AMENDMENT TO SENATE BILL 1831

2    AMENDMENT NO. ______. Amend Senate Bill 1831 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Liquor Control Act of 1934 is amended by
5changing Sections 5-1, 6-6, 6-6.5, 8-1, and 8-5 and by adding
6Sections 6-5.5 and 6-6.6 as follows:

19    No person, firm, partnership, corporation, or other legal
20business entity that is engaged in the manufacturing of wine
21may concurrently obtain and hold a wine-maker's license and a
22wine manufacturer's license.
23    (a) A manufacturer's license shall allow the manufacture,
24importation in bulk, storage, distribution and sale of
25alcoholic liquor to persons without the State, as may be
26permitted by law and to licensees in this State as follows:

1    Class 1. A Distiller may make sales and deliveries of
2alcoholic liquor to distillers, rectifiers, importing
3distributors, distributors and non-beverage users and to no
4other licensees.
5    Class 2. A Rectifier, who is not a distiller, as defined
6herein, may make sales and deliveries of alcoholic liquor to
7rectifiers, importing distributors, distributors, retailers
8and non-beverage users and to no other licensees.
9    Class 3. A Brewer may make sales and deliveries of beer to
10importing distributors and distributors and may make sales as
11authorized under subsection (e) of Section 6-4 of this Act.
12    Class 4. A first class wine-manufacturer may make sales and
13deliveries of up to 50,000 gallons of wine to manufacturers,
14importing distributors and distributors, and to no other
15licensees.
16    Class 5. A second class Wine manufacturer may make sales
17and deliveries of more than 50,000 gallons of wine to
18manufacturers, importing distributors and distributors and to
19no other licensees.
20    Class 6. A first-class wine-maker's license shall allow the
21manufacture of up to 50,000 gallons of wine per year, and the
22storage and sale of such wine to distributors in the State and
23to persons without the State, as may be permitted by law. A
24person who, prior to June 1, 2008 (the effective date of Public
25Act 95-634), is a holder of a first-class wine-maker's license
26and annually produces more than 25,000 gallons of its own wine

1and who distributes its wine to licensed retailers shall cease
2this practice on or before July 1, 2008 in compliance with
3Public Act 95-634.
4    Class 7. A second-class wine-maker's license shall allow
5the manufacture of between 50,000 and 150,000 gallons of wine
6per year, and the storage and sale of such wine to distributors
7in this State and to persons without the State, as may be
8permitted by law. A person who, prior to June 1, 2008 (the
9effective date of Public Act 95-634), is a holder of a
10second-class wine-maker's license and annually produces more
11than 25,000 gallons of its own wine and who distributes its
12wine to licensed retailers shall cease this practice on or
13before July 1, 2008 in compliance with Public Act 95-634.
14    Class 8. A limited wine-manufacturer may make sales and
15deliveries not to exceed 40,000 gallons of wine per year to
16distributors, and to non-licensees in accordance with the
17provisions of this Act.
18    Class 9. A craft distiller license shall allow the
19manufacture of up to 100,000 gallons of spirits by distillation
20per year and the storage of such spirits. If a craft distiller
21licensee, including a craft distiller licensee who holds more
22than one craft distiller license, is not affiliated with any
23other manufacturer of spirits, then the craft distiller
24licensee may sell such spirits to distributors in this State
25and up to 2,500 gallons of such spirits to non-licensees to the
26extent permitted by any exemption approved by the Commission

1pursuant to Section 6-4 of this Act. A craft distiller license
2holder may store such spirits at a non-contiguous licensed
3location, but at no time shall a craft distiller license holder
4directly or indirectly produce in the aggregate more than
5100,000 gallons of spirits per year.
6    A craft distiller licensee may hold more than one craft
7distiller's license. However, a craft distiller that holds more
8than one craft distiller license shall not manufacture, in the
9aggregate, more than 100,000 gallons of spirits by distillation
10per year and shall not sell, in the aggregate, more than 2,500
11gallons of such spirits to non-licensees in accordance with an
12exemption approved by the State Commission pursuant to Section
136-4 of this Act.
14    Any craft distiller licensed under this Act who on July 28,
152010 (the effective date of Public Act 96-1367) was licensed as
16a distiller and manufactured no more spirits than permitted by
17this Section shall not be required to pay the initial licensing
18fee.
19    Class 10. A class 1 brewer license, which may only be
20issued to a licensed brewer or licensed non-resident dealer,
21shall allow the manufacture of up to 930,000 gallons of beer
22per year provided that the class 1 brewer licensee does not
23manufacture more than a combined 930,000 gallons of beer per
24year and is not a member of or affiliated with, directly or
25indirectly, a manufacturer that produces more than 930,000
26gallons of beer per year or any other alcoholic liquor. A class

11 brewer licensee may make sales and deliveries to importing
2distributors and distributors and to retail licensees in
3accordance with the conditions set forth in paragraph (18) of
4subsection (a) of Section 3-12 of this Act. If the State
5Commission provides prior approval, a class 1 brewer may
6annually transfer up to 930,000 gallons of beer manufactured by
7that class 1 brewer to the premises of a licensed class 1
8brewer wholly owned and operated by the same licensee.
9    Class 11. A class 2 brewer license, which may only be
10issued to a licensed brewer or licensed non-resident dealer,
11shall allow the manufacture of up to 3,720,000 gallons of beer
12per year provided that the class 2 brewer licensee does not
13manufacture more than a combined 3,720,000 gallons of beer per
14year and is not a member of or affiliated with, directly or
15indirectly, a manufacturer that produces more than 3,720,000
16gallons of beer per year or any other alcoholic liquor. A class
172 brewer licensee may make sales and deliveries to importing
18distributors and distributors, but shall not make sales or
19deliveries to any other licensee. If the State Commission
20provides prior approval, a class 2 brewer licensee may annually
21transfer up to 3,720,000 gallons of beer manufactured by that
22class 2 brewer licensee to the premises of a licensed class 2
23brewer wholly owned and operated by the same licensee.
24    A class 2 brewer may transfer beer to a brew pub wholly
25owned and operated by the class 2 brewer subject to the
26following limitations and restrictions: (i) the transfer shall

1not annually exceed more than 31,000 gallons; (ii) the annual
2amount transferred shall reduce the brew pub's annual permitted
3production limit; (iii) all beer transferred shall be subject
4to Article VIII of this Act; (iv) a written record shall be
5maintained by the brewer and brew pub specifying the amount,
6date of delivery, and receipt of the product by the brew pub;
7and (v) the brew pub shall be located no farther than 80 miles
8from the class 2 brewer's licensed location.
9    A class 2 brewer shall, prior to transferring beer to a
10brew pub wholly owned by the class 2 brewer, furnish a written
11notice to the State Commission of intent to transfer beer
12setting forth the name and address of the brew pub and shall
13annually submit to the State Commission a verified report
14identifying the total gallons of beer transferred to the brew
15pub wholly owned by the class 2 brewer.
16    (a-1) A manufacturer which is licensed in this State to
17make sales or deliveries of alcoholic liquor to licensed
18distributors or importing distributors and which enlists
19agents, representatives, or individuals acting on its behalf
20who contact licensed retailers on a regular and continual basis
21in this State must register those agents, representatives, or
22persons acting on its behalf with the State Commission.
23    Registration of agents, representatives, or persons acting
24on behalf of a manufacturer is fulfilled by submitting a form
25to the Commission. The form shall be developed by the
26Commission and shall include the name and address of the

