AMENDMENT TO HOUSE BILL 1652

2    AMENDMENT NO. ______. Amend House Bill 1652 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Civil Administrative Code of Illinois is
5amended by changing Section 5-715 as follows:
 
6    (20 ILCS 5/5-715)
7    Sec. 5-715. Expedited licensure for service members and
8spouses.
9    (a) In this Section, "service member" means any person who,
10at the time of application under this Section, is an active
11duty member of the United States Armed Forces or any reserve
12component of the United States Armed Forces, the Coast Guard,
13or the National Guard of any state, commonwealth, or territory
14of the United States or the District of Columbia or whose
15active duty service concluded within the preceding 2 years
16before application.

1    (a-5) The Department of Financial and Professional
2Regulation shall within 180 days after the effective date of
3this amendatory Act of the 101st General Assembly designate one
4staff member as the military liaison within the Department of
5Financial and Professional Regulation to ensure proper
6enactment of the requirements of this Section. The military
7liaison's responsibilities shall also include, but are not
8limited to: (1) the management of all expedited applications to
9ensure processing within 60 days after receipt of a completed
10application; (2) coordination with all military installation
11military and family support center directors within this State,
12including at least quarterly meetings with each military
13installation military and family support center; and (3)
14training by the military liaison to all directors of each
15division that issues an occupational or professional license to
16ensure proper application of this Section. Beginning in 2020,
17and at the end of each calendar year thereafter, the military
18liaison shall provide an annual report documenting the
19expedited licensure program for service members and spouses,
20and shall deliver that report to the Secretary of Financial and
21Professional Regulation and the Lieutenant Governor.
22    (b) Each director of a department that issues an
23occupational or professional license is authorized to and shall
24issue an expedited temporary occupational or professional
25license to a service member who meets the requirements under
26this Section. The temporary occupational or professional

1license shall be valid for 6 months after the date of issuance
2or until a license is granted or a notice to deny a license is
3issued in accordance with rules adopted by the department
4issuing the license, whichever occurs first. No temporary
5occupational or professional license shall be renewed. An
6application for a temporary occupational or professional
7license, presented with military orders from the service member
8(or an equivalent memorandum from the service member's
9commander) which provides evidence that the service member will
10reside in this State within 6 months after the date of
11application for temporary occupational or professional
12licensure, shall be expedited by the department within 60 days
13after the date on which the applicant provides the department
14with all necessary documentation required for licensure. An
15expedited temporary occupational or professional license shall
16be issued by the department to any service members meeting the
17application requirements of this Section, regardless of
18whether the service member currently resides in this State. The
19service member shall apply to the department on forms provided
20by the department. An application must include proof that:
21        (1) the applicant is a service member;
22        (2) the applicant holds a valid license in good
23    standing for the occupation or profession issued by another
24    state, commonwealth, possession, or territory of the
25    United States, the District of Columbia, or any foreign
26    jurisdiction and the requirements for licensure in the

1    other jurisdiction are determined by the department to be
2    substantially equivalent to the standards for licensure of
3    this State;
4        (3) the applicant is assigned to a duty station in this
5    State, or has established legal residence in this State, or
6    will reside in this State within 6 months after the date of
7    application;
8        (4) a complete set of the applicant's fingerprints has
9    been submitted to the Department of State Police for
10    statewide and national criminal history checks, if
11    applicable to the requirements of the department issuing
12    the license; the applicant shall pay the fee to the
13    Department of State Police or to the fingerprint vendor for
14    electronic fingerprint processing; no temporary
15    occupational or professional license shall be issued to an
16    applicant if the statewide or national criminal history
17    check discloses information that would cause the denial of
18    an application for licensure under any applicable
19    occupational or professional licensing Act;
20        (5) the applicant is not ineligible for licensure
21    pursuant to Section 2105-165 of the Civil Administrative
22    Code of Illinois;
23        (6) (Blank); the applicant has submitted an
24    application for full licensure; and
25        (7) the applicant has paid the required fee; fees shall
26    not be refundable.

2        (2) the applicant holds a valid license in good
3    standing for the occupation or profession issued by another
4    state, commonwealth, possession, or territory of the
5    United States, the District of Columbia, or any foreign
6    jurisdiction and the requirements for licensure in the
7    other jurisdiction are determined by the department to be
8    substantially equivalent to the standards for licensure of
9    this State;
10        (3) the applicant's spouse is assigned to a duty
11    station in this State, or has established legal residence
12    in this State, or will reside in this State within 6 months
13    after the date of application;
14        (4) a complete set of the applicant's fingerprints has
15    been submitted to the Department of State Police for
16    statewide and national criminal history checks, if
17    applicable to the requirements of the department issuing
18    the license; the applicant shall pay the fee to the
19    Department of State Police or to the fingerprint vendor for
20    electronic fingerprint processing; no temporary

1    pursuant to Section 2105-165 of the Civil Administrative
2    Code of Illinois;
3        (6) (Blank); the applicant has submitted an
4    application for full licensure; and
5        (7) the applicant has paid the required fee; fees shall
6    not be refundable.
7    (c-5) If a service member or his or her spouse relocates
8from this State, he or she shall be provided an opportunity to
9place his or her license in inactive status through
10coordination with the military liaison. If the service member
11or his or her spouse returns to this State, he or she may
12reactivate the license by completing a license renewal
13application. The license renewal shall be expedited and
14completed within 30 days after receipt of a completed
15application for renewal. A license renewal is only applicable
16when the valid license for which the first issuance of a
17license was predicated is still valid and in good standing. A
18license renewal application must include proof that: (1) the
19applicant still holds a valid license in good standing for the
20occupation or profession issued in another State,
21commonwealth, possession, or territory of the United States,
22the District of Columbia, or any foreign jurisdiction; and (2)
23the service member is assigned to a duty station in this State,
24is deployed overseas, or has orders (or a letter from his or
25her commander) designating that the service member shall be
26assigned within 180 days to a duty station in this State, or

1has established legal residence in this State.
2    (d) All relevant experience of a service member or his or
3her spouse in the discharge of official duties, including
4full-time and part-time experience, shall be credited in the
5calculation of any years of practice in an occupation or
6profession as may be required under any applicable occupational
7or professional licensing Act. All relevant training provided
8by the military and completed by a service member shall be
9credited to that service member as meeting any training or
10education requirement under any applicable occupational or
11professional licensing Act, provided that the training or
12education is determined by the department to be substantially
13equivalent to that required under any applicable Act and is not
14otherwise contrary to any other licensure requirement.
15    (e) A department may adopt any rules necessary for the
16implementation and administration of this Section and shall by
17rule provide for fees for the administration of this Section.
