1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Sections 5.891 and 6z-107 as follows:
 
6    (30 ILCS 105/5.891 new)
7    Sec. 5.891. The Cook County Water Infrastructure Fund.
 
8    (30 ILCS 105/6z-107 new)
9    Sec. 6z-107. Water supplies from Lake Michigan.
10    (a) As used in this Section:
11    "Non-supplying municipality in Cook County" means a
12municipality in Cook County that receives its water from
13another municipality and does not sell its water to another
14municipality.
15    "Supplying municipality in Cook County" means a
16municipality in Cook County that either receives water directly
17from Lake Michigan or buys its water from another municipality
18and then sells some of its water to another municipality.
19    (b) The Cook County Water Infrastructure Fund is created as
20a special fund in the State treasury. Subject to appropriation,
21moneys in the Fund shall be used by the Environmental
22Protection Agency to make grants to municipalities to fund

1infrastructure improvements to facilitate water supplies from
2Lake Michigan for residents of Cook County.
3    Notwithstanding any other provision of law, the Cook County
4Water Infrastructure Fund is not subject to sweeps,
5administrative charges or chargebacks, or any other fiscal or
6budgetary maneuver that would in any way transfer any funds
7from the Cook County Water Infrastructure Fund into any other
8fund of the State.
9    (c) In making grants from the Cook County Water
10Infrastructure Fund, the Agency must prioritize water
11infrastructure projects in non-supplying municipalities in
12Cook County over water infrastructure projects in supplying
13municipalities in Cook County.
14    (d) The Environmental Protection Agency may adopt rules
15under the Illinois Administrative Procedure Act to implement
16this Section.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.
