SYNOPSIS AS INTRODUCED:

215 ILCS 5/Art. XXXIIB heading new
215 ILCS 5/521.1 new
    Amends the Illinois Insurance Code. Creates the Pharmacy Benefits Managers Article. Provides that a pharmacy benefits manager may not prohibit a pharmacy or pharmacist from providing a customer with a more affordable alternative if a more affordable alternative is available.

1     AN ACT concerning regulation.

2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:

4     Section 5. The Illinois Insurance Code is amended by adding
5 Article XXXIIB as follows:

6     (215 ILCS 5/Art. XXXIIB heading new)
7 ARTICLE XXXIIB. PHARMACY BENEFITS MANAGERS

8     (215 ILCS 5/521.1 new)
9     Sec. 521.1. Pharmacy benefits managers.
10     (a) As used in this Section, "pharmacy benefits manager"
11 means an entity that administers or manages a pharmacy benefits
12 plan or program.
13     (b) A pharmacy benefits manager may not prohibit a pharmacy
14 or pharmacist from providing a customer with a more affordable
15 alternative if a more affordable alternative is available.
