SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/5-12001.3 new
60 ILCS 1/110-12 new
65 ILCS 5/11-13-1.2 new

    Amends the Counties Code, Township Code, and Illinois Municipal Code. Provides that the governing body of a county, township, or municipality may waive any fees or costs associated with a permit, inspection, or certification of occupancy required by law for construction, reconstruction, alteration, repair, movement to another site, removal, or demolition of a manufactured home, building, dwelling, or structure, either commercial or residential, damaged as a result of a disaster, emergency, weather event, or for any reason deemed warranted in the interests of public safety, welfare, and recovery of the community by the governing body of the county, township, or municipality. Defines "disaster". Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
55-12001.3 as follows:
 
6    (55 ILCS 5/5-12001.3 new)
7    Sec. 5-12001.3. Waiver of building, inspection, and
8construction fees.
9    (a) As used in this Section, "disaster" includes, but is
10not limited to, an occurrence or threat of widespread or severe
11damage, injury, or loss of life or property resulting from any
12natural or technological cause, including, but not limited to,
13fire, flood, earthquake, wind, storm, hazardous materials
14spill, or other water contamination, epidemic, air
15contamination, blight, extended periods of severe, and
16inclement weather, drought, infestation, critical shortages of
17essential fuels and energy, explosion, riot, hostile military
18or paramilitary action, public health emergencies, or acts of
19domestic terrorism.
20    (b) Notwithstanding any other provision of law, a county
21board or board of county commissioners may, by resolution,
22waive any fees or costs associated with a permit, inspection,
23or certification of occupancy required by law for construction,

8    Section 10. The Township Code is amended by adding Section
9110-12 as follows:
 
10    (60 ILCS 1/110-12 new)
11    Sec. 110-12. Waiver of building, inspection, and
12construction fees.
13    (a) As used in this Section, "disaster" includes, but is
14not limited to, an occurrence or threat of widespread or severe
15damage, injury, or loss of life or property resulting from any
16natural or technological cause, including, but not limited to,
17fire, flood, earthquake, wind, storm, hazardous materials
18spill, or other water contamination, epidemic, air
19contamination, blight, extended periods of severe, and
20inclement weather, drought, infestation, critical shortages of
21essential fuels and energy, explosion, riot, hostile military
22or paramilitary action, public health emergencies, or acts of

7result of a disaster, emergency, weather event, or for any
8reason deemed warranted in the interests of public safety,
9welfare, and recovery of the community by the board of trustees
10of the township.
 
11    Section 15. The Illinois Municipal Code is amended by
12adding Section 11-13-1.2 as follows:
 
13    (65 ILCS 5/11-13-1.2 new)
14    Sec. 11-13-1.2. Waiver of building, inspection, and
15construction fees.
16    (a) As used in this Section, "disaster" includes, but is
17not limited to, an occurrence or threat of widespread or severe
18damage, injury, or loss of life or property resulting from any
19natural or technological cause, including, but not limited to,
20fire, flood, earthquake, wind, storm, hazardous materials
21spill, or other water contamination, epidemic, air

8demolition of a manufactured home, building, dwelling, or
9structure, either commercial or residential, damaged as a
10result of a disaster, emergency, weather event, or for any
11reason deemed warranted in the interests of public safety,
12welfare, and recovery of the community by the city council of
13the municipality.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.
