AMENDMENT TO HOUSE BILL 3222

2    AMENDMENT NO. ______. Amend House Bill 3222, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:

"ARTICLE 1.

 
6    Section 1-5. "AN ACT concerning civil law", approved August
722, 2005, Public Act 94-653, is amended by changing Section 5
8as follows:
 
9    (P.A. 94-653, Sec. 5)
10    Sec. 5. The Illinois Department of Human Services is hereby
11authorized to grant and convey a permanent conservation
12easement to the Illinois Department of Natural Resources or to
13the Chicago Park District on a parcel containing 30 acres, more
14or less, that is located in Section 18, Township 40 North,
15Range 13 East of the third principal meridian, Cook County,

1Illinois, situated to the West and South of the Chicago Read
2Mental Health Center, for the purpose of preserving and
3protecting the wetlands and forested area for the benefit of
4the patients of the facility, the community, and the general
5public, this 30-acre parcel being more particularly described
6under Section 10 of this Act.

9    Section 1-10. "An Act concerning civil law", approved
10August 22, 2005, Public Act 94-653, is amended by repealing
11Section 10.

ARTICLE 2.

 
13    Section 2-5. The Director of the Department of Natural
14Resources, on behalf of the State of Illinois, is authorized to
15terminate all contractual interests of the State of Illinois
16provided in the Agreement between the State of Illinois,
17through the former Department of Conservation, and the City of
18Pana, a Municipal Corporation, situated in Christian County,
19made on June 28, 1949, for the purpose of funding the
20construction of a dam and water reservoir to create the Pana
21Lake Project.
 
22    Section 2-10. The State of Illinois contractual interests

1authorized to be terminated by this Act include the following:
2    (1) Rights to develop, manage, and maintain any and all of
3the lands associated with the Pana Lake Project, as described
4in Exhibit A of the Agreement, as part of a Statewide lake,
5water storage, and public recreation system, including public
6hunting and fishing grounds development of game management and
7reforestation and to use said area for the preservation and
8propagation of fish and wildlife thereon for 99 years.
9    (2) Obligation of the City of Pana to maintain the Pana
10Lake Project at its own sole cost and expense and keep in good
11repair at all times the dam and all facilities erected in
12connection therewith.
13    (3) Right to purchase the land occupied by the Pana Lake
14Project if the City of Pana shall at any time determine to sell
15such land and the improvements thereon.
 
16    Section 2-15. The State of Illinois paid $100,000 toward
17the Pana Lake Project in consideration for obtaining the
18foregoing contractual interests pursuant to appropriation of
19State funds for the purpose made in Section 4 of Senate Bill
20662 by the 65th General Assembly, approved July 21, 1947.
 
21    Section 2-20. The State of Illinois shall not receive
22consideration for the termination of its contractual rights of
23the June 28, 1949 Agreement.

1    Section 2-25. The Director of the Department of Natural
2Resources may execute a mutual termination with the City of
3Pana terminating both parties' interests in the June 28, 1949
4Agreement.

ARTICLE 3.

 
6    Section 3-5. The Director of the Department of Natural
7Resources, on behalf of the State of Illinois, is authorized to
8execute and deliver to the Forest Preserve District of Will
9County, a forest preserve district organized and existing under
10the laws of the State of Illinois, of the County of Will, State
11of Illinois, for and in consideration of $1 paid to the
12Department, a quitclaim deed to the following described real
13property, to wit:
 
14    A tract conveyed to the State of Illinois by Document No.
15R75-17163, dated July 3, 1975 in County of Will, State of
16Illinois, description as follows:
 
17    The South half of Lot l, Lots 2, 3, 5, 6, 8, 9, 11, 12, 13,
18    14, 15, 16, 17, 18, 19, and 20 in the Subdivision of the
19    Southwest quarter of Section 1, in Township 34 North and in
20    Range 13 East of the Third Principal Meridian, according to
21    the plat thereof recorded December 9, 1946, in Book 1140,
22    page 537, as Document No. 617215, (excepting therefrom that

3    Section 4-10. The conveyances of real property authorized
4by Section 4-5 are subject to: (1) existing public utilities,
5existing public roads, and any and all reservations, easements,
6encumbrances, covenants, and restrictions of record; and (2)
7the express condition that if said real property ceases to be
8used for public purposes, it shall revert to the State of
9Illinois, Medical District Commission.
 
10    Section 4-15. The President of the Illinois Medical
11District Commission shall obtain a certified copy of the
12portions of this Act containing the title, the enacting clause,
13the effective date, the appropriate Section or Sections
14containing the land descriptions of the property to be
15conveyed, and this Section within 60 days after its effective
16date and shall record the certified document in the Recorder's
17office in the county in which the land is located.

ARTICLE 99.

 
19    Section 99-99. Effective date. This Act takes effect upon
20becoming law.".
