AMENDMENT TO SENATE BILL 1449

2    AMENDMENT NO. ______. Amend Senate Bill 1449 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Insurance Code is amended by
5adding Section 370c.2 as follows:
 
6    (215 ILCS 5/370c.2 new)
7    Sec. 370c.2. Task force on disability income insurance;
8parity for behavioral health conditions.
9    (a) As used in this Section, "behavioral health condition"
10means any mental, emotional, nervous, or substance use disorder
11or condition that falls under any of the diagnostic categories
12listed in the mental and behavioral disorders chapter of the
13current edition of the International Classification of Disease
14or that is listed in the most recent version of the Diagnostic
15and Statistical Manual of Mental Disorders.
16    (b) The Department shall form a task force to review the

1plans and policies for individual and group short-term and
2long-term disability income insurance issued and offered to
3individuals and employers in this State in order to examine the
4use of such insurance for behavioral health conditions. The
5Task Force shall work cooperatively with the insurance
6industry, community organizations, businesses and business
7coalitions, and advocacy groups to reduce the stigma of
8behavioral health conditions. The task force shall be comprised
9of the following members:
10        (1) 2 experts in the disability income insurance
11    industry appointed by the Governor.
12        (2) 2 experts in the behavioral health conditions and
13    treatment industry appointed by the Governor.
14        (3) 2 consumers of disability income insurance who have
15    experienced or are experiencing a behavioral health
16    condition appointed by the Governor.
17        (4) One member of the General Assembly appointed by the
18    Speaker of the House of Representatives.
19        (5) One member of the General Assembly appointed by the
20    President of the Senate.
21        (6) One member of the General Assembly appointed by the
22    Minority Leader of the House of Representatives.
23        (7) One member of the General Assembly appointed by the
24    Minority Leader of the Senate.
25    (c) The task force shall elect a chairperson from its
26membership and shall have the authority to determine its

1meeting schedule, hearing schedule, and agendas.
2    (d) Appointments shall be made 90 days after the effective
3date of this amendatory Act of the 101st General Assembly.
4    (e) Members shall serve without compensation and shall be
5adults and residents of Illinois.
6    (f) The task force shall:
7        (1) review existing plans and policies for individual
8    and group short-term and long-term disability income
9    insurance issued, delivered, and offered in the State;
10        (2) compare consumer use of short-term and long-term
11    disability income insurance coverage for behavioral health
12    conditions with use of such insurance for physical
13    conditions;
14        (3) review reports of current costs incurred from
15    individual and group short-term and long-term disability
16    income insurance to cover behavioral health conditions at
17    parity with physical conditions; and
18        (4) provide recommendations on the use of individual
19    and group short-term and long-term disability income
20    insurance to cover behavioral health conditions.
21    (g) Any of the findings, recommendations, and other
22information determined by the task force to be relevant shall
23be made available on the Department's website.
24    (h) The task force shall submit findings and
25recommendations to the Governor and the General Assembly by
26December 31, 2020.

1    (i) The task force is dissolved and this Section is
2repealed on December 31, 2021.
 
3    Section 99. Effective date. This Act takes effect upon
4becoming law.".
