AMENDMENT TO HOUSE BILL 2491

2    AMENDMENT NO. ______. Amend House Bill 2491 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Environmental Protection Act is amended by
5adding Section 22.59 as follows:
 
6    (415 ILCS 5/22.59 new)
7    Sec. 22.59. Plastics gasification facilities.
8    (a) As used in this Section:
9    "Plastics" means polystyrene or any other synthetic
10organic polymer that can be molded into shape under heat and
11pressure and then set into a rigid or slightly elastic form.
12    "Plastics gasification facility" means a manufacturing
13facility that:
14        (1) receives only uncontaminated plastics that have
15    been processed into a feedstock meeting the facility's
16    specifications for a gasification feedstock; and

1        (2) uses heat in an oxygen-deficient atmosphere to
2    process the feedstock into fuels, chemicals, or chemical
3    feedstocks that are returned to the economic mainstream in
4    the form of raw materials or products.
5    "Plastics pyrolysis facility" means a manufacturing
6facility that:
7        (1) receives only uncontaminated plastics that have
8    been processed into a feedstock meeting the facility's
9    specifications for a pyrolysis feedstock; and
10        (2) uses heat in the absence of oxygen to process the
11    uncontaminated plastics into fuels, chemicals, or chemical
12    feedstocks that are returned to the economic mainstream in
13    the form of raw materials or products.
14    (b) To the extent allowed by federal law, uncontaminated
15plastics that have been processed into a feedstock meeting
16feedstock specifications for a plastics gasification facility
17or plastics pyrolysis facility, and that are further processed
18by such a facility and returned to the economic mainstream in
19the form of raw materials or products, are considered recycled
20and are not subject to regulation as waste.
21    (c) The Agency may propose to the Board for adoption, and
22the Board may adopt, rules establishing standards for materials
23accepted as feedstocks by plastics gasification facilities and
24plastics pyrolysis facilities, rules establishing standards
25for the management of feedstocks at plastics gasification
26facilities and plastics pyrolysis facilities, and any other

1rules, as may be necessary to implement and administer this
2Section.
 
3    Section 99. Effective date. This Act takes effect upon
4becoming law.".
