SYNOPSIS AS INTRODUCED:
 
20 ILCS 3305/7.3 new

    Amends the Illinois Emergency Management Agency Act. Provides that no occupational or professional license issued by any State agency to a business or person may be revoked or suspended based upon a failure to comply with an executive order related to the COVID-19 Pandemic, unless a court order has been obtained to allow such license revocation or suspension. Provides that no State agency or employee of that State agency may enter on to the premises of a business or person for the purpose of effectuating the revocation or suspension of an occupational or professional license based upon a failure to comply with an executive order related to the COVID-19 Pandemic, unless a court order has been obtained to allow the enforcing State agency to enter on to the premises for such purpose and notice has been provided to the relevant State legislators of the district in which the business or person resides. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Emergency Management Agency Act is
5amended by adding Section 7.3 as follows:
 
6    (20 ILCS 3305/7.3 new)
7    Sec. 7.3. Emergency powers related to the COVID-19
8Pandemic; licensure revocation prohibited.
9    (a) Notwithstanding any provision of law or executive order
10to the contrary, no occupational or professional license issued
11by any State agency to a business or person may be revoked or
12suspended based upon a failure to comply with an executive
13order related to the COVID-19 Pandemic that is issued by the
14Governor under Section 7, unless a court order has been
15obtained to allow such license revocation or suspension on
16grounds independent of failure to comply with the provisions of
17the executive order.
18    (b) Notwithstanding any provision of law or executive order
19to the contrary, no State agency or employee of that State
20agency may enter on to the premises of a business or person for
21the purpose of effectuating the revocation or suspension of an
22occupational or professional license, or related matters,
23based upon a failure to comply with an executive order related

1to the COVID-19 Pandemic that is issued by the Governor under
2Section 7, unless a court order has been obtained to allow the
3enforcing State agency to enter on to the premises for such
4purpose and the relevant State legislators of the district in
5which the business or person resides have been provide with at
6least 30 days notice prior to entrance.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.
