Amends the Voluntary Health Services Plans Act. Provides that if a health services plan corporation furnishes dental services to the plan's subscribers and beneficiaries and these services are rendered by dentists licensed in Illinois, the board of trustees of the corporation shall appoint a Dental Director who shall be a dentist licensed to practice dentistry in Illinois. Provides that the Dental Director, under the board of trustees, shall have control of and responsibility for the dental and dental-related scientific aspects of the business of the corporation. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Voluntary Health Services Plans Act is | 5 | | amended by changing Section 5 as follows:
| 6 | | (215 ILCS 165/5) (from Ch. 32, par. 599)
| 7 | | Sec. 5.
The business and affairs of a health services plan
| 8 | | corporation shall be managed by a board of trustees, which | 9 | | shall have
the power to adopt, and to amend from time to time, | 10 | | by-laws governing
the conduct of the corporation's business. | 11 | | The board of trustees shall
consist of not less than seven | 12 | | persons, all of whom shall have the same
general qualifications | 13 | | as the incorporators, and at least 30% of whom
shall, in | 14 | | addition, be physicians or dentists, licensed in Illinois to | 15 | | practice
medicine in all of its branches or dentistry, | 16 | | respectively; provided, however,
that if in computing
the | 17 | | required number of physicians or dentists on the board of | 18 | | trustees, the amount
of 30% does not coincide with a whole | 19 | | number, but lies between whole
numbers, the smaller whole | 20 | | number shall be controlling as to the number
of physicians or | 21 | | dentists. The original board of trustees shall be appointed by | 22 | | the
incorporators. Trustees shall serve for a term of three | 23 | | years, except
that as to the original appointed board, not more |

| 1 | | than one-third of the
members thereof shall be appointed for | 2 | | three years, not more than
one-third thereof for two years and | 3 | | the balance thereof for one year. As
the terms of the members | 4 | | of the board of trustees expire, they shall be
replaced, from | 5 | | time to time, by election by the health services plan
| 6 | | subscribers who are members of the health services plan | 7 | | corporation. If
the corporation furnishes medical services to | 8 | | the plan's subscribers and
beneficiaries and these services are | 9 | | rendered by physicians licensed in
Illinois to practice | 10 | | medicine in all of its branches, the
board of trustees shall | 11 | | appoint a Medical Director who shall be a
physician licensed in | 12 | | Illinois to practice medicine in all of its
branches. The | 13 | | Medical Director may participate in all deliberations of
the | 14 | | board of trustees but shall not vote in any decisions or
| 15 | | determinations made by the board of trustees. The Medical | 16 | | Director,
under the board of trustees, shall have complete | 17 | | charge of and
responsibility for the medical and medically | 18 | | related scientific aspects
of the business of
the corporation. | 19 | | If the corporation furnishes dental services to the plan's | 20 | | subscribers and beneficiaries and these services are rendered | 21 | | by dentists licensed in Illinois, the board of trustees shall | 22 | | appoint a Dental Director who shall be a dentist licensed in | 23 | | Illinois to practice dentistry.
