Urbanized Area Formula Funding program; Madison | 11 | | Mass Transit District. | 12 | | (a) As used in this Section: | 13 | | "Agency" means the Bi-State Development Agency. | 14 | | "District" means the Madison Mass Transit District. | 15 | | "Federal formula" means the Urbanized Area Formula Funding |

| 1 | | program under 49 USC 5307. | 2 | | (b) The Agency shall pass through to the District on an | 3 | | annual basis the amount of federal formula assistance equal to | 4 | | 100% of the Alton/Wood River urbanized area formula allocation | 5 | | as capital assistance, on the basis that the District is the | 6 | | exclusive provider of public transit service in the Alton/Wood | 7 | | River urbanized area with total responsibility for capital and | 8 | | operating expenses to deliver such services. The District shall | 9 | | be responsible for any obligations associated with the receipt | 10 | | of these funds as required by the Federal Transit | 11 | | Administration. | 12 | | (c) The Agency shall pass through to the District 100% of | 13 | | that portion of the federal formula funds allocation generated | 14 | | to the St. Louis urbanized area as a result of the District's | 15 | | filing of National Transit Database statistics for passengers | 16 | | miles and revenue miles for those transportation services | 17 | | operated and reported by the District, including motor bus, | 18 | | demand response, and vanpool services, as defined by the | 19 | | Federal Transit Administration. The Agency shall use the | 20 | | Federal Transit Administration Unit Values of Data, published | 21 | | annually in the Federal Register, to calculate this allocation | 22 | | each year. The District shall be responsible for any | 23 | | obligations associated with the receipt of these funds as | 24 | | required by the Federal Transit Administration. | 25 | | (d) The Agency shall retain the federal formula funds | 26 | | allocated by the Federal Transit Administration to the region |

| 1 | | on the basis of Madison County, Illinois population and | 2 | | population density within the St. Louis urbanized area. | 3 | | Additionally, the Agency shall retain those federal formula | 4 | | funds allocated on the basis of regular fixed route and | 5 | | seasonal services operated and reported by the Agency in the | 6 | | St. Louis urbanized area. These revenues shall constitute the | 7 | | total financial commitment and payment in full for: | 8 | | (1) all claims, debts or obligations, rights, | 9 | | liabilities, direct or indirect, made or asserted by the | 10 | | Agency, arising out of any previous service agreements, | 11 | | issues, or relationship between the District and the Agency | 12 | | occurring on or before June 30, 2019; and | 13 | | (2) any capital or operating subsidy for the MetroLink | 14 | | Light Rail System, as currently configured or as may be | 15 | | extended in the future. The Agency shall afford the | 16 | | District's bus passengers and vehicles full access to the | 17 | | MetroLink system without any additional fees or surcharges | 18 | | above and beyond those fares typically charged residents of | 19 | | the St. Clair County, the City of St. Louis, Missouri, or | 20 | | St. Louis County, Missouri, for comparable distance trips, | 21 | | subject to any agreement between the Agency and the | 22 | | District existing on the effective date of this amendatory | 23 | | Act of the 101st General Assembly, until such time | 24 | | MetroLink is extended into Madison County. ".
