| 2 | | AMENDMENT NO. ______. Amend Senate Bill 1423 as follows:

| 1 | | accumulated in any firefighters' pension fund under this | 2 | | Article to the State Employees' Retirement System in accordance | 3 | | with Section 14-110. The creditable service shall be | 4 | | transferred only upon payment by the firefighters' pension fund | 5 | | to the State Employees' Retirement System of an amount equal | 6 | | to: | 7 | | (1) the amounts accumulated to the credit of the | 8 | | applicant for the service to be transferred on file with | 9 | | the fund on the date of transfer; | 10 | | (2) employer contributions in an amount equal to the | 11 | | amount determined under paragraph (1); and | 12 | | (3) any interest paid by the applicant in order to | 13 | | reinstate service to be transferred. | 14 | | Participation in the firefighters' pension fund with | 15 | | respect to the service to be transferred shall terminate on the | 16 | | date of transfer. | 17 | | (b) Any person applying to transfer service under this | 18 | | Section may reinstate service that was terminated by receipt of | 19 | | a refund, by paying to the firefighters' pension fund the | 20 | | amount of the refund with interest thereon at the actuarially | 21 | | assumed rate of interest, compounded annually, from the date of | 22 | | refund to the date of payment.

| 1 | | System who is a State policeman, an investigator for the | 2 | | Secretary of State, a conservation police officer, an | 3 | | investigator for the Office of the Attorney General, an | 4 | | investigator for the Department of Revenue, a Commerce | 5 | | Commission police officer, an
investigator for the Office of | 6 | | the State's Attorneys Appellate Prosecutor,
or a controlled | 7 | | substance inspector
may apply for transfer of some or all of | 8 | | his or her credits and creditable service
accumulated in this | 9 | | Fund for service as a sheriff's law enforcement
employee, | 10 | | person employed by a participating municipality to perform | 11 | | police duties, or law enforcement officer employed on a | 12 | | full-time basis by a forest preserve district to the State | 13 | | Employees' Retirement System in accordance with
Section | 14 | | 14-110. The creditable service shall be transferred only upon | 15 | | payment
by this Fund to the State Employees' Retirement System | 16 | | of an amount equal to:
| 17 | | (1) the amounts accumulated to the credit of the | 18 | | applicant for the service
to be transferred, including | 19 | | interest; and
| 20 | | (2) municipality credits based on such service, | 21 | | including interest; and
| 22 | | (3) any interest paid by the applicant to reinstate | 23 | | such service.
| 24 | | Participation in this Fund as to any credits transferred under | 25 | | this
Section shall terminate on the date of transfer.

creditable service | 2 | | terminated upon receipt of a separation benefit, by paying
to | 3 | | the Fund the amount of the separation benefit plus interest | 4 | | thereon at the actuarially assumed rate of interest
to the date | 5 | | of payment.
