2    AMENDMENT NO. ______. Amend House Bill 2461 by replacing

"Article 1.

 
5    Section 1-5. The State of Illinois owns the following

3    Section 1-10. The real estate described in Section 1-5 is
4no longer needed by the State of Illinois. Therefore, upon
5completion of the Illinois State Toll Highway Authority's use
6of the parcel, the Department of Transportation, on behalf of
7the State of Illinois, shall convey by quitclaim deed all
8right, title, and interest of the State of Illinois and the
9Department of Transportation in and to the real estate
10described in Section 1-5 of this Act to the Village of
11Bensenville, for no less than the fair market value as
12determined by an average of 3 appraisals.
 
13    Section 1-15. The Secretary of Transportation shall obtain
14a certified copy of this Act within 60 days after this Act's
15effective date and shall record the certified document in the
16Recorder's Office of DuPage County, Illinois.

Article 2.

 
18    Section 2-5. Subject to the conditions set forth in Section
192-10, the Director of the Department of Children and Family
20Services, on behalf of the State of Illinois, shall execute and
21deliver to the Carole Robertson Center for Learning, an

1Illinois not-for-profit corporation, for and in consideration
2of $1 paid to the Department, a quitclaim deed to the following
3described real property:
 
4    Lot 1 (except the West 8.0 feet thereof), Lot 14 (except
5    the West 8.0 feet thereof), and Lots 2 through 7, both
6    inclusive, all in Block 1, together with the 16 foot
7    vacated alley lying East of the East line of Lot 14 and
8    lying West of the West line of Lots 2 thru 7, both
9    inclusive, and lying North of the North line of the C.B.& Q
10    R.R. right of way all in Block 1 in Levi P. Morton's
11    subdivision of the SE 1/4 of the SW 1/4 of Section 24,
12    Township 39 North, Range 13 (excepting the right of way of
13    the C.B.& Q. R.R.) all in Cook County.
 
14    Section 2-10. Conditions of conveyance.
15    (a) The quitclaim deed executed under Section 2-5 shall
16convey all right, title, and interest of the State of Illinois
17and the Department of Children and Family Services in and to
18the real property described in Section 2-5 to the Carole
19Robertson Center for Learning.
20    (b) The conveyance of real property authorized by Section
212-5 shall be made subject to existing public utilities,
22existing public roads, and any and all reservations, easements,
23encumbrances, covenants, and restrictions of record.
24    (c) The quitclaim deed to the Carole Robertson Center for

1Learning shall state on its face and be subject to the
2conditions that the real property shall be used by the Carole
3Robertson Center for Learning for a public child care facility
4and that if the Carole Robertson Center for Learning ceases to
5exist, if the real property is used for any purposes other than
6a public child care facility, or if an attempt is made to sell
7the property, then title shall revert without further action to
8the State of Illinois.
 
9    Section 2-15. Recording. The Director of the Department of
10Children and Family Services shall prepare one or more
11quitclaim deeds to convey the real property. The Director may
12also record a certified copy of this Act. Each quitclaim deed
13shall reference this Act and contain the reversionary language
14from subsection (c) of Section 2-10. All documents of
15conveyance shall be recorded in the county in which the land is
16located.

Article 3.

 
18    Section 3-5. The Northern Illinois University Law is
19amended by changing Section 30-45 as follows:
 
20    (110 ILCS 685/30-45)
21    Sec. 30-45. Powers and duties. The Board also shall have
22power and it shall be its duty:

