AMENDMENT TO SENATE BILL 764

2    AMENDMENT NO. ______. Amend Senate Bill 764 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Toll Highway Act is amended by changing
5Section 3 as follows:
 
6    (605 ILCS 10/3)  (from Ch. 121, par. 100-3)
7    Sec. 3. There is hereby created an Authority to be known as
8The Illinois State Toll Highway Authority, which is hereby
9constituted an instrumentality and an administrative agency of
10the State of Illinois. The said Authority shall consist of 13
1111 directors; the Governor and the Secretary of the Department
12of Transportation, ex officio, and 11 9 directors appointed by
13the Governor with the advice and consent of the Senate, from
14the State at large, which said directors and their successors
15are hereby authorized to carry out the provisions of this Act,
16and to exercise the powers herein conferred. Of the 11 9

1directors appointed by the Governor, at least one director
2shall be from Cook County, at least one director shall be from
3Lake County, at least one director shall be from DuPage County,
4at least one director shall be from Will County, at least one
5director shall be from Winnebago, Boone, or McHenry County, at
6least one director shall be from Kane, DeKalb, Ogle, or Lee
7County, and no more than 6 5 shall be members of the same
8political party. Within 30 days after the effective date of
9this amendatory Act of the 101st General Assembly, the Governor
10shall appoint one director from Lake County and one director
11from Winnebago, Boone, or McHenry County.
12    Notwithstanding any provision of law to the contrary, the
13term of office of each director of the Authority serving on the
14effective date of this amendatory Act of the 100th General
15Assembly, other than the Governor and the Secretary of the
16Department of Transportation, is abolished and a vacancy in
17each office is created on the effective date of this amendatory
18Act of the 100th General Assembly. The Governor shall appoint
19directors to the Authority for the vacancies created under this
20amendatory Act of the 100th General Assembly by February 28,
212019. Directors whose terms are abolished under this amendatory
22Act of the 100th General Assembly shall be eligible for
23reappointment.
24    Vacancies shall be filled for the unexpired term in the
25same manner as original appointments. All appointments shall be
26in writing and filed with the Secretary of State as a public

1record. It is the intention of this section that the Governor's
2appointments shall be made with due consideration to the
3location of proposed toll highway routes so that maximum
4geographic representation from the areas served by said toll
5highway routes may be accomplished insofar as practicable. The
6said Authority shall have the power to contract and be
7contracted with, to acquire, hold and convey personal and real
8property or any interest therein including rights of way,
9franchises and easements; to have and use a common seal, and to
10alter the same at will; to make and establish resolutions,
11by-laws, rules, rates and regulations, and to alter or repeal
12the same as the Authority shall deem necessary and expedient
13for the construction, operation, relocation, regulation and
14maintenance of a system of toll highways within and through the
15State of Illinois.
16    Appointment of the additional directors provided for by
17this amendatory Act of 1980 shall be made within 30 days after
18the effective date of this amendatory Act of 1980.

20    Section 99. Effective date. This Act takes effect upon
21becoming law.".