1applicant, the name and address of the manufacturer he or she
2represents, the territory or areas assigned to sell to or
3discuss pricing terms of alcoholic liquor, and any other
4questions deemed appropriate and necessary. All statements in
5the forms required to be made by law or by rule shall be deemed
6material, and any person who knowingly misstates any material
7fact under oath in an application is guilty of a Class B
8misdemeanor. Fraud, misrepresentation, false statements,
9misleading statements, evasions, or suppression of material
10facts in the securing of a registration are grounds for
11suspension or revocation of the registration. The State
12Commission shall post a list of registered agents on the
13Commission's website.
14    (b) A distributor's license shall allow the wholesale
15purchase and storage of alcoholic liquors and sale of alcoholic
16liquors to licensees in this State and to persons without the
17State, as may be permitted by law, and the sale of beer, cider,
18or both beer and cider to brewers, class 1 brewers, and class 2
19brewers that, pursuant to subsection (e) of Section 6-4 of this
20Act, sell beer, cider, or both beer and cider to non-licensees
21at their breweries. No person licensed as a distributor shall
22be granted a non-resident dealer's license.
23    (c) An importing distributor's license may be issued to and
24held by those only who are duly licensed distributors, upon the
25filing of an application by a duly licensed distributor, with
26the Commission and the Commission shall, without the payment of

1any fee, immediately issue such importing distributor's
2license to the applicant, which shall allow the importation of
3alcoholic liquor by the licensee into this State from any point
4in the United States outside this State, and the purchase of
5alcoholic liquor in barrels, casks or other bulk containers and
6the bottling of such alcoholic liquors before resale thereof,
7but all bottles or containers so filled shall be sealed,
8labeled, stamped and otherwise made to comply with all
9provisions, rules and regulations governing manufacturers in
10the preparation and bottling of alcoholic liquors. The
11importing distributor's license shall permit such licensee to
12purchase alcoholic liquor from Illinois licensed non-resident
13dealers and foreign importers only. No person licensed as an
14importing distributor shall be granted a non-resident dealer's
15license.
16    (d) A retailer's license shall allow the licensee to sell
17and offer for sale at retail, only in the premises specified in
18the license, alcoholic liquor for use or consumption, but not
19for resale in any form. Nothing in Public Act 95-634 shall
20deny, limit, remove, or restrict the ability of a holder of a
21retailer's license to transfer, deliver, or ship alcoholic
22liquor to the purchaser for use or consumption subject to any
23applicable local law or ordinance. Any retail license issued to
24a manufacturer shall only permit the manufacturer to sell beer
25at retail on the premises actually occupied by the
26manufacturer. For the purpose of further describing the type of

1business conducted at a retail licensed premises, a retailer's
2licensee may be designated by the State Commission as (i) an on
3premise consumption retailer, (ii) an off premise sale
4retailer, or (iii) a combined on premise consumption and off
5premise sale retailer.
6    Notwithstanding any other provision of this subsection
7(d), a retail licensee may sell alcoholic liquors to a special
8event retailer licensee for resale to the extent permitted
9under subsection (e).
10    (e) A special event retailer's license (not-for-profit)
11shall permit the licensee to purchase alcoholic liquors from an
12Illinois licensed distributor (unless the licensee purchases
13less than $500 of alcoholic liquors for the special event, in
14which case the licensee may purchase the alcoholic liquors from
15a licensed retailer) and shall allow the licensee to sell and
16offer for sale, at retail, alcoholic liquors for use or
17consumption, but not for resale in any form and only at the
18location and on the specific dates designated for the special
19event in the license. An applicant for a special event retailer
20license must (i) furnish with the application: (A) a resale
21number issued under Section 2c of the Retailers' Occupation Tax
22Act or evidence that the applicant is registered under Section
232a of the Retailers' Occupation Tax Act, (B) a current, valid
24exemption identification number issued under Section 1g of the
25Retailers' Occupation Tax Act, and a certification to the
26Commission that the purchase of alcoholic liquors will be a

1tax-exempt purchase, or (C) a statement that the applicant is
2not registered under Section 2a of the Retailers' Occupation
3Tax Act, does not hold a resale number under Section 2c of the
4Retailers' Occupation Tax Act, and does not hold an exemption
5number under Section 1g of the Retailers' Occupation Tax Act,
6in which event the Commission shall set forth on the special
7event retailer's license a statement to that effect; (ii)
8submit with the application proof satisfactory to the State
9Commission that the applicant will provide dram shop liability
10insurance in the maximum limits; and (iii) show proof
11satisfactory to the State Commission that the applicant has
12obtained local authority approval.
13    Nothing in this Act prohibits an Illinois licensed
14distributor from offering credit or a refund for unused,
15salable alcoholic liquors to a holder of a special event
16retailer's license or from the special event retailer's
17licensee from accepting the credit or refund of alcoholic
18liquors at the conclusion of the event specified in the
19license.
20    (f) A railroad license shall permit the licensee to import
21alcoholic liquors into this State from any point in the United
22States outside this State and to store such alcoholic liquors
23in this State; to make wholesale purchases of alcoholic liquors
24directly from manufacturers, foreign importers, distributors
25and importing distributors from within or outside this State;
26and to store such alcoholic liquors in this State; provided

1that the above powers may be exercised only in connection with
2the importation, purchase or storage of alcoholic liquors to be
3sold or dispensed on a club, buffet, lounge or dining car
4operated on an electric, gas or steam railway in this State;
5and provided further, that railroad licensees exercising the
6above powers shall be subject to all provisions of Article VIII
7of this Act as applied to importing distributors. A railroad
8license shall also permit the licensee to sell or dispense
9alcoholic liquors on any club, buffet, lounge or dining car
10operated on an electric, gas or steam railway regularly
11operated by a common carrier in this State, but shall not
12permit the sale for resale of any alcoholic liquors to any
13licensee within this State. A license shall be obtained for
14each car in which such sales are made.
15    (g) A boat license shall allow the sale of alcoholic liquor
16in individual drinks, on any passenger boat regularly operated
17as a common carrier on navigable waters in this State or on any
18riverboat operated under the Riverboat Gambling Act, which boat
19or riverboat maintains a public dining room or restaurant
20thereon.
21    (h) A non-beverage user's license shall allow the licensee
22to purchase alcoholic liquor from a licensed manufacturer or
23importing distributor, without the imposition of any tax upon
24the business of such licensed manufacturer or importing
25distributor as to such alcoholic liquor to be used by such
26licensee solely for the non-beverage purposes set forth in

1subsection (a) of Section 8-1 of this Act, and such licenses
2shall be divided and classified and shall permit the purchase,
3possession and use of limited and stated quantities of
4alcoholic liquor as follows:
5Class 1, not to exceed ......................... 500 gallons
6Class 2, not to exceed ....................... 1,000 gallons
7Class 3, not to exceed ....................... 5,000 gallons
8Class 4, not to exceed ...................... 10,000 gallons
9Class 5, not to exceed ....................... 50,000 gallons
10    (i) A wine-maker's premises license shall allow a licensee
11that concurrently holds a first-class wine-maker's license to
12sell and offer for sale at retail in the premises specified in
13such license not more than 50,000 gallons of the first-class
14wine-maker's wine that is made at the first-class wine-maker's
15licensed premises per year for use or consumption, but not for
16resale in any form. A wine-maker's premises license shall allow
17a licensee who concurrently holds a second-class wine-maker's
18license to sell and offer for sale at retail in the premises
19specified in such license up to 100,000 gallons of the
20second-class wine-maker's wine that is made at the second-class
21wine-maker's licensed premises per year for use or consumption
22but not for resale in any form. A wine-maker's premises license
23shall allow a licensee that concurrently holds a first-class
24wine-maker's license or a second-class wine-maker's license to
25sell and offer for sale at retail at the premises specified in
26the wine-maker's premises license, for use or consumption but