1    (1) To make rules, regulations and bylaws, not inconsistent
2with law, for the government and management of Northern
3Illinois University and its branches.
4    (2) To employ, and, for good cause, to remove a President
5of Northern Illinois University, and all necessary deans,
6professors, associate professors, assistant professors,
7instructors, other educational and administrative assistants,
8and all other necessary employees, and to prescribe their
9duties and contract with them upon matters relating to tenure,
10salaries and retirement benefits in accordance with the State
11Universities Civil Service Act. Whenever the Board establishes
12a search committee to fill the position of President of
13Northern Illinois University, there shall be minority
14representation, including women, on that search committee. The
15Board shall, upon the written request of an employee of
16Northern Illinois University, withhold from the compensation
17of that employee any dues, payments or contributions payable by
18such employee to any labor organization as defined in the
19Illinois Educational Labor Relations Act. Under such
20arrangement, an amount shall be withheld from each regular
21payroll period which is equal to the pro rata share of the
22annual dues plus any payments or contributions, and the Board
23shall transmit such withholdings to the specified labor
24organization within 10 working days from the time of the
25withholding.
26    (3) To prescribe the courses of study to be followed, and

1textbooks and apparatus to be used at Northern Illinois
2University.
3    (4) To issue upon the recommendation of the faculty,
4diplomas to such persons as have satisfactorily completed the
5required studies of Northern Illinois University, and confer
6such professional and literary degrees as are usually conferred
7by other institutions of like character for similar or
8equivalent courses of study, or such as the Board may deem
9appropriate.
10    (5) To examine into the conditions, management, and
11administration of Northern Illinois University, to provide the
12requisite buildings, apparatus, equipment and auxiliary
13enterprises, and to fix and collect matriculation fees; tuition
14fees; fees for student activities; fees for student facilities
15such as student union buildings or field houses or stadia or
16other recreational facilities; student welfare fees;
17laboratory fees; and similar fees for supplies and materials.
18The expense of the building, improving, repairing and supplying
19fuel and furniture and the necessary appliances and apparatus
20for conducting Northern Illinois University, the reimbursed
21expenses of members of the Board, and the salaries or
22compensation of the President, assistants, agents and other
23employees of Northern Illinois University, shall be a charge
24upon the State Treasury. All other expenses shall be chargeable
25against students, and the Board shall regulate the charges
26accordingly.

1    (6) To succeed to and to administer all trusts, trust
2property, and gifts now or hereafter belonging or pertaining to
3Northern Illinois University.
4    (7) To accept endowments of professorships or departments
5in Northern Illinois University from any person who may proffer
6them and, at regular meetings, to prescribe rules and
7regulations in relation to endowments and declare on what
8general principles they may be accepted.
9    (8) To enter into contracts with the Federal government for
10providing courses of instruction and other services at Northern
11Illinois University for persons serving in or with the military
12or naval forces of the United States, and to provide such
13courses of instruction and other services.
14    (9) To contract with respect to the Cooperative Computer
15Center to obtain services related to electronic data
16processing.
17    (10) To provide for the receipt and expenditures of Federal
18funds paid to Northern Illinois University by the Federal
19government for instruction and other services for persons
20serving in or with the military or naval forces of the United
21States, and to provide for audits of such funds.
22    (11) To appoint, subject to the applicable civil service
23law, persons to be members of the Northern Illinois University
24Police Department. Members of the Police Department shall be
25conservators of the peace and as such have all powers possessed
26by policemen in cities, and sheriffs, including the power to

1make arrests on view or warrants of violations of State
2statutes, University rules and regulations and city or county
3ordinances, except that they may exercise such powers only
4within counties wherein Northern Illinois University and any of
5its branches or properties are located when such is required
6for the protection of University properties and interests, and
7its students and personnel, and otherwise, within such
8counties, when requested by appropriate State or local law
9enforcement officials. However, such officers shall have no
10power to serve and execute civil processes.
11    The Board must authorize to each member of the Northern
12Illinois University Police Department and to any other employee
13of Northern Illinois University exercising the powers of a
14peace officer a distinct badge that, on its face, (i) clearly
15states that the badge is authorized by Northern Illinois
16University and (ii) contains a unique identifying number. No
17other badge shall be authorized by Northern Illinois
18University.
19    (12) The Board may, directly or in cooperation with other
20institutions of higher education, acquire by purchase or lease
21or otherwise, and construct, enlarge, improve, equip,
22complete, operate, control and manage research and high
23technology parks, together with the necessary lands,
24buildings, facilities, equipment, and personal property
25therefor, to encourage and facilitate (i) the location and
26development of business and industry in the State of Illinois,

