| 12 | | (a) All money collected by the Clerk of the Circuit Court | 13 | | under Article 15 of this Act shall be remitted as directed in | 14 | | Article 15 of this Act to the county treasurer, to the State | 15 | | Treasurer, and to the treasurers of the units of local | 16 | | government. If an amount payable to any of the treasurers is |

| 1 | | less than $10, the clerk may postpone remitting the money until | 2 | | $10 has accrued or by the end of fiscal year. The treasurers | 3 | | shall deposit the money as indicated in the schedules, except, | 4 | | in a county with a population of over 3,000,000, money remitted | 5 | | to the county treasurer shall be subject to appropriation by | 6 | | the county board. Any amount retained by the Clerk of the | 7 | | Circuit Court in a county with population of over 3,000,000 | 8 | | shall be subject to appropriation by the county board. | 9 | | (b) The county treasurer or the treasurer of the unit of | 10 | | local government may create the funds indicated in paragraphs | 11 | | (1) through (5), (9), and (16) of subsection (d) of this | 12 | | Section, if not already in existence. If a county or unit of | 13 | | local government has not instituted, and does not plan to | 14 | | institute a program that uses a particular fund, the treasurer | 15 | | need not create the fund and may instead deposit the money | 16 | | intended for the fund into the general fund of the county or | 17 | | unit of local government for use in financing the court system. | 18 | | (c) If the arresting agency is a State agency, the | 19 | | arresting agency portion shall be remitted by the clerk of | 20 | | court to the State Treasurer who shall deposit the portion as | 21 | | follows: | 22 | | (1) if the arresting agency is the Department of State | 23 | | Police, into the State Police Law Enforcement | 24 | | Administration Fund; | 25 | | (2) if the arresting agency is the Department of | 26 | | Natural Resources, into the Conservation Police Operations |

| 6 | | (d) Fund descriptions and provisions: | 7 | | (1) The Court Automation Fund is to defray the expense, | 8 | | borne by the county, of establishing and maintaining | 9 | | automated record keeping systems in the Office of the Clerk | 10 | | of the Circuit Court. The money shall be remitted monthly | 11 | | by the clerk to the county treasurer and identified as | 12 | | funds for the Circuit Court Clerk. The fund shall be | 13 | | audited by the county auditor, and the board shall make | 14 | | expenditures from the fund in payment of any costs related | 15 | | to the automation of court records including hardware, | 16 | | software, research and development costs, and personnel | 17 | | costs related to the foregoing, provided that the | 18 | | expenditure is approved by the clerk of the court and by | 19 | | the chief judge of the circuit court or his or her | 20 | | designee. | 21 | | (2) The Document Storage Fund is to defray the expense, | 22 | | borne by the county, of establishing and maintaining a | 23 | | document storage system and converting the records of the | 24 | | circuit court clerk to electronic or micrographic storage. | 25 | | The money shall be remitted monthly by the clerk to the | 26 | | county treasurer and identified as funds for the circuit |

The fund shall be audited by the county | 2 | | auditor, and the board shall make expenditure from the fund | 3 | | in payment of any cost related to the storage of court | 4 | | records, including hardware, software, research and | 5 | | development costs, and personnel costs related to the | 6 | | foregoing, provided that the expenditure is approved by the | 7 | | clerk of the court. | 8 | | (3) The Circuit Clerk Operations and Administration | 9 | | Fund may be used to defray the expenses incurred for | 10 | | collection and disbursement of the various assessment | 11 | | schedules. The money shall be remitted monthly by the clerk | 12 | | to the county treasurer and identified as funds for the | 13 | | circuit court clerk. | 14 | | (4) The State's Attorney Records Automation Fund is to | 15 | | defray the expense of establishing and maintaining | 16 | | automated record keeping systems in the offices of the | 17 | | State's Attorney. The money shall be remitted monthly by | 18 | | the clerk to the county treasurer for deposit into the | 19 | | State's Attorney Records Automation Fund. Expenditures | 20 | | from this fund may be made by the State's Attorney for | 21 | | hardware, software, and research and development related | 22 | | to automated record keeping systems. | 23 | | (5) The Public Defender Records Automation Fund is to | 24 | | defray the expense of establishing and maintaining | 25 | | automated record keeping systems in the offices of the | 26 | | Public Defender. The money shall be remitted monthly by the |

