2020, the Department is authorized to | 10 | | make grants, subject to appropriation by the General Assembly, | 11 | | from the Tourism Promotion Fund to a unit of local government, | 12 | | municipal convention center, or convention center authority | 13 | | that provides incentives, as defined in subsection (i) of | 14 | | Section 3 of this Act, for the purpose of attracting | 15 | | conventions, meetings, and trade shows to municipal convention | 16 | | centers and attracting sporting events to municipal amateur | 17 | | sports facilities. Grants awarded under this Section shall be | 18 | | based on the net proceeds received under the Hotel Operators' | 19 | | Occupation Tax Act for the renting, leasing, or letting of | 20 | | hotel rooms in the municipality for the month in which the | 21 | | convention, meeting, trade show, or sporting event occurs. | 22 | | Grants shall not exceed 80% of the incentive amount provided by | 23 | | the unit of local government, municipal convention center, or |

Further, in no event may the | 2 | | aggregate amount of grants awarded to a single municipal | 3 | | convention center, convention center authority, or municipal | 4 | | amateur sports facility exceed $200,000 in any calendar year. | 5 | | The Department may, by rule, require any other provisions it | 6 | | deems necessary in order to protect the State's interest in | 7 | | administering this program. | 8 | | (b) No later than May 15 of each year, through May 15, | 9 | | 2020, the unit of local government, municipal convention | 10 | | center, or convention center authority shall certify to the | 11 | | Department the amounts of funds expended in the previous fiscal | 12 | | year to provide qualified incentives; however, in no event may | 13 | | the certified amount pursuant to this paragraph exceed $200,000 | 14 | | for any municipal convention center, convention center | 15 | | authority, or municipal amateur sports facility in any calendar | 16 | | year. The unit of local government, convention center, or | 17 | | convention center authority shall certify (A) the net proceeds | 18 | | received under the Hotel Operators' Occupation Tax Act for the | 19 | | renting, leasing, or letting of hotel rooms in the municipality | 20 | | for the month in which the convention, meeting, or trade show | 21 | | occurs and (B) the average of the net proceeds received under | 22 | | the Hotel Operators' Occupation Tax Act for the renting, | 23 | | leasing, or letting of hotel rooms in the municipality for the | 24 | | same month in the 3 immediately preceding years. The unit of | 25 | | local government, municipal convention center, or convention | 26 | | center authority shall include the incentive amounts as part of |

| 1 | | its regular audit. | 2 | | (c) The Department shall submit a report on the | 3 | | effectiveness of the program established under this Section to | 4 | | the General Assembly no later than January 1, 2020.
