Higher education supplier diversity report. | 13 | | (a) Every private institution of higher education approved | 14 | | by the Illinois Student Assistance Commission for purposes of | 15 | | the Monetary Award Program shall submit a 2-page report on its |

| 1 | | voluntary supplier diversity program to the Department. The | 2 | | report shall set forth all of the following: | 3 | | (1) The name, address, phone number, and e-mail address | 4 | | of the point of contact for the supplier diversity program | 5 | | (or the institution's procurement program if there is no | 6 | | supplier diversity program) for vendors to register with | 7 | | the program. | 8 | | (2) Local and State certifications the institution | 9 | | accepts or recognizes for minority-owned, women-owned, or | 10 | | veteran-owned business status. | 11 | | (3) On the second page, a narrative explaining the | 12 | | results of the report and the tactics to be employed to | 13 | | achieve the goals. | 14 | | (4)
The voluntary goals, if any, for either
fiscal year | 15 | | or calendar year 2019 in each category for the
entire | 16 | | budget of the institution (expending both public and
| 17 | | private moneys, including any fee-supported entities) and
| 18 | | the commodity codes or a description of particular goods | 19 | | and services for the area of procurement in which
the | 20 | | institution expects most of those goals to focus on in
the | 21 | | next year. However, a private institution of higher | 22 | | education may report the
information under this paragraph | 23 | | (4) for fiscal year or
calendar year 2018 instead. With | 24 | | respect to
private institutions of higher education,
| 25 | | beginning with the 2020 report, the actual spending for the
| 26 | | entire budget of the institution (expending both public and
|

| 1 | | private moneys, including any fee-supported entities) for
| 2 | | minority business enterprises, women's business
| 3 | | enterprises, and veteran-owned businesses, expressed both
| 4 | | in actual dollars and as a percentage of the total budget
| 5 | | of the institution. However, if
a private institution of | 6 | | higher education elects to report
the information under | 7 | | paragraph (3) for fiscal year or calendar year 2018 | 8 | | instead, then the
information under this paragraph (4) must | 9 | | be reported
beginning with the 2020 report. | 10 | | Each private institution of higher education is required to | 11 | | submit a searchable Adobe PDF report to the Department on or | 12 | | before November 15, 2019 and on or before November 15 of each | 13 | | year thereafter. However, if a private institution of higher | 14 | | education elects to report the information under paragraph (3) | 15 | | for fiscal year or calendar year 2018 instead, then the | 16 | | institution is required to submit the report on or before | 17 | | November 15, 2019 and on or before November 15 of each year | 18 | | thereafter. | 19 | | (b) For each report submitted under subsection (a), the | 20 | | Department shall publish the results on its Internet website | 21 | | for 5 years after submission. The Department is not responsible | 22 | | for collecting the reports or for the content of the reports. | 23 | | (c) The Department shall hold an annual higher education | 24 | | supplier diversity workshop in February of 2020 and every | 25 | | February thereafter to discuss the reports with | 26 | | representatives of the institutions of higher education and |

| 1 | | vendors. | 2 | | (d) The Department shall prepare a one-page template (not | 3 | | including the narrative section) for the voluntary supplier | 4 | | diversity reports. | 5 | | (20 ILCS 605/605-1030 new) | 6 | | Sec. 605-1030. Office of Supplier Diversity. | 7 | | (a) The Office of Supplier Diversity is hereby created | 8 | | within the Department. The Office shall assist minority-owned | 9 | | businesses, women-owned businesses, and veteran-owned | 10 | | businesses as well as State institutions that contract with | 11 | | those businesses. The Office shall serve as a repository for | 12 | | reports and information concerning entities that manage | 13 | | supplier diversity programs to assist minority-owned, | 14 | | women-owned, and veteran-owned businesses in connecting with | 15 | | potential clients. | 16 | | (b) The Office shall conduct public workshops focused on | 17 | | specific industries to collaboratively connect diverse | 18 | | enterprises with entities that manage supplier diversity | 19 | | programs. These workshops shall be modeled after Illinois | 20 | | Commerce Commission hearings for utilities and railroads and | 21 | | shall include a collaborative discussion of filed supplier | 22 | | diversity reports. The annual calendar for these workshops | 23 | | shall be as follows: | 24 | | (1) Gaming, February. | 25 | | (2) Hospitals, April. |

