AMENDMENT TO SENATE BILL 2866

2    AMENDMENT NO. ______. Amend Senate Bill 2866 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by changing Section 2310-617 as follows:
 
7    (20 ILCS 2310/2310-617)
8    Sec. 2310-617. Human papillomavirus vaccine.
9    (a) As used in this Section, "eligible individual" means a
10female child under the age of 18, and, beginning on January 1,
112020, a male child under the age of 18, who is a resident of
12Illinois who: (1) is not entitled to receive a human
13papillomavirus (HPV) vaccination at no cost as a benefit under
14a plan of health insurance, a managed care plan, or a plan
15provided by a health maintenance organization, a health
16services plan corporation, or a similar entity, and (2) meets

1the requirements established by the Department of Public Health
2by rule.
3    (b) Subject to appropriation, the Department of Public
4Health shall establish and administer a program, commencing no
5later than July 1, 2011, under which any eligible individual
6shall, upon the eligible individual's request, receive a series
7of HPV vaccinations as medically indicated, at no cost to the
8eligible individual.
9    (c) The Department of Public Health shall adopt rules for
10the administration and operation of the program, including, but
11not limited to: determination of the HPV vaccine formulation to
12be administered and the method of administration; eligibility
13requirements and eligibility determinations; and standards and
14criteria for acquisition and distribution of the HPV vaccine
15and related supplies. The Department may enter into contracts
16or agreements with public or private entities for the
17performance of such duties under the program as the Department
18may deem appropriate to carry out this Section and its rules
19adopted under this Section.

21    Section 10. The Communicable Disease Prevention Act is
22amended by changing Section 2e as follows:

24    Sec. 2e. HPV-related Cervical cancer prevention.

1    (a) Notwithstanding the provisions of Section 2 of this
2Act, beginning August 1, 2007, the Department of Public Health
3must provide all female students who are entering sixth grade
4and their parents or legal guardians written information about
5the link between human papillomavirus (HPV) and cervical,
6vulvar, vaginal, penile, anal, and oropharyngeal cancers in
7males and females, as applicable, and the availability of a HPV
8vaccine so that they may be protected before ever being exposed
9to the virus cervical cancer and the availability of a HPV
10vaccine.
11    (b) The Director of Public Health shall prescribe the
12content of the information required in subsection (a) of this
13Section.
14    (c) In order to provide for the expeditious and timely
15implementation of the provisions of this amendatory Act of the
1695th General Assembly, the Department of Public Health shall
17adopt emergency rules in accordance with Section 5-45 of the
18Illinois Administrative Procedure Act to the extent necessary
19to administer the Department's responsibilities under this
20amendatory Act of the 95th General Assembly. The adoption of
21emergency rules authorized by this subsection (c) is deemed to
22be necessary for the public interest, safety, and welfare.
23    (d) In order to provide for the expeditious and timely
24implementation of the provisions of this amendatory Act of the
25100th General Assembly, the Department of Public Health shall
26adopt emergency rules in accordance with Section 5-45 of the

1Illinois Administrative Procedure Act to the extent necessary
2to administer the Department's responsibilities under this
3amendatory Act of the 100th General Assembly no later than July
41, 2019. The adoption of emergency rules authorized by this
5subsection (d) is deemed to be necessary for the public
6interest, safety, and welfare.