1not for resale in any form, any beer, wine, and spirits
2purchased from a licensed distributor. Upon approval from the
3State Commission, a wine-maker's premises license shall allow
4the licensee to sell and offer for sale at (i) the wine-maker's
5licensed premises and (ii) at up to 2 additional locations for
6use and consumption and not for resale. Each location shall
7require additional licensing per location as specified in
8Section 5-3 of this Act. A wine-maker's premises licensee shall
9secure liquor liability insurance coverage in an amount at
10least equal to the maximum liability amounts set forth in
11subsection (a) of Section 6-21 of this Act.
12    (j) An airplane license shall permit the licensee to import
13alcoholic liquors into this State from any point in the United
14States outside this State and to store such alcoholic liquors
15in this State; to make wholesale purchases of alcoholic liquors
16directly from manufacturers, foreign importers, distributors
17and importing distributors from within or outside this State;
18and to store such alcoholic liquors in this State; provided
19that the above powers may be exercised only in connection with
20the importation, purchase or storage of alcoholic liquors to be
21sold or dispensed on an airplane; and provided further, that
22airplane licensees exercising the above powers shall be subject
23to all provisions of Article VIII of this Act as applied to
24importing distributors. An airplane licensee shall also permit
25the sale or dispensing of alcoholic liquors on any passenger
26airplane regularly operated by a common carrier in this State,

1but shall not permit the sale for resale of any alcoholic
2liquors to any licensee within this State. A single airplane
3license shall be required of an airline company if liquor
4service is provided on board aircraft in this State. The annual
5fee for such license shall be as determined in Section 5-3.
6    (k) A foreign importer's license shall permit such licensee
7to purchase alcoholic liquor from Illinois licensed
8non-resident dealers only, and to import alcoholic liquor other
9than in bulk from any point outside the United States and to
10sell such alcoholic liquor to Illinois licensed importing
11distributors and to no one else in Illinois; provided that (i)
12the foreign importer registers with the State Commission every
13brand of alcoholic liquor that it proposes to sell to Illinois
14licensees during the license period, (ii) the foreign importer
15complies with all of the provisions of Section 6-9 of this Act
16with respect to registration of such Illinois licensees as may
17be granted the right to sell such brands at wholesale, and
18(iii) the foreign importer complies with the provisions of
19Sections 6-5 and 6-6 of this Act to the same extent that these
20provisions apply to manufacturers.
21    (l) (i) A broker's license shall be required of all persons
22who solicit orders for, offer to sell or offer to supply
23alcoholic liquor to retailers in the State of Illinois, or who
24offer to retailers to ship or cause to be shipped or to make
25contact with distillers, rectifiers, brewers or manufacturers
26or any other party within or without the State of Illinois in

1order that alcoholic liquors be shipped to a distributor,
2importing distributor or foreign importer, whether such
3solicitation or offer is consummated within or without the
4State of Illinois.
5    No holder of a retailer's license issued by the Illinois
6Liquor Control Commission shall purchase or receive any
7alcoholic liquor, the order for which was solicited or offered
8for sale to such retailer by a broker unless the broker is the
9holder of a valid broker's license.
10    The broker shall, upon the acceptance by a retailer of the
11broker's solicitation of an order or offer to sell or supply or
12deliver or have delivered alcoholic liquors, promptly forward
13to the Illinois Liquor Control Commission a notification of
14said transaction in such form as the Commission may by
15regulations prescribe.
16    (ii) A broker's license shall be required of a person
17within this State, other than a retail licensee, who, for a fee
18or commission, promotes, solicits, or accepts orders for
19alcoholic liquor, for use or consumption and not for resale, to
20be shipped from this State and delivered to residents outside
21of this State by an express company, common carrier, or
22contract carrier. This Section does not apply to any person who
23promotes, solicits, or accepts orders for wine as specifically
24authorized in Section 6-29 of this Act.
25    A broker's license under this subsection (l) shall not
26entitle the holder to buy or sell any alcoholic liquors for his

1own account or to take or deliver title to such alcoholic
2liquors.
3    This subsection (l) shall not apply to distributors,
4employees of distributors, or employees of a manufacturer who
5has registered the trademark, brand or name of the alcoholic
6liquor pursuant to Section 6-9 of this Act, and who regularly
7sells such alcoholic liquor in the State of Illinois only to
8its registrants thereunder.
9    Any agent, representative, or person subject to
10registration pursuant to subsection (a-1) of this Section shall
11not be eligible to receive a broker's license.
12    (m) A non-resident dealer's license shall permit such
13licensee to ship into and warehouse alcoholic liquor into this
14State from any point outside of this State, and to sell such
15alcoholic liquor to Illinois licensed foreign importers and
16importing distributors and to no one else in this State;
17provided that (i) said non-resident dealer shall register with
18the Illinois Liquor Control Commission each and every brand of
19alcoholic liquor which it proposes to sell to Illinois
20licensees during the license period, (ii) it shall comply with
21all of the provisions of Section 6-9 hereof with respect to
22registration of such Illinois licensees as may be granted the
23right to sell such brands at wholesale by duly filing such
24registration statement, thereby authorizing the non-resident
25dealer to proceed to sell such brands at wholesale, and (iii)
26the non-resident dealer shall comply with the provisions of

1Sections 6-5 and 6-6 of this Act to the same extent that these
2provisions apply to manufacturers. No person licensed as a
3non-resident dealer shall be granted a distributor's or
4importing distributor's license.
5    (n) A brew pub license shall allow the licensee to only (i)
6manufacture up to 155,000 gallons of beer per year only on the
7premises specified in the license, (ii) make sales of the beer
8manufactured on the premises or, with the approval of the
9Commission, beer manufactured on another brew pub licensed
10premises that is wholly owned and operated by the same licensee
11to importing distributors, distributors, and to non-licensees
12for use and consumption, (iii) store the beer upon the
13premises, (iv) sell and offer for sale at retail from the
14licensed premises for off-premises consumption no more than
15155,000 gallons per year so long as such sales are only made
16in-person, (v) sell and offer for sale at retail for use and
17consumption on the premises specified in the license any form
18of alcoholic liquor purchased from a licensed distributor or
19importing distributor, and (vi) with the prior approval of the
20Commission, annually transfer no more than 155,000 gallons of
21beer manufactured on the premises to a licensed brew pub wholly
22owned and operated by the same licensee.
23    A brew pub licensee shall not under any circumstance sell
24or offer for sale beer manufactured by the brew pub licensee to
25retail licensees.
26    A person who holds a class 2 brewer license may

1simultaneously hold a brew pub license if the class 2 brewer
2(i) does not, under any circumstance, sell or offer for sale
3beer manufactured by the class 2 brewer to retail licensees;
4(ii) does not hold more than 3 brew pub licenses in this State;
5(iii) does not manufacture more than a combined 3,720,000
6gallons of beer per year, including the beer manufactured at
7the brew pub; and (iv) is not a member of or affiliated with,
8directly or indirectly, a manufacturer that produces more than
93,720,000 gallons of beer per year or any other alcoholic
10liquor.
11    Notwithstanding any other provision of this Act, a licensed
12brewer, class 2 brewer, or non-resident dealer who before July
131, 2015 manufactured less than 3,720,000 gallons of beer per
14year and held a brew pub license on or before July 1, 2015 may
15(i) continue to qualify for and hold that brew pub license for
16the licensed premises and (ii) manufacture more than 3,720,000
17gallons of beer per year and continue to qualify for and hold
18that brew pub license if that brewer, class 2 brewer, or
19non-resident dealer does not simultaneously hold a class 1
20brewer license and is not a member of or affiliated with,
21directly or indirectly, a manufacturer that produces more than
223,720,000 gallons of beer per year or that produces any other
23alcoholic liquor.
24    (o) A caterer retailer license shall allow the holder to
25serve alcoholic liquors as an incidental part of a food service
26that serves prepared meals which excludes the serving of snacks

