AMENDMENT TO HOUSE BILL 3427

2    AMENDMENT NO. ______. Amend House Bill 3427 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the Water
5Heater Safety Valve Act.
 
6    Section 5. Temperature mixing valve or safety valve. A
7manufacturer or supplier of a water heater or tank for use in a
8residence or residential facility located in Illinois must
9supply or attach a temperature mixing valve or other safety
10valve to the water heater or tank that prevents water with a
11temperature above 120 degrees Fahrenheit from coming from any
12bathtub faucet, shower faucet, sink faucet, or any other source
13of water into direct contact with a person.
 
14    Section 10. Enforcement and administration; civil
15penalties.

1    (a) The Department of Public Health shall administer and
2enforce the provisions of this Act.
3    (b) Any person or entity who violates this Act shall be
4liable for a civil penalty of $500 for the first violation and
5$1,000 for each subsequent violation. The State's Attorney of
6the county in which the violation occurred or the Attorney
7General may bring an action in the circuit court of the county
8in which the violation occurred to enforce the collection of
9any civil penalty imposed.
 
10    Section 90. The Illinois Plumbing License Law is amended by
11changing Section 40 as follows:
 
12    (225 ILCS 320/40)  (from Ch. 111, par. 1138)
13    Sec. 40. All persons engaged in plumbing as defined in this
14Act shall comply with the minimum code of standards for
15plumbing and the fixtures, materials, design and installation
16methods of plumbing systems published by the Department and
17filed with the Secretary of State as required by this Act.
18    All installations of equipment, fixtures, appliances or
19piping which are used or intended for use entirely for or as a
20part of a water supply system or sewage disposal system and
21thereby can affect the public health shall comply with the
22provisions of the State Plumbing Code for design, materials,
23installation and maintenance. The installation, repair,
24maintenance, alteration or extension of building sewers shall

1be done in accordance with the State Plumbing Code. Any person
2engaged in any of such work shall upon investigation and
3determination of non-compliance with the provisions of the
4State Plumbing Code be subject to the penalties contained in
5this Act. Such prosecution shall be the responsibility of the
6State's Attorney or other authority as authorized by this Act.
7    A person engaged in plumbing who installs a water heater or
8tank for use in a residence or residential facility located in
9Illinois must supply or attach a temperature mixing valve or
10other safety valve to the water heater or tank that prevents
11water with a temperature above 120 degrees Fahrenheit from
12coming from any bathtub faucet, shower faucet, sink faucet, or
13any other source of water into direct contact with a person.