| 1 | | clerk to the county treasurer for deposit into the Public | 2 | | Defender Records Automation Fund. Expenditures from this | 3 | | fund may be made by the Public Defender for hardware, | 4 | | software, and research and development related to | 5 | | automated record keeping systems. | 6 | | (6) The DUI Fund shall be used for enforcement and | 7 | | prevention of driving while under the influence of alcohol, | 8 | | other drug or drugs, intoxicating compound or compounds or | 9 | | any combination thereof, as defined by Section 11-501 of | 10 | | the Illinois Vehicle Code, including, but not limited to, | 11 | | the purchase of law enforcement equipment and commodities | 12 | | that will assist in the prevention of alcohol-related | 13 | | criminal violence throughout the State; police officer | 14 | | training and education in areas related to alcohol-related | 15 | | crime, including, but not limited to, DUI training; and | 16 | | police officer salaries, including, but not limited to, | 17 | | salaries for hire-back funding for safety checkpoints, | 18 | | saturation patrols, and liquor store sting operations.
Any | 19 | | moneys shall be used to purchase law enforcement equipment | 20 | | that will assist in the prevention of alcohol-related | 21 | | criminal violence throughout the State. The money shall be | 22 | | remitted monthly by the clerk to the State or local | 23 | | treasurer for deposit as provided by law. | 24 | | (7) The Trauma Center Fund shall be distributed as | 25 | | provided under Section 3.225 of the Emergency Medical | 26 | | Services (EMS) Systems Act. |

| 1 | | (8) The Probation and Court Services Fund is to be | 2 | | expended as described in Section 15.1 of the Probation and | 3 | | Probation Officers Act. | 4 | | (9) The Circuit Court Clerk Electronic Citation Fund | 5 | | shall have the Circuit Court Clerk as the custodian, ex | 6 | | officio, of the Fund and shall be used to perform the | 7 | | duties required by the office for establishing and | 8 | | maintaining electronic citations. The Fund shall be | 9 | | audited by the county's auditor. | 10 | | (10) The Drug Treatment Fund is a special fund in the | 11 | | State treasury. Moneys in the Fund shall be expended as | 12 | | provided in Section 411.2 of the Illinois Controlled | 13 | | Substances Act. | 14 | | (11) The Violent Crime Victims Assistance Fund is a | 15 | | special fund in the State treasury to provide moneys for | 16 | | the grants to be awarded under the Violent Crime Victims | 17 | | Assistance Act. | 18 | | (12) The Criminal Justice Information Projects Fund | 19 | | shall be appropriated to and administered by the Illinois | 20 | | Criminal Justice Information Authority for distribution to | 21 | | fund Department of State Police drug
task forces and | 22 | | Metropolitan Enforcement Groups, for the costs associated | 23 | | with making grants from the Prescription Pill and Drug | 24 | | Disposal Fund, for undertaking criminal justice | 25 | | information projects, and for the operating and other

The moneys deposited into | 2 | | the Criminal Justice Information Projects Fund under | 3 | | Sections 15-15 and 15-35 of this Act shall be appropriated | 4 | | to and administered by the Illinois Criminal Justice | 5 | | Information Authority for distribution to fund Department | 6 | | of State Police drug
task forces and Metropolitan | 7 | | Enforcement Groups
by dividing the
funds equally by the | 8 | | total number of Department of State Police
drug task forces | 9 | | and Illinois Metropolitan Enforcement Groups. | 10 | | (13) The Sexual Assault Services Fund shall be | 11 | | appropriated to the Department of Public Health. Upon | 12 | | appropriation of moneys from the Sexual Assault Services | 13 | | Fund, the Department of Public Health shall make grants of | 14 | | these moneys to sexual assault organizations with whom the | 15 | | Department has contracts for the purpose of providing | 16 | | community-based services to victims of sexual assault. | 17 | | Grants are in addition to, and are not substitutes for, | 18 | | other grants authorized and made by the Department. | 19 | | (14) The County Jail Medical Costs Fund is to help | 20 | | defray the costs outlined in Section 17 of the County Jail | 21 | | Act. Moneys in the Fund shall be used solely for | 22 | | reimbursement to the county of costs for medical expenses | 23 | | and administration of the Fund. | 24 | | (15) The Prisoner Review Board Vehicle and Equipment | 25 | | Fund is a special fund in the State treasury. The Prisoner | 26 | | Review Board shall, subject to appropriation by the General |

| 1 | | Assembly and approval by the Secretary, use all moneys in | 2 | | the Prisoner Review Board Vehicle and Equipment Fund for | 3 | | the purchase and operation of vehicles and equipment. | 4 | | (16) In each county in which a Children's Advocacy | 5 | | Center provides services, a Child Advocacy Center Fund is | 6 | | specifically for the operation and administration of the | 7 | | Children's Advocacy Center, from which the county board | 8 | | shall make grants to support the activities and services of | 9 | | the Children's Advocacy Center within that county.
| 10 | | (17) In each county in which Court Appointed Special | 11 | | Advocates provide services, a Court Appointed Special | 12 | | Advocates Fund is specifically for the operations of the | 13 | | Court Appointed Special Advocates, from which the county | 14 | | board shall make grants to support the activities and | 15 | | services of the Court Appointed Special Advocates within | 16 | | that county.