1as the primary meal, either on or off-site whether licensed or
2unlicensed. A caterer retailer license shall allow the holder,
3a distributor, or an importing distributor to transfer any
4inventory to and from the holder's retail premises and shall
5allow the holder to purchase alcoholic liquor from a
6distributor or importing distributor to be delivered directly
7to an off-site event.
8    Nothing in this Act prohibits a distributor or importing
9distributor from offering credit or a refund for unused,
10salable beer to a holder of a caterer retailer license or a
11caterer retailer licensee from accepting a credit or refund for
12unused, salable beer, in the event an act of God is the sole
13reason an off-site event is cancelled and if: (i) the holder of
14a caterer retailer license has not transferred alcoholic liquor
15from its caterer retailer premises to an off-site location;
16(ii) the distributor or importing distributor offers the credit
17or refund for the unused, salable beer that it delivered to the
18off-site premises and not for any unused, salable beer that the
19distributor or importing distributor delivered to the caterer
20retailer's premises; and (iii) the unused, salable beer would
21likely spoil if transferred to the caterer retailer's premises.
22A caterer retailer license shall allow the holder to transfer
23any inventory from any off-site location to its caterer
24retailer premises at the conclusion of an off-site event or
25engage a distributor or importing distributor to transfer any
26inventory from any off-site location to its caterer retailer

1premises at the conclusion of an off-site event, provided that
2the distributor or importing distributor issues bona fide
3charges to the caterer retailer licensee for fuel, labor, and
4delivery and the distributor or importing distributor collects
5payment from the caterer retailer licensee prior to the
6distributor or importing distributor transferring inventory to
7the caterer retailer premises.
8    For purposes of this subsection (o), an "act of God" means
9an unforeseeable event, such as a rain or snow storm, hail, a
10flood, or a similar event, that is the sole cause of the
11cancellation of an off-site, outdoor event.
12    (p) An auction liquor license shall allow the licensee to
13sell and offer for sale at auction wine and spirits for use or
14consumption, or for resale by an Illinois liquor licensee in
15accordance with provisions of this Act. An auction liquor
16license will be issued to a person and it will permit the
17auction liquor licensee to hold the auction anywhere in the
18State. An auction liquor license must be obtained for each
19auction at least 14 days in advance of the auction date.
20    (q) A special use permit license shall allow an Illinois
21licensed retailer to transfer a portion of its alcoholic liquor
22inventory from its retail licensed premises to the premises
23specified in the license hereby created; to purchase alcoholic
24liquor from a distributor or importing distributor to be
25delivered directly to the location specified in the license
26hereby created; , and to sell or offer for sale at retail, only

1in the premises specified in the license hereby created, the
2transferred or delivered alcoholic liquor for use or
3consumption, but not for resale in any form. A special use
4permit license may be granted for the following time periods:
5one day or less; 2 or more days to a maximum of 15 days per
6location in any 12-month period. An applicant for the special
7use permit license must also submit with the application proof
8satisfactory to the State Commission that the applicant will
9provide dram shop liability insurance to the maximum limits and
10have local authority approval.
11    A special use permit license shall allow the holder to
12transfer any inventory from the holder's special use premises
13to its retail premises at the conclusion of the special use
14event or engage a distributor or importing distributor to
15transfer any inventory from the holder's special use premises
16to its retail premises at the conclusion of an off-site event,
17provided that the distributor or importing distributor issues
18bona fide charges to the special use permit licensee for fuel,
19labor, and delivery and the distributor or importing
20distributor collects payment from the retail licensee prior to
21the distributor or importing distributor transferring
22inventory to the retail premises.
23    Nothing in this Act prohibits a distributor or importing
24distributor from offering credit or a refund for unused,
25salable beer to a special use permit licensee or a special use
26permit licensee from accepting a credit or refund for unused,

1salable beer at the conclusion of the event specified in the
2license if: (i) the holder of the special use permit license
3has not transferred alcoholic liquor from its retail licensed
4premises to the premises specified in the special use permit
5license; (ii) the distributor or importing distributor offers
6the credit or refund for the unused, salable beer that it
7delivered to the premises specified in the special use permit
8license and not for any unused, salable beer that the
9distributor or importing distributor delivered to the
10retailer's premises; and (iii) the unused, salable beer would
11likely spoil if transferred to the retailer premises.
12    (r) A winery shipper's license shall allow a person with a
13first-class or second-class wine manufacturer's license, a
14first-class or second-class wine-maker's license, or a limited
15wine manufacturer's license or who is licensed to make wine
16under the laws of another state to ship wine made by that
17licensee directly to a resident of this State who is 21 years
18of age or older for that resident's personal use and not for
19resale. Prior to receiving a winery shipper's license, an
20applicant for the license must provide the Commission with a
21true copy of its current license in any state in which it is
22licensed as a manufacturer of wine. An applicant for a winery
23shipper's license must also complete an application form that
24provides any other information the Commission deems necessary.
25The application form shall include all addresses from which the
26applicant for a winery shipper's license intends to ship wine,

1including the name and address of any third party, except for a
2common carrier, authorized to ship wine on behalf of the
3manufacturer. The application form shall include an
4acknowledgement consenting to the jurisdiction of the
5Commission, the Illinois Department of Revenue, and the courts
6of this State concerning the enforcement of this Act and any
7related laws, rules, and regulations, including authorizing
8the Department of Revenue and the Commission to conduct audits
9for the purpose of ensuring compliance with Public Act 95-634,
10and an acknowledgement that the wine manufacturer is in
11compliance with Section 6-2 of this Act. Any third party,
12except for a common carrier, authorized to ship wine on behalf
13of a first-class or second-class wine manufacturer's licensee,
14a first-class or second-class wine-maker's licensee, a limited
15wine manufacturer's licensee, or a person who is licensed to
16make wine under the laws of another state shall also be
17disclosed by the winery shipper's licensee, and a copy of the
18written appointment of the third-party wine provider, except
19for a common carrier, to the wine manufacturer shall be filed
20with the State Commission as a supplement to the winery
21shipper's license application or any renewal thereof. The
22winery shipper's license holder shall affirm under penalty of
23perjury, as part of the winery shipper's license application or
24renewal, that he or she only ships wine, either directly or
25indirectly through a third-party provider, from the licensee's
26own production.

1    Except for a common carrier, a third-party provider
2shipping wine on behalf of a winery shipper's license holder is
3the agent of the winery shipper's license holder and, as such,
4a winery shipper's license holder is responsible for the acts
5and omissions of the third-party provider acting on behalf of
6the license holder. A third-party provider, except for a common
7carrier, that engages in shipping wine into Illinois on behalf
8of a winery shipper's license holder shall consent to the
9jurisdiction of the State Commission and the State. Any
10third-party, except for a common carrier, holding such an
11appointment shall, by February 1 of each calendar year and upon
12request by the State Commission or the Department of Revenue,
13file with the State Commission a statement detailing each
14shipment made to an Illinois resident. The statement shall
15include the name and address of the third-party provider filing
16the statement, the time period covered by the statement, and
17the following information:
18        (1) the name, address, and license number of the winery
19    shipper on whose behalf the shipment was made;
20        (2) the quantity of the products delivered; and
21        (3) the date and address of the shipment.
22If the Department of Revenue or the State Commission requests a
23statement under this paragraph, the third-party provider must
24provide that statement no later than 30 days after the request
25is made. Any books, records, supporting papers, and documents
26containing information and data relating to a statement under

