AMENDMENT TO HOUSE BILL 2494

2    AMENDMENT NO. ______. Amend House Bill 2494 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Public Aid Code is amended by
5changing Section 10-17.6 as follows:
 
6    (305 ILCS 5/10-17.6)  (from Ch. 23, par. 10-17.6)
7    Sec. 10-17.6. Certification of Information to Licensing
8Agencies.
9    (a) The Illinois Department may provide by rule for
10certification to any State licensing agency to suspend, revoke,
11or deny issuance or renewal of licenses because of (i) the
12failure of responsible relatives to comply with subpoenas or
13warrants relating to paternity or child support proceedings and
14(ii) past due support owed by responsible relatives under a
15support order entered by a court or administrative body of this
16or any other State on behalf of resident or non-resident

1persons receiving child support enforcement services under
2Title IV, Part D of the Social Security Act. The rule shall
3provide for notice to and an opportunity to be heard by each
4responsible relative affected and any final administrative
5decision rendered by the Department shall be reviewed only
6under and in accordance with the Administrative Review Law. A
7responsible relative shall be provided notice on 3 separate
8occasions before the suspension of the driver's license of the
9responsible relative. The first 2 notices shall be issued by
10the Illinois Department, and the third notice shall be issued
11by the Secretary of State. If the responsible relative fails to
12avail himself or herself of the opportunities to prevent the
13suspension of his or her driver's license, the driver's license
14shall be suspended until the responsible relative meets the
15criteria for the restoration of his or her driving privileges.
16    (b) The Illinois Department may provide by rule for
17directing the Secretary of State to issue family financial
18responsibility driving permits upon petition of responsible
19relatives whose driver's licenses have been suspended in
20accordance with subsection (b) of Section 7-702.1 of the
21Illinois Vehicle Code. Any final administrative decisions
22rendered by the Department upon such petitions shall be
23reviewable only under and in accordance with the Administrative
24Review Law.
