AMENDMENT TO HOUSE BILL 2100

2    AMENDMENT NO. ______. Amend House Bill 2100, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
43, as follows:
 
5on page 15, immediately below line 5, by inserting the
6following:
7    "(b-5) Beginning on July 1, 2020, the State Board of
8Education may charge a charter school that it authorizes a fee
9not to exceed 3% of the revenue provided to the school to be
10used exclusively for covering the cost of authorizing
11activities. Authorizing activities may include, but are not
12limited to: (i) soliciting, reviewing, and taking action on
13charter school proposals; (ii) hiring, training, and
14supervising staff engaged in authorizing activities; (iii)
15developing and conducting oversight, including regular
16monitoring, of authorized charter schools; (iv) reporting on
17best practices and performances of charter schools; (v)

1applying for, managing, and distributing grants and funds
2appropriated for charter schools and authorizing activities;
3(vi) training members of the State Board on their authorizing
4roles; and (vii) training other employees of the State Board on
5how to work with charter schools as their own local education
6agencies."; and
 
7on page 27, by replacing line 12 with the following:
8"revoke or not renew a charter unless it determines that doing
9so is in the best interests of the students currently enrolled
10in the charter school."; and
 
11on page 27, line 16, by replacing "placed" with "offered
12placement"; and
 
13on page 27, by replacing line 18 with the following:
14"Student Succeeds Act accountability plan, and that they have
15reasonable options for transportation to those schools. In
16determining"; and
 
17by replacing line 26 on page 27 through line 11 on page 28 with
18the following:
19"Commission and the State Board. The State Board Commission may
20reverse a local board's decision to not renew a charter if the
21State Board Commission finds that the charter school or charter
22school proposal (i) is in compliance with this Article, and

1(ii) is in the best interests of the students it is designed to
2serve. The State Board Commission may condition the granting of
3an appeal on the acceptance by the charter school of funding in
4an amount less than that requested in the proposal submitted to
5the local school board. Final decisions of the State Board
6Commission shall be subject to judicial review under the
7Administrative Review Law.
8    (f) Notwithstanding other provisions of this Article, if
9the State Board Commission on appeal reverses a local board's
10decision to not renew a charter or".