1this paragraph shall be kept and preserved for a period of 3
2years, unless their destruction sooner is authorized, in
3writing, by the Director of Revenue, and shall be open and
4available to inspection by the Director of Revenue or the State
5Commission or any duly authorized officer, agent, or employee
6of the State Commission or the Department of Revenue, at all
7times during business hours of the day. Any person who violates
8any provision of this paragraph or any rule of the State
9Commission for the administration and enforcement of the
10provisions of this paragraph is guilty of a Class C
11misdemeanor. In case of a continuing violation, each day's
12continuance thereof shall be a separate and distinct offense.
13    The State Commission shall adopt rules as soon as
14practicable to implement the requirements of Public Act 99-904
15and shall adopt rules prohibiting any such third-party
16appointment of a third-party provider, except for a common
17carrier, that has been deemed by the State Commission to have
18violated the provisions of this Act with regard to any winery
19shipper licensee.
20    A winery shipper licensee must pay to the Department of
21Revenue the State liquor gallonage tax under Section 8-1 for
22all wine that is sold by the licensee and shipped to a person
23in this State. For the purposes of Section 8-1, a winery
24shipper licensee shall be taxed in the same manner as a
25manufacturer of wine. A licensee who is not otherwise required
26to register under the Retailers' Occupation Tax Act must

1register under the Use Tax Act to collect and remit use tax to
2the Department of Revenue for all gallons of wine that are sold
3by the licensee and shipped to persons in this State. If a
4licensee fails to remit the tax imposed under this Act in
5accordance with the provisions of Article VIII of this Act, the
6winery shipper's license shall be revoked in accordance with
7the provisions of Article VII of this Act. If a licensee fails
8to properly register and remit tax under the Use Tax Act or the
9Retailers' Occupation Tax Act for all wine that is sold by the
10winery shipper and shipped to persons in this State, the winery
11shipper's license shall be revoked in accordance with the
12provisions of Article VII of this Act.
13    A winery shipper licensee must collect, maintain, and
14submit to the Commission on a semi-annual basis the total
15number of cases per resident of wine shipped to residents of
16this State. A winery shipper licensed under this subsection (r)
17must comply with the requirements of Section 6-29 of this Act.
18    Pursuant to paragraph (5.1) or (5.3) of subsection (a) of
19Section 3-12, the State Commission may receive, respond to, and
20investigate any complaint and impose any of the remedies
21specified in paragraph (1) of subsection (a) of Section 3-12.
22    As used in this subsection, "third-party provider" means
23any entity that provides fulfillment house services, including
24warehousing, packaging, distribution, order processing, or
25shipment of wine, but not the sale of wine, on behalf of a
26licensed winery shipper.

1    (s) A craft distiller tasting permit license shall allow an
2Illinois licensed craft distiller to transfer a portion of its
3alcoholic liquor inventory from its craft distiller licensed
4premises to the premises specified in the license hereby
5created and to conduct a sampling, only in the premises
6specified in the license hereby created, of the transferred
7alcoholic liquor in accordance with subsection (c) of Section
86-31 of this Act. The transferred alcoholic liquor may not be
9sold or resold in any form. An applicant for the craft
10distiller tasting permit license must also submit with the
11application proof satisfactory to the State Commission that the
12applicant will provide dram shop liability insurance to the
13maximum limits and have local authority approval.
14    A brewer warehouse permit may be issued to the holder of a
15class 1 brewer license or a class 2 brewer license. If the
16holder of the permit is a class 1 brewer licensee, the brewer
17warehouse permit shall allow the holder to store or warehouse
18up to 930,000 gallons of tax-determined beer manufactured by
19the holder of the permit at the premises specified on the
20permit. If the holder of the permit is a class 2 brewer
21licensee, the brewer warehouse permit shall allow the holder to
22store or warehouse up to 3,720,000 gallons of tax-determined
23beer manufactured by the holder of the permit at the premises
24specified on the permit. Sales to non-licensees are prohibited
25at the premises specified in the brewer warehouse permit.

6    Sec. 6-5.5. Consignment sales prohibited; retailer
7returns.
8    (a) In this Section, "retailer" means a retailer, special
9event retailer, special use permit licensee, caterer retailer,
10or brew pub.
11    (b) It is unlawful for a manufacturer with
12self-distribution privileges, importing distributor, or
13distributor to sell, offer for sale, or contract to sell to any
14retailer, or for any such retailer to purchase, offer to
15purchase, or contract to purchase any products:
16        (1) on consignment or conditional sale, pursuant to
17    which the retailer has no obligation to pay for the product
18    until sold;
19        (2) with the privilege of return unless expressly
20    authorized in this Act;
21        (3) on any basis other than a bona fide sale; or
22        (4) if any part of the sale involves, directly or
23    indirectly, the acquisition by the retailer of other
24    products from a manufacturer with self-distribution
25    privileges, importing distributor, or distributor, or an

1    agreement to acquire other products from the manufacturer
2    with self-distribution privileges, importing distributor,
3    or distributor.
4    (c) Transactions involving the bona fide return of products
5for ordinary and usual commercial reasons arising after the
6product has been sold are not prohibited.
7    (d) Unless there is a bona fide business reason for
8replacement of an alcoholic liquor product when delivered, the
9alcoholic liquor product may not be replaced free of charge to
10a retailer. Replacement of an alcoholic liquor product damaged
11while in a retailer's possession constitutes the providing of
12something of value and is a violation of Sections 6-4, 6-5, and
136-6 of this Act. A manufacturer with self-distribution
14privileges, importing distributor, or distributor is not
15required to accept the return of products for the reasons
16stated in items (1) through (7) of subsection (f).
17        (1) A manufacturer with self-distribution privileges,
18    importing distributor, or distributor may not accept the
19    return of alcoholic liquor products as breakage if the
20    product was damaged after delivery and while in the
21    possession of the retailer. The manufacturer with
22    self-distribution privileges, importing distributor, or
23    distributor may replace damaged cartons, packaging, or
24    carrying containers of alcoholic liquor at any time.
25        (2) Alcoholic liquor products or other compensation
26    shall not be furnished to a retailer for product breakage

1    that occurs as a result of handling by the retailer or its
2    agents, employees, or customers.
3        (3) If an alcoholic liquor product has been damaged
4    prior to or at the time of actual delivery, the product may
5    only be exchanged for an equal quantity of identical
6    product or returned for credit. If an identical product is
7    unavailable, a similar type of product, including a
8    similarly priced product, may be exchanged.
9        (4) If an alcoholic liquor product has been damaged
10    prior to or at the time of actual delivery, the product may
11    be exchanged no later than 15 days after delivery under the
12    following conditions:
13            (A) If the pre-delivery damage is visible at the
14        time of delivery, the retailer must identify the
15        damaged product immediately.
16            (B) If the damage is latent and not visible at the
17        time of delivery, the retailer must notify the
18        manufacturer with self-distribution privileges,
19        importing distributor, or distributor of the
20        pre-delivery damage within 15 days after delivery, or
21        the date of invoice, whichever is later.
22    (e) It is unlawful to sell, offer to sell, or contract to
23sell alcoholic liquor products with the privilege of return for
24any reason, other than those considered to be ordinary and
25usual commercial reasons, arising after the product has been
26sold. A manufacturer with self-distribution privileges,

1importing distributor, or distributor is under no obligation to
2accept a return or make an exchange for any product. A
3manufacturer with self-distribution privileges, importing
4distributor, or distributor that elects to make an authorized
5exchange of a product or return of a product for cash or credit
6does so at its sole discretion and must maintain proper books
7and records of the transaction in accordance with 11 Ill. Adm.
8Code 100.130.
9    (f) Ordinary and usual commercial reasons for the return of
10alcoholic liquor products are limited to the following:
11        (1) Defective products. Products that are unmarketable
12    because of product deterioration, leaking containers,
13    damaged labels, or missing or mutilated tamper evident
14    closures may be exchanged for an equal quantity of
15    identical or similar products, including similarly priced
16    products, or credit against outstanding indebtedness.
17        (2) Error in products delivered. Any discrepancy
18    between products ordered and products delivered may be
19    corrected, within 15 days after the date of delivery or
20    date of invoice, whichever is later, by exchange of the
21    products delivered for those that were ordered or by a
22    return for credit against outstanding indebtedness.
23        (3) Products that may no longer be lawfully sold.
24    Products that may no longer be lawfully sold may be
25    returned for credit against outstanding indebtedness. This
26    includes situations in which, due to a change in regulation