1and (ii) the increased application and development of
2technology, and (iii) the improvement and development of the
3State's economy. The Board may lease to nonprofit corporations
4all or any part of the land, buildings, facilities, equipment
5or other property included in a research and high technology
6park upon such terms and conditions as the Board may deem
7advisable and enter into any contract or agreement with such
8nonprofit corporations as may be necessary or suitable for the
9construction, financing, operation and maintenance and
10management of any such park; and may lease to any person, firm,
11partnership or corporation, either public or private, any part
12or all of the land, building, facilities, equipment or other
13property of such park for such purposes and upon such rentals,
14terms and conditions as the Board may deem advisable; and may
15finance all or part of the cost of any such park, including the
16purchase, lease, construction, reconstruction, improvement,
17remodeling, addition to, and extension and maintenance of all
18or part of such high technology park, and all equipment and
19furnishings, by legislative appropriations, government grants,
20contracts, private gifts, loans, receipts from the operation of
21such high technology park, rentals and similar receipts; and
22may make its other facilities and services available to tenants
23or other occupants of any such park at rates which are
24reasonable and appropriate.
25    (13) To assist in the provision of buildings and facilities
26beneficial to, useful for, or supportive of university

1purposes, the Board of Trustees of Northern Illinois University
2may exercise the following powers with regard to the areas area
3located on or adjacent to the Northern Illinois University
4DeKalb campus and bounded as follows:

6    In Township 40 North, Range 4 East, of the Third Prime
7    Meridian, County of DeKalb, State of Illinois: The East
8    half of the Southeast Quarter of Section 17, the Southwest
9    Quarter of Section 16, and the Northwest Quarter of Section

7    years, provided that each such lease or purchase contract
8    shall be and shall recite that it is subject to termination
9    and cancellation in any year for which the General Assembly
10    fails to make an appropriation to pay the rent or purchase
11    installments payable under the terms of such lease or

13        (c) Sell property without compliance with the State
14    Property Control Act and retain proceeds in the University
15    treasury in a special, separate development fund account
16    which the Auditor General shall examine to assure
17    compliance with this Act.
18    Any buildings or facilities to be developed on the land
19shall be buildings or facilities that, in the determination of
20the Board of Trustees, in whole or in part: (i) are for use by
21the University; or (ii) otherwise advance the interests of the
22University, including, by way of example, residential,
23recreational, educational, and athletic facilities for
24University staff and students and commercial facilities which
25provide services needed by the University community. Revenues
26from the development fund account may be withdrawn by the

1University for the purpose of demolition and the processes
2associated with demolition; repairs to existing campus
3facilities and infrastructure, and professional services
4associated with planning and design routine land and property
5acquisition; extension of utilities; streetscape work;
6landscape work; surface and structure parking; sidewalks,
7recreational paths, and street construction; and lease and
8lease purchase arrangements and the professional services
9associated with the planning and development of the area.
10Moneys from the development fund account used for any other
11purpose must be deposited into and appropriated from the
12General Revenue Fund. Buildings or facilities leased to an
13entity or person other than the University shall not be subject
14to any limitations applicable to a State-supported college or
15university under any law. All development on the land and all
16the use of any buildings or facilities shall be subject to the
17control and approval of the Board of Trustees of Northern
18Illinois University.
19    (14) To borrow money, as necessary, from time to time in
20anticipation of receiving tuition, payments from the State of
21Illinois, or other revenues or receipts of the University, also
22known as anticipated moneys. The borrowing limit shall be
23capped at 100% of the total amount of payroll and other expense
24vouchers submitted and payable to the University for fiscal
25year 2010 expenses, but unpaid by the State Comptroller's
26office. Prior to borrowing any funds, the University shall

