SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/22.01  from Ch. 111 1/2, par. 1022.01

    Amends the Environmental Protection Act. Provides that when manifests are required by the Pollution Control Board for the shipment of nonhazardous special waste, the manifests shall consist of forms prescribed by the Environmental Protection Agency, rather than being identical to manifests required for the shipment of hazardous waste. Provides that the forms must comply with the requirements of the Act and may be purchased from a third party, rather than provided by the Agency. Effective immediately.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5changing Section 22.01 as follows:
 
6    (415 ILCS 5/22.01)  (from Ch. 111 1/2, par. 1022.01)
7    Sec. 22.01. Manifests for nonhazardous special waste. When
8manifests are required by the Board for the shipment of
9nonhazardous special waste, the manifests shall consist of
10forms prescribed by the Agency. The forms must comply with the
11requirements of this Section and may be purchased from a third
12party. such manifests shall be identical to manifests required
13for the shipment of hazardous waste. Such manifests may be
14provided by the Agency, and shall be identical to the manifests
15required by the Board for hazardous waste. Generators of
16nonhazardous special waste and facilities accepting
17nonhazardous special waste are not required to submit copies of
18nonhazardous special waste manifests to the Agency; provided,
19however, that generators of nonhazardous special waste
20containing polychlorinated biphenyls and facilities accepting
21nonhazardous special waste containing polychlorinated
22biphenyls shall submit copies of nonhazardous special waste
23manifests to the Agency for shipments of waste containing

1polychlorinated biphenyls. Copies of each manifest shall be
2retained for 3 years by generators and facilities, and shall be
3available for inspection and copying by the Agency. The Agency
4may adopt such procedures for the distribution of copies of
5manifests as it deems necessary. Nothing in this Section shall
6preclude the Agency from collecting fees under Section 22.8 (g)
7of this Act. Generators of nonhazardous special waste shall not
8be required to file reports with the Agency regarding the
9shipment of nonhazardous special waste within the State of
10Illinois; provided, however, that the Board may require
11generators of nonhazardous special waste to file annual reports
12with the Agency regarding the shipment of nonhazardous special
13waste out-of-state. Commencing February 1, 1992, and annually
14thereafter, facilities accepting nonhazardous special waste
15shall file a report with the Agency, specifying the quantities
16and disposition of nonhazardous special waste accepted for
17treatment, storage or disposal during the previous calendar
18year.
19    Nothing in this Section shall be interpreted or construed
20to prohibit any company treating, storing or disposing of
21nonhazardous special wastes from requiring manifests to be
22submitted to it for such wastes. This Section does not apply to
23potentially infectious medical waste.

25    Section 99. Effective date. This Act takes effect upon
26becoming law.