1    or administrative procedure over which a retailer has no
2    control, a particular size or brand is no longer permitted
3    to be sold.
4        (4) Termination of business. Products on hand at the
5    time a retailer terminates operations may be returned for
6    cash or credit against outstanding indebtedness. This does
7    not include a temporary seasonal shutdown.
8        (5) Change in products. A retailer's inventory of a
9    product that has been changed in formula, proof, label, or
10    container may be exchanged for equal quantities of the new
11    version of that product.
12        (6) Discontinued products. If a manufacturer,
13    non-resident dealer, foreign importer, or importing
14    distributor discontinues the production or importation of
15    a product, a retailer may return its inventory of that
16    product for cash or credit against outstanding
17    indebtedness.
18        (7) Seasonal dealers. Manufacturers with
19    self-distribution privileges, importing distributors, or
20    distributors may accept the return of product from
21    retailers who are only open a portion of the year if the
22    products are likely to spoil during the off-season. These
23    returns shall be for cash or credit against outstanding
24    indebtedness.
25    (g) Without limitation, the following are not considered
26ordinary and commercial reasons to justify a return of an

1alcoholic liquor product:
2        (1) Overstocked and slow-moving alcoholic liquor
3    products. The return or exchange of a product because it is
4    overstocked or slow moving does not constitute a return for
5    ordinary and usual commercial reasons.
6        (2) Seasonal alcoholic liquor products. The return for
7    cash or credit or exchange of wine or spirits for which
8    there is only a limited or seasonal demand, such as holiday
9    decanters and certain distinctive bottles, does not
10    constitute a return for ordinary and usual commercial
11    reasons. Nothing in this item (2) prohibits the exchange of
12    seasonal beer products for similarly priced beer products.
13    (h) Nothing in this Section prohibits a manufacturer with
14self-distribution privileges, importing distributor, or
15distributor from accepting the return of beer from a retailer
16if the beer is near or beyond its freshness date, code date,
17pull date, or other similar date marking the deterioration or
18freshness of the beer if:
19        (1) the brewer has policies and procedures in place
20    that specify the date the retailer must pull the product;
21        (2) the brewer's freshness return or exchange policies
22    and procedures are readily verifiable and consistently
23    followed by the brewer; and
24        (3) the container has identifying markings that
25    correspond with this date.
26    Returns under this subsection may be accepted in return for

1credit against indebtedness or equal amounts of the same or
2similar beer, including a similarly priced product.
3    For purposes of this Section, beer is near code on any date
4on or before the freshness or code date not to exceed 30 days
5prior to the freshness or code date. If near-code beer is
6returned, a manufacturer with self-distribution privileges,
7importing distributor, or distributor may sell near-code beer
8to another retailer who may reasonably sell the beer on or
9before the expiration of the freshness or code date. No beer
10shall be returned as near-code prior to 30 days of the
11freshness or code date.
12    It is a violation of this Section for a retailer to hold
13beer for the purpose of returning beer as out of code.

15    Sec. 6-6. Except as otherwise provided in this Act no
16manufacturer or distributor or importing distributor shall,
17directly or indirectly, sell, supply, furnish, give or pay for,
18or loan or lease, any furnishing, fixture or equipment on the
19premises of a place of business of another licensee authorized
20under this Act to sell alcoholic liquor at retail, either for
21consumption on or off the premises, nor shall he or she,
22directly or indirectly, pay for any such license, or advance,
23furnish, lend or give money for payment of such license, or
24purchase or become the owner of any note, mortgage, or other
25evidence of indebtedness of such licensee or any form of

1security therefor, nor shall such manufacturer, or
2distributor, or importing distributor, directly or indirectly,
3be interested in the ownership, conduct or operation of the
4business of any licensee authorized to sell alcoholic liquor at
5retail, nor shall any manufacturer, or distributor, or
6importing distributor be interested directly or indirectly or
7as owner or part owner of said premises or as lessee or lessor
8thereof, in any premises upon which alcoholic liquor is sold at
9retail.
10    No manufacturer or distributor or importing distributor
11shall, directly or indirectly or through a subsidiary or
12affiliate, or by any officer, director or firm of such
13manufacturer, distributor or importing distributor, furnish,
14give, lend or rent, install, repair or maintain, to or for any
15retail licensee in this State, any signs or inside advertising
16materials except as provided in this Section and Section 6-5.
17With respect to retail licensees, other than any government
18owned or operated auditorium, exhibition hall, recreation
19facility or other similar facility holding a retailer's license
20as described in Section 6-5, a manufacturer, distributor, or
21importing distributor may furnish, give, lend or rent and
22erect, install, repair and maintain to or for any retail
23licensee, for use at any one time in or about or in connection
24with a retail establishment on which the products of the
25manufacturer, distributor or importing distributor are sold,
26the following signs and inside advertising materials as

1authorized in subparts (i), (ii), (iii), and (iv):
2        (i) Permanent outside signs shall cost not more than
3    $3,000 per brand manufacturer, exclusive of erection,
4    installation, repair and maintenance costs, and permit
5    fees and shall bear only the manufacturer's name, brand
6    name, trade name, slogans, markings, trademark, or other
7    symbols commonly associated with and generally used in
8    identifying the product including, but not limited to,
9    "cold beer", "on tap", "carry out", and "packaged liquor".
10        (ii) Temporary outside signs shall include, but not be
11    limited to, banners, flags, pennants, streamers, and other
12    items of a temporary and non-permanent nature, and shall
13    cost not more than $1,000 per manufacturer. Each temporary
14    outside sign must include the manufacturer's name, brand
15    name, trade name, slogans, markings, trademark, or other
16    symbol commonly associated with and generally used in
17    identifying the product. Temporary outside signs may also
18    include, for example, the product, price, packaging, date
19    or dates of a promotion and an announcement of a retail
20    licensee's specific sponsored event, if the temporary
21    outside sign is intended to promote a product, and provided
22    that the announcement of the retail licensee's event and
23    the product promotion are held simultaneously. However,
24    temporary outside signs may not include names, slogans,
25    markings, or logos that relate to the retailer. Nothing in
26    this subpart (ii) shall prohibit a distributor or importing

1    distributor from bearing the cost of creating or printing a
2    temporary outside sign for the retail licensee's specific
3    sponsored event or from bearing the cost of creating or
4    printing a temporary sign for a retail licensee containing,
5    for example, community goodwill expressions, regional
6    sporting event announcements, or seasonal messages,
7    provided that the primary purpose of the temporary outside
8    sign is to highlight, promote, or advertise the product. In
9    addition, temporary outside signs provided by the
10    manufacturer to the distributor or importing distributor
11    may also include, for example, subject to the limitations
12    of this Section, preprinted community goodwill
13    expressions, sporting event announcements, seasonal
14    messages, and manufacturer promotional announcements.
15    However, a distributor or importing distributor shall not
16    bear the cost of such manufacturer preprinted signs.
17        (iii) Permanent inside signs, whether visible from the
18    outside or the inside of the premises, include, but are not
19    limited to: alcohol lists and menus that may include names,
20    slogans, markings, or logos that relate to the retailer;
21    neons; illuminated signs; clocks; table lamps; mirrors;
22    tap handles; decalcomanias; window painting; and window
23    trim. All neons, illuminated signs, clocks, table lamps,
24    mirrors, and tap handles are the property of the
25    manufacturer and shall be returned to the manufacturer or
26    its agent upon request. All permanent inside signs in place