| 1 | | (3) Public and private higher education, July. | 2 | | (4) Economic Development for a Growing Economy tax | 3 | | credits, September. | 4 | | (5) Museums and professional sports teams, November. | 5 | | (c) In addition, the Department shall compile and publish | 6 | | on its website a master database of all points of contact for | 7 | | supplier diversity programs, including certifications accepted | 8 | | and links to the most recent supplier diversity reports | 9 | | submitted under: | 10 | | Section 405-530 of the Department of Central | 11 | | Management Services Law of the Civil Administrative Code of | 12 | | Illinois, | 13 | | Section 5.3 of the Illinois Health Facilities Planning | 14 | | Act, | 15 | | Section 8k of the Business Enterprise for Minorities, | 16 | | Women, and Persons with Disabilities Act, | 17 | | Section 5-57 of the Economic Development for a Growing | 18 | | Economy Tax Credit Act, | 19 | | Section 5-117 of the Public Utilities Act, | 20 | | Section 12.2 of the Illinois Horse Racing Act of 1975, | 21 | | or | 22 | | Section 10 of the Railroad Supplier Diversity Act. | 23 | | Section 15. The Business Enterprise for Minorities, Women, | 24 | | and Persons with

| 1 | | (30 ILCS 575/8k new) | 2 | | Sec. 8k. Museum and sports facility diversity report. | 3 | | (a) Beginning in Fiscal Year 2020 and each fiscal year | 4 | | thereafter, (i) any museum under the authority of a park | 5 | | district in a municipality having a population of 1,000,000 or | 6 | | more, (ii) any sports facility under the jurisdiction of the | 7 | | Illinois Sports Facilities Authority, and (iii) any | 8 | | professional sports team located in the State that had annual | 9 | | ticket sales of more than $20,000,000 in the previous calendar | 10 | | year shall submit an annual diversity report to the Department, | 11 | | on or before January 30, which includes information and data on | 12 | | diversity goals, and progress toward achieving those goals, by | 13 | | businesses owned by minorities, women, and persons with | 14 | | disabilities. | 15 | | (b) The diversity report shall include the following | 16 | | information from the previous fiscal year: | 17 | | (1) the percentage of total annual spending on | 18 | | contracts with businesses owned by minorities, women, and | 19 | | persons with disabilities; | 20 | | (2) the total number of contracts awarded or let to | 21 | | businesses owned by minorities, women, and persons with | 22 | | disabilities; | 23 | | (3) the type of professional service contracts awarded | 24 | | or let to business owned by minorities, women, and persons | 25 | | with disabilities, including, but not limited to, |

| 1 | | construction management, media, accounting, marketing, and | 2 | | public relations contracts; | 3 | | (4) whether the business owned by minorities, women, or | 4 | | persons with disabilities is the primary entity holding the | 5 | | contract with the museum or sports facility or a | 6 | | subcontractor on a larger contract with the museum or | 7 | | sports facility; | 8 | | (5) a narrative description of contracting diversity | 9 | | and equity goals and strategic plans for meeting those | 10 | | goals; | 11 | | (6) the percentage of total annual spending in | 12 | | professional services with businesses owned by minorities, | 13 | | women, and persons with disabilities, including, but not | 14 | | limited to, the following professional services | 15 | | categories: (i) accounting; (ii) architecture and | 16 | | engineering; (iii) consulting; (iv) information | 17 | | technology; (v) insurance; (vi) financial, legal, media, | 18 | | construction management, and marketing services; and (vii) | 19 | | other professional services; and | 20 | | (7) when reporting on businesses owned by minorities, | 21 | | the report shall include a breakdown by demographic group. | 22 | | The reports shall be submitted in the format as prescribed | 23 | | by the Department by rule. The Department shall publish each | 24 | | annual report on its website. In November of each year, the | 25 | | Department shall transmit to the General Assembly a report | 26 | | including a summary of the information reported to the |

| 1 | | Department for the previous fiscal year and a cumulative | 2 | | summary for all previous years in which reports were filed. | 3 | | (c) The Department shall hold an annual symposium on or | 4 | | before July 30, 2020, and on or before July 30 of every year | 5 | | thereafter, that is open to the public on the status of | 6 | | contracting diversity and equity goals, and to share best | 7 | | practices and to collaboratively seek solutions to structural | 8 | | impediments that preclude achieving those goals. Museums may | 9 | | hold this symposium together or separately. | 10 | | (d) The Department shall publish a database on its website | 11 | | of the point of contact for each museum and sports facility | 12 | | responsible for business diversity, along with a list of | 13 | | certifications each recognizes for business diversity. | 14 | | (e) As used in this Section, "Department" means the | 15 | | Department of Commerce and Economic Opportunity. | 16 | | Section 20. The Economic Development for a Growing Economy | 17 | | Tax Credit Act is amended by changing Section 5-57 as follows: | 18 | | (35 ILCS 10/5-57) | 19 | | Sec. 5-57. Supplier diversity goals; reports. Each | 20 | | taxpayer claiming a credit under this Act shall, no later than | 21 | | April 15 of each taxable year for which the taxpayer claims a | 22 | | credit under this Act, submit to the Department of Commerce and | 23 | | Economic Opportunity an annual report containing the | 24 | | information described in subsections (b), (c), (d), and (e) of |

| 1 | | Section 5-117 of the Public Utilities Act. Those reports shall | 2 | | be submitted in the form and manner required by the Department | 3 | | of Commerce and Economic Opportunity and shall be published on | 4 | | the Department's website .
