AMENDMENT TO SENATE BILL 2562

AMENDMENT NO. ______. Amend Senate Bill 2562 on page 1, by replacing line 5 with "amended by changing Sections 15, 20, and 35 as follows"; and

on page 3, line 17, after the semicolon, by inserting "or"; and

on page 3, by replacing line 19 with "personnel. In"; and

on page 3, line 22, by replacing "100" with "10,000"; and

on page 4, line 11, after the period, by inserting ""Large scale event" does not include any demonstration, protest, rally, march, parade, or other gathering for the purpose of expressing political, religious, social, or other views. Drones operated under this Section cannot be equipped with facial recognition or biometric technology."; and

on page 4, immediately below line 12, by inserting the following:

"(725 ILCS 167/20)

Sec. 20. Information retention.

(a) If a law enforcement agency uses a drone under Section 15 of this Act, the agency within 30 days shall destroy all information gathered by the drone, except that a supervisor at that agency may retain particular information if:

(1) there is reasonable suspicion that the information contains evidence of criminal activity, or

(2) the information is relevant to an ongoing investigation or pending criminal trial.

(b) Except as provided under subsection (c) of this Section, if a law enforcement agency uses a drone under paragraph (7) of Section 15 of this Act, the law enforcement agency shall destroy all information gathered by the drone within 7 days, except that a supervisor at that law enforcement agency may retain particular information if:

(1) there is reasonable suspicion that the information contains evidence of criminal activity; or

(2) the information is relevant to an ongoing investigation or pending criminal trial.

(c) If a law enforcement agency uses a drone under paragraph (7) of Section 15 of this Act at any demonstration, protest, rally, march, parade, or other gathering for the purpose of expressing political, religious, social, or other views, the law enforcement agency shall destroy all information gathered by the drone within 24 hours, except that a supervisor at that law enforcement agency may retain particular information if:

(1) there is reasonable suspicion that the information contains evidence of criminal activity; or

(2) the information is relevant to an ongoing investigation or pending criminal trial. The law enforcement agency shall limit access to the information gathered by the drone to the highest ranking officer investigating whether there was criminal activity at the event. Additionally, the information collected shall not be shared it with any other member of the law enforcement agency or any other agency unless the information contains evidence of criminal activity or the information is relevant to an ongoing investigation or pending criminal trial.

on page 5, by replacing line 4 with "those agencies, information reported by each agency under subsection (a) of this Section, unless this information is relevant to an ongoing investigation or pending criminal trial the number of drones that it owns.".