1    and in use at any one time shall cost in the aggregate not
2    more than $6,000 per manufacturer. A permanent inside sign
3    must include the manufacturer's name, brand name, trade
4    name, slogans, markings, trademark, or other symbol
5    commonly associated with and generally used in identifying
6    the product. However, permanent inside signs may not
7    include names, slogans, markings, or logos that relate to
8    the retailer. For the purpose of this subpart (iii), all
9    permanent inside signs may be displayed in an adjacent
10    courtyard or patio commonly referred to as a "beer garden"
11    that is a part of the retailer's licensed premises.
12        (iv) Temporary inside signs shall include, but are not
13    limited to, lighted chalk boards, acrylic table tent
14    beverage or hors d'oeuvre list holders, banners, flags,
15    pennants, streamers, and inside advertising materials such
16    as posters, placards, bowling sheets, table tents, inserts
17    for acrylic table tent beverage or hors d'oeuvre list
18    holders, sports schedules, or similar printed or
19    illustrated materials and product displays, such as
20    display racks, bins, barrels, or similar items, the primary
21    function of which is to temporarily hold and display
22    alcoholic beverages; however, such items, for example, as
23    coasters, trays, napkins, glassware and cups shall not be
24    deemed to be inside signs or advertising materials and may
25    only be sold to retailers at fair market value, which shall
26    be no less than the cost of the item to the manufacturer,

1    distributor, or importing distributor. All temporary
2    inside signs and inside advertising materials in place and
3    in use at any one time shall cost in the aggregate not more
4    than $1,000 per manufacturer. Nothing in this subpart (iv)
5    prohibits a distributor or importing distributor from
6    paying the cost of printing or creating any temporary
7    inside banner or inserts for acrylic table tent beverage or
8    hors d'oeuvre list holders for a retail licensee, provided
9    that the primary purpose for the banner or insert is to
10    highlight, promote, or advertise the product. For the
11    purpose of this subpart (iv), all temporary inside signs
12    and inside advertising materials may be displayed in an
13    adjacent courtyard or patio commonly referred to as a "beer
14    garden" that is a part of the retailer's licensed premises.
15    The restrictions contained in this Section 6-6 do not apply
16to signs, or promotional or advertising materials furnished by
17manufacturers, distributors or importing distributors to a
18government owned or operated facility holding a retailer's
19license as described in Section 6-5.
20    No distributor or importing distributor shall directly or
21indirectly or through a subsidiary or affiliate, or by any
22officer, director or firm of such manufacturer, distributor or
23importing distributor, furnish, give, lend or rent, install,
24repair or maintain, to or for any retail licensee in this
25State, any signs or inside advertising materials described in
26subparts (i), (ii), (iii), or (iv) of this Section except as

1the agent for or on behalf of a manufacturer, provided that the
2total cost of any signs and inside advertising materials
3including but not limited to labor, erection, installation and
4permit fees shall be paid by the manufacturer whose product or
5products said signs and inside advertising materials advertise
6and except as follows:
7    A distributor or importing distributor may purchase from or
8enter into a written agreement with a manufacturer or a
9manufacturer's designated supplier and such manufacturer or
10the manufacturer's designated supplier may sell or enter into
11an agreement to sell to a distributor or importing distributor
12permitted signs and advertising materials described in
13subparts (ii), (iii), or (iv) of this Section for the purpose
14of furnishing, giving, lending, renting, installing,
15repairing, or maintaining such signs or advertising materials
16to or for any retail licensee in this State. Any purchase by a
17distributor or importing distributor from a manufacturer or a
18manufacturer's designated supplier shall be voluntary and the
19manufacturer may not require the distributor or the importing
20distributor to purchase signs or advertising materials from the
21manufacturer or the manufacturer's designated supplier.
22    A distributor or importing distributor shall be deemed the
23owner of such signs or advertising materials purchased from a
24manufacturer or a manufacturer's designated supplier.
25    The provisions of Public Act 90-373 concerning signs or
26advertising materials delivered by a manufacturer to a

1distributor or importing distributor shall apply only to signs
2or advertising materials delivered on or after August 14, 1997.
3    A manufacturer, distributor, or importing distributor may
4furnish free social media advertising to a retail licensee if
5the social media advertisement does not contain the retail
6price of any alcoholic liquor and the social media
7advertisement complies with any applicable rules or
8regulations issued by the Alcohol and Tobacco Tax and Trade
9Bureau of the United States Department of the Treasury. A
10manufacturer, distributor, or importing distributor may list
11the names of one or more unaffiliated retailers in the
12advertisement of alcoholic liquor through social media.
13Nothing in this Section shall prohibit a retailer from
14communicating with a manufacturer, distributor, or importing
15distributor on social media or sharing media on the social
16media of a manufacturer, distributor, or importing
17distributor. A retailer may request free social media
18advertising from a manufacturer, distributor, or importing
19distributor. Nothing in this Section shall prohibit a
20manufacturer, distributor, or importing distributor from
21sharing, reposting, or otherwise forwarding a social media post
22by a retail licensee, so long as the sharing, reposting, or
23forwarding of the social media post does not contain the retail
24price of any alcoholic liquor. No manufacturer, distributor, or
25importing distributor shall pay or reimburse a retailer,
26directly or indirectly, for any social media advertising

1services, except as specifically permitted in this Act. No
2retailer shall accept any payment or reimbursement, directly or
3indirectly, for any social media advertising services offered
4by a manufacturer, distributor, or importing distributor,
5except as specifically permitted in this Act. For the purposes
6of this Section, "social media" means a service, platform, or
7site where users communicate with one another and share media,
8such as pictures, videos, music, and blogs, with other users
9free of charge.
10    No person engaged in the business of manufacturing,
11importing or distributing alcoholic liquors shall, directly or
12indirectly, pay for, or advance, furnish, or lend money for the
13payment of any license for another. Any licensee who shall
14permit or assent, or be a party in any way to any violation or
15infringement of the provisions of this Section shall be deemed
16guilty of a violation of this Act, and any money loaned
17contrary to a provision of this Act shall not be recovered
18back, or any note, mortgage or other evidence of indebtedness,
19or security, or any lease or contract obtained or made contrary
20to this Act shall be unenforceable and void.
21    This Section shall not apply to airplane licensees
22exercising powers provided in paragraph (i) of Section 5-1 of
23this Act.

1    Sec. 6-6.5. Sanitation. A manufacturer, distributor, or
2importing distributor may sell coil cleaning services to a
3retail licensee at fair market cost.
4    A manufacturer, distributor, or importing distributor may
5sell dispensing accessories to retail licensees at a price not
6less than the cost to the manufacturer, distributor, or
7importing distributor who initially purchased them. Dispensing
8accessories include, but are not limited to, items such as
9standards, faucets, cold plates, rods, vents, taps, tap
10standards, hoses, washers, couplings, gas gauges, vent
11tongues, shanks, and check valves. A manufacturer,
12distributor, or importing distributor may service, balance, or
13inspect draft beer, wine, or distilled spirits systems at
14regular intervals and may provide labor to replace or install
15dispensing accessories.
16    Coil cleaning supplies consisting of detergents, cleaning
17chemicals, brushes, or similar type cleaning devices may be
18sold at a price not less than the cost to the manufacturer,
19distributor, or importing distributor.

