AMENDMENT TO HOUSE BILL 3469

2    AMENDMENT NO. ______. Amend House Bill 3469, AS AMENDED,
3with reference to page and line numbers of Senate Amendment No.
41, as follows:
 
5on page 4, line 22, by replacing "three" with "four"; and
 
6on page 4, line 23, after "labor community," by inserting
7"environmental community,"; and
 
8on page 5, by replacing lines 6 through 9 with the following:
 
9        "(9) the Director of Employment Security, or his or her
10    designee;
11        (10) the Superintendent of the State Board of
12    Education, or his or her designee; and
13        (11) the Director of the Illinois Community College
14    Board, or his or her designee."; and

1on page 5, line 11, by replacing "January 31, 2021" with
2"February 28, 2021"; and
 
3on page 6, line 2, by replacing "November 1, 2021" with
4"December 1, 2021"; and
 
5on page 31, line 23, after the period, by inserting "This
6Section is repealed one year after the effective date of this
7amendatory Act of the 101st General Assembly."; and
 
8on page 89, by replacing lines 1 through 8 with "1, 2015.
9Nothing shall be deemed to prohibit an individual from using
10this site to determine a Firearm Owner's Identification Card
11status. The Department shall adopt rules not inconsistent with
12this Section to implement this system."; and
 
13by replacing line 17 on page 92 through line 22 on page 94 with
14the following:
 
15    "(430 ILCS 65/6)  (from Ch. 38, par. 83-6)
16    Sec. 6. Contents of Firearm Owner's Identification Card.
17    (a) A Firearm Owner's Identification Card, issued by the
18Department of State Police at such places as the Director of
19the Department shall specify, shall contain the applicant's
20name, residence, date of birth, sex, physical description,

1recent photograph, except as provided in subsection (c-5), and
2signature. Each Firearm Owner's Identification Card must have
3the expiration date boldly and conspicuously displayed on the
4face of the card, unless the validity has been extended under
5subsection (b) of Section 7. Each Firearm Owner's
6Identification Card must have printed on it the following:
7"CAUTION - This card does not permit bearer to UNLAWFULLY carry
8or use firearms." Before December 1, 2002, the Department may
9use a person's digital photograph and signature from his or her
10Illinois driver's license or Illinois Identification Card, if
11available. On and after December 1, 2002, the Department shall
12use a person's digital photograph and signature from his or her
13Illinois driver's license or Illinois Identification Card, if
14available. The Department shall decline to use a person's
15digital photograph or signature if the digital photograph or
16signature is the result of or associated with fraudulent or
17erroneous data, unless otherwise provided by law.
18    (b) A person applying for a Firearm Owner's Identification
19Card shall consent to the Department of State Police using the
20applicant's digital driver's license or Illinois
21Identification Card photograph, if available, and signature on
22the applicant's Firearm Owner's Identification Card. The
23Secretary of State shall allow the Department of State Police
24access to the photograph and signature for the purpose of
25identifying the applicant and issuing to the applicant a
26Firearm Owner's Identification Card.

1    (c) The Secretary of State shall conduct a study to
2determine the cost and feasibility of creating a method of
3adding an identifiable code, background, or other means on the
4driver's license or Illinois Identification Card to show that
5an individual is not disqualified from owning or possessing a
6firearm under State or federal law. The Secretary shall report
7the findings of this study 12 months after the effective date
8of this amendatory Act of the 92nd General Assembly.
9    (c-5) If a person qualifies for a photograph exemption, in
10lieu of a photograph, the Firearm Owner's Identification Card
11shall contain a copy of the card holder's fingerprints. Each
12Firearm Owner's Identification Card described in this
13subsection (c-5) must have printed on it the following: "This
14card is only valid for firearm purchases through a federally
15licensed firearms dealer when presented with photographic
16identification, as prescribed by 18 U.S.C. 922(t)(1)(C)."
