| 2 | | AMENDMENT NO. ______. Amend House Bill 2915 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 1. Public policy. The adoption and use of | 5 | | technology is critical to the field of disabilities. The | 6 | | benefits of incorporating newer and emerging technologies are | 7 | | innumerable. And, for Illinois' citizens with disabilities, | 8 | | the successful implementation of technology will result in an | 9 | | enhanced quality of life and increased independence. The | 10 | | immeasurable benefits will be felt statewide and may include: | 11 | | (1) more persons with disabilities being able to live | 12 | | in their own homes with fewer roommates and less dependence | 13 | | on physical staff presence; | 14 | | (2) mainstream technologies that incorporate | 15 | | accessibility features into devices as a standard practice | 16 | | and allow persons with disabilities to effectively use the | 17 | | same devices as everyone else, allowing them to blend into |

| 1 | | the fabric of the community; | 2 | | (3) commercially available, off-the-shelf solutions | 3 | | becoming increasingly affordable, more so than products | 4 | | traditionally designed specifically for persons with | 5 | | disabilities; | 6 | | (4) many products designed to be mobile so that the | 7 | | technology can go with a person from home to work to the | 8 | | community, which will allow a level of flexibility that is | 9 | | rare with older technologies; and | 10 | | (5) providers being able to reallocate staffing | 11 | | resources as the work force crisis is able to be addressed | 12 | | through the implementation of technology.
| 13 | | Section 5. The Mental Health and Developmental | 14 | | Disabilities Administrative Act is amended by adding Section | 15 | | 4.5 as follows: | 16 | | (20 ILCS 1705/4.5 new) | 17 | | Sec. 4.5. Assistive Technology for Persons with | 18 | | Developmental Disabilities Pilot Program. | 19 | | (a) Subject to appropriation, the Department shall | 20 | | establish the Assistive Technology for Persons with | 21 | | Developmental Disabilities Pilot Program hereinafter referred | 22 | | to as the Pilot Program. The Pilot Program shall: | 23 | | (1) serve persons with intellectual and developmental | 24 | | disabilities currently receiving Home and Community-Based |

| 1 | | Services in this State; | 2 | | (2) fund only newer and emerging technologies not | 3 | | covered under the existing Home and Community-Based | 4 | | Services waiver; | 5 | | (3) not affect existing funding of technologies that | 6 | | are covered under the existing Home and Community-Based | 7 | | Services waiver; | 8 | | (4) include technology supports for a person in his or | 9 | | her residence, day program, or community; | 10 | | (5) assist persons with intellectual and developmental | 11 | | disabilities to live person-centered lives of their own | 12 | | choosing; | 13 | | (6) examine the use and impact of technology supports | 14 | | on the participating individuals' quality of life, | 15 | | personal growth, and personal satisfaction with the | 16 | | supports; | 17 | | (7) examine the use and impact of the technology | 18 | | supports on members of the greater intellectual and | 19 | | developmental disabilities community as they live, work, | 20 | | and play in their communities; and | 21 | | (8) be administered via agreement between provider | 22 | | agencies and the Department. | 23 | | (b) The Department shall create a Request for Proposals | 24 | | (RFP) for the Pilot Program and distribute it to all | 25 | | community-based programs and organizations. Interested | 26 | | programs and organizations must submit a completed RFP in order |

| 1 | | to have their proposal considered for this Pilot Program. As | 2 | | part of the RFP, organizations must: | 3 | | (1) provide a general explanation of the type of | 4 | | technology being proposed for the Pilot Program; | 5 | | (2) describe the outcomes expected from the | 6 | | implementation of the proposed technology; | 7 | | (3) provide the name and qualifications of proposed | 8 | | external vendors, if applicable; and | 9 | | (4) estimate the anticipated annual expense of the | 10 | | proposal and provide a breakdown of which expenses are | 11 | | covered by the program or organization and which expenses | 12 | | are covered by the Department under the Pilot Program. | 13 | | (c) The Department shall select the proposals for the Pilot | 14 | | Program. | 15 | | (d) The Department shall notify the programs and | 16 | | organizations that submitted proposals of its decision. The | 17 | | programs and organizations selected for the Pilot Program | 18 | | shall: | 19 | | (1) identify the individuals who will be participating | 20 | | in the approved projects; | 21 | | (2) describe the expected outcomes for each individual | 22 | | participating in the approved projects; | 23 | | (3) incorporate the use of the technology in the | 24 | | person's service plan and monitor progress quarterly; | 25 | | (4) provide documentation of team agreement to | 26 | | implement the technology; |

| 1 | | (5) complete a technology assessment for each person | 2 | | who is participating in the Pilot Program with the | 3 | | assessment reflecting the appropriateness of the | 4 | | technology being implemented; and | 5 | | (6) provide training to participants and their support | 6 | | staff on the technology being implemented. The training | 7 | | shall include general information, expected outcomes, use | 8 | | of devices, and maintenance, and repair of any equipment. | 9 | | (e) If the selected proposals include remote support | 10 | | technologies, programs and organizations shall: | 11 | | (1) furnish informed consent documents signed by the | 12 | | participant or his or her legal representative; | 13 | | (2) describe the supervision requirements for each | 14 | | participant and explain how the technology will meet those | 15 | | requirements; | 16 | | (3) provide a back-up plan for participants that | 17 | | addresses system failures, inclement weather, and | 18 | | emergency response; and | 19 | | (4) develop and provide an individualized support | 20 | | protocol with the remote support provider. | 21 | | (f) The Pilot Program shall be established no later than | 22 | | July 1, 2019, and projects shall begin no later than January 1, | 23 | | 2020. The duration of the Pilot Program shall be 2 years unless | 24 | | recommended changes are made to the Home and Community-Based | 25 | | Services waiver before that time in which case the technologies | 26 | | shall continue to be funded under the parameters of the revised |

| 2 | | Section 99. Effective date. This Act takes effect upon | 3 | | becoming law.".
