Information retention. | 5 | | (a) If a law enforcement agency uses a drone under Section | 6 | | 15 of this Act, the agency within 30 days shall destroy all | 7 | | information gathered by the drone, except that a supervisor at | 8 | | that agency may retain particular information if: | 9 | | (1) there is reasonable suspicion that the information | 10 | | contains evidence of criminal activity, or | 11 | | (2) the information is relevant to an ongoing | 12 | | investigation or pending criminal trial.
| 13 | | (b) Except as provided under subsection (c) of this | 14 | | Section, if a law enforcement agency uses a drone under | 15 | | paragraph (7) of Section 15 of this Act, the law enforcement | 16 | | agency shall destroy all information gathered by the drone | 17 | | within 7 days, except that a supervisor at that law enforcement | 18 | | agency may retain particular information if: | 19 | | (1) there is reasonable suspicion that the information | 20 | | contains evidence of criminal activity; or | 21 | | (2) the information is relevant to an ongoing | 22 | | investigation or pending criminal trial. | 23 | | (c) If a law enforcement agency uses a drone under | 24 | | paragraph (7) of Section 15 of this Act at any demonstration, | 25 | | protest, rally, march, parade, or other gathering for the |

| 1 | | purpose of expressing political, religious, social, or other | 2 | | views, the law enforcement agency shall destroy all information | 3 | | gathered by the drone within 24 hours, except that a supervisor | 4 | | at that law enforcement agency may retain particular | 5 | | information if: | 6 | | (1) there is reasonable suspicion that the information | 7 | | contains evidence of criminal activity; or | 8 | | (2) the information is relevant to an ongoing | 9 | | investigation or pending criminal trial.
The law | 10 | | enforcement agency shall limit access to the information | 11 | | gathered by the drone to the highest ranking officer | 12 | | investigating whether there was criminal activity at the | 13 | | event. Additionally, the information collected shall not | 14 | | be shared it with any other member of the law enforcement | 15 | | agency or any other agency unless the information contains | 16 | | evidence of criminal activity or the information is | 17 | | relevant to an ongoing investigation or pending criminal | 18 | | trial. | 19 | | (Source: P.A. 98-569, eff. 1-1-14.)"; and | 20 | | on page 5, by replacing line 4 with "those agencies, | 21 | | information reported by each agency under subsection (a) of | 22 | | this Section, unless this information is relevant to an ongoing | 23 | | investigation or pending criminal trial the number of drones | 24 | | that it owns .".