1request from the Comptroller's office a verification of the
2borrowing limit and shall include the estimated date on which
3such borrowing shall occur. The borrowing limit cap shall be
4verified by the State Comptroller's office not prior to 45 days
5before any estimated date for executing any promissory note or
6line of credit established under this item (14). The principal
7amount borrowed under a promissory note or line of credit shall
8not exceed 75% of the borrowing limit. Within 15 days after
9borrowing funds under any promissory note or line of credit
10established under this item (14), the University shall submit
11to the Governor's Office of Management and Budget, the Speaker
12of the House of Representatives, the Minority Leader of the
13House of Representatives, the President of the Senate, and the
14Minority Leader of the Senate an Emergency Short Term Cash
15Management Plan. The Emergency Short Term Cash Management Plan
16shall outline the amount borrowed, the terms for repayment, the
17amount of outstanding State vouchers as verified by the State
18Comptroller's office, and the University's plan for
19expenditure of any borrowed funds, including, but not limited
20to, a detailed plan to meet payroll obligations for all
21collective bargaining employees, civil service employees, and
22academic, research, and health care personnel. The
23establishment of any promissory note or line of credit
24established under this item (14) must be finalized within 90
25days after the effective date of this amendatory Act of the
2696th General Assembly. The borrowed moneys shall be applied to

1the purposes of paying salaries and other expenses lawfully
2authorized in the University's State appropriation and unpaid
3by the State Comptroller. Any line of credit established under
4this item (14) shall be paid in full one year after creation or
5within 10 days after the date the University receives
6reimbursement from the State for all submitted fiscal year 2010
7vouchers, whichever is earlier. Any promissory note
8established under this item (14) shall be repaid within one
9year after issuance of the note. The Chairman, Comptroller, or
10Treasurer of the Board shall execute a promissory note or
11similar debt instrument to evidence the indebtedness incurred
12by the borrowing. In connection with a borrowing, the Board may
13establish a line of credit with a financial institution,
14investment bank, or broker/dealer. The obligation to make the
15payments due under any promissory note or line of credit
16established under this item (14) shall be a lawful obligation
17of the University payable from the anticipated moneys. Any
18borrowing under this item (14) shall not constitute a debt,
19legal or moral, of the State and shall not be enforceable
20against the State. The promissory note or line of credit shall
21be authorized by a resolution passed by the Board and shall be
22valid whether or not a budgeted item with respect to that
23resolution is included in any annual or supplemental budget
24adopted by the Board. The resolution shall set forth facts
25demonstrating the need for the borrowing, state an amount that
26the amount to be borrowed will not exceed, and establish a

1maximum interest rate limit not to exceed the maximum rate
2authorized by the Bond Authorization Act or 9%, whichever is
3less. The resolution may direct the Comptroller or Treasurer of
4the Board to make arrangements to set apart and hold the
5portion of the anticipated moneys, as received, that shall be
6used to repay the borrowing, subject to any prior pledges or
7restrictions with respect to the anticipated moneys. The
8resolution may also authorize the Treasurer of the Board to
9make partial repayments of the borrowing as the anticipated
10moneys become available and may contain any other terms,
11restrictions, or limitations not inconsistent with the powers
12of the Board.
13    For the purposes of this item (14), "financial institution"
14means any bank subject to the Illinois Banking Act, any savings
15and loan association subject to the Illinois Savings and Loan
16Act of 1985, and any federally chartered commercial bank or
17savings and loan association or government-sponsored
18enterprise organized and operated in this State pursuant to the
19laws of the United States.

10    curve bears North 64 degrees 53 minutes 25 seconds East,
11    93.65 feet to the north line of said Outlot A; thence North
12    88 degrees 35 minutes 58 seconds East, on said north line,
13    26.35 feet to the Point of Beginning.
 
14    Said parcel containing 0.035 acre, more or less.
15    (b) This Section is repealed 3 years after the effective
16date of this amendatory Act of the 101st General Assembly.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.".