22    Sec. 6-6.6. Giving, selling, and leasing dispensing
23equipment. Notwithstanding any provision of this Act to the
24contrary, a manufacturer, distributor, or importing
25distributor may:

1        (1) give dispensing equipment free of charge to a
2    retailer, special use permit licensee, or caterer retailer
3    one time per year for a one-day period. A manufacturer,
4    distributor, or importing distributor shall not supply a
5    retailer, special use permit licensee, or caterer retailer
6    with free beer, wine, spirits, or any other item of value
7    for the same one-day period the dispensing equipment is
8    given, except as otherwise provided in this Act or the
9    Illinois Administrative Code;
10        (2) give dispensing equipment free of charge to a
11    special event retailer only for the duration of the
12    licensed special event. A manufacturer, distributor, or
13    importing distributor shall not supply a special event
14    retailer with free beer, wine, or distilled spirits for the
15    event the dispensing equipment is given, except as
16    otherwise provided in this Act or the Illinois
17    Administrative Code; or
18        (3) sell dispensing equipment to a retailer, special
19    event retailer, special use permit licensee, or caterer
20    retailer for a price that is not less than the cost to the
21    manufacturer, distributor, or importing distributor. For
22    purposes of this paragraph (3), the cost of dispensing
23    equipment is the amount that the manufacturer,
24    distributor, or importing distributor paid for the
25    dispensing equipment. If the manufacturer, distributor, or
26    importing distributor did not pay for the dispensing

1    equipment but was given the equipment, the cost of the
2    dispensing equipment is equal to (i) the amount another
3    manufacturer, distributor, or importing distributor paid
4    for the dispensing equipment, (ii) the cost of
5    manufacturing or producing the dispensing equipment, or
6    (iii) the fair market value of the dispensing equipment.
7    A manufacturer, distributor, or importing distributor may
8also enter into a written lease for the fair market value of
9the dispensing equipment to retailers, special event
10retailers, special use permit licensees, or caterer retailers.
11The manufacturer, distributor, or importing distributor shall
12invoice and collect the sale price or payment for the entire
13lease period from the retailer, special event retailer, special
14use permit licensee, or caterer retailer within 30 days of the
15date of the invoice or from the date the lease is executed. The
16term of any lease for dispensing equipment shall not exceed 180
17days in the aggregate in one calendar year, and no lease shall
18be renewed automatically. There shall be a lapse of 90
19consecutive days before the beginning of a new lease term.
20    At the direction of the manufacturer, distributor, or
21importing distributor, the retailer, special event retailer,
22special use permit licensee, or caterer retailer shall return
23the equipment or the manufacturer, distributor, or importing
24distributor shall retrieve the dispensing equipment at the
25termination of the lease.
26    In this Section, "dispensing equipment" means any portable

1or temporary unit the primary purpose of which is to pour
2alcoholic liquor or to maintain the alcoholic liquor in a
3consumable state. "Dispensing equipment" includes courtesy
4wagons, beer wagons, beer trailers, ice bins, draft coolers,
5coil boxes, portable bars, and kiosks. "Dispensing equipment"
6does not include permanent tap systems, permanent
7refrigeration systems, or any other built-in or physically
8attached fixture of the retailer, special event retailer,
9special use permit licensee, or caterer retailer.
10    In this Section, "fair market value" for the purposes of
11leasing dispensing equipment means (i) the cost of depreciation
12of the dispensing equipment to the manufacturer, distributor,
13or importing distributor for the same period of the lease or
14(ii) the cost of depreciation the manufacturer, distributor, or
15importing distributor would have incurred based upon the market
16value of the dispensing equipment if the manufacturer,
17distributor, or importing distributor did not pay for the
18dispensing equipment or if the dispensing equipment is fully
19depreciated.

21    Sec. 8-1. A tax is imposed upon the privilege of engaging
22in business as a manufacturer or as an importing distributor of
23alcoholic liquor other than beer at the rate of $0.185 per
24gallon until September 1, 2009 and $0.231 per gallon beginning
25September 1, 2009 for cider containing not less than 0.5%

1alcohol by volume nor more than 7% alcohol by volume, $0.73 per
2gallon until September 1, 2009 and $1.39 per gallon beginning
3September 1, 2009 for wine other than cider containing less
4than 7% alcohol by volume, and $4.50 per gallon until September
51, 2009 and $8.55 per gallon beginning September 1, 2009 on
6alcohol and spirits manufactured and sold or used by such
7manufacturer, or as agent for any other person, or sold or used
8by such importing distributor, or as agent for any other
9person. A tax is imposed upon the privilege of engaging in
10business as a manufacturer of beer or as an importing
11distributor of beer at the rate of $0.185 per gallon until
12September 1, 2009 and $0.231 per gallon beginning September 1,
132009 on all beer, regardless of alcohol by volume, manufactured
14and sold or used by such manufacturer, or as agent for any
15other person, or sold or used by such importing distributor, or
16as agent for any other person. Any brewer manufacturing beer in
17this State shall be entitled to and given a credit or refund of
1875% of the tax imposed on each gallon of beer up to 4.9 million
19gallons per year in any given calendar year for tax paid or
20payable on beer produced and sold in the State of Illinois.
21    For purposes of this Section, "beer" means beer, ale,
22porter, stout, and other similar fermented beverages of any
23name or description containing one-half of one percent or more
24of alcohol by volume, brewed or produced from malt, wholly or
25in part, or from any substitute for malt.
26    For the purpose of this Section, "cider" means any

1alcoholic beverage obtained by the alcohol fermentation of the
2juice of apples or pears including, but not limited to,
3flavored, sparkling, or carbonated cider.
4    The credit or refund created by this Act shall apply to all
5beer taxes in the calendar years 1982 through 1986.
6    The increases made by this amendatory Act of the 91st
7General Assembly in the rates of taxes imposed under this
8Section shall apply beginning on July 1, 1999.
9    A tax at the rate of 1˘ per gallon on beer and 48˘ per
10gallon on alcohol and spirits is also imposed upon the
11privilege of engaging in business as a retailer or as a
12distributor who is not also an importing distributor with
13respect to all beer and all alcohol and spirits owned or
14possessed by such retailer or distributor when this amendatory
15Act of 1969 becomes effective, and with respect to which the
16additional tax imposed by this amendatory Act upon
17manufacturers and importing distributors does not apply.
18Retailers and distributors who are subject to the additional
19tax imposed by this paragraph of this Section shall be required
20to inventory such alcoholic liquor and to pay this additional
21tax in a manner prescribed by the Department.
22    The provisions of this Section shall be construed to apply
23to any importing distributor engaging in business in this
24State, whether licensed or not.
25    However, such tax is not imposed upon any such business as
26to any alcoholic liquor shipped outside Illinois by an Illinois

1licensed manufacturer or importing distributor, nor as to any
2alcoholic liquor delivered in Illinois by an Illinois licensed
3manufacturer or importing distributor to a purchaser for
4immediate transportation by the purchaser to another state into
5which the purchaser has a legal right, under the laws of such
6state, to import such alcoholic liquor, nor as to any alcoholic
7liquor other than beer sold by one Illinois licensed
8manufacturer or importing distributor to another Illinois
9licensed manufacturer or importing distributor to the extent to
10which the sale of alcoholic liquor other than beer by one
11Illinois licensed manufacturer or importing distributor to
12another Illinois licensed manufacturer or importing
13distributor is authorized by the licensing provisions of this
14Act, nor to alcoholic liquor whether manufactured in or
15imported into this State when sold to a "non-beverage user"
16licensed by the State for use in the manufacture of any of the
17following when they are unfit for beverage purposes:
18    Patent and proprietary medicines and medicinal,
19antiseptic, culinary and toilet preparations;
20    Flavoring extracts and syrups and food products;
21    Scientific, industrial and chemical products, excepting
22denatured alcohol;
23    Or for scientific, chemical, experimental or mechanical
24purposes;
25    Nor is the tax imposed upon the privilege of engaging in
26any business in interstate commerce or otherwise, which

1business may not, under the Constitution and Statutes of the
2United States, be made the subject of taxation by this State.
3    The tax herein imposed shall be in addition to all other
4occupation or privilege taxes imposed by the State of Illinois
5or political subdivision thereof.
6    If any alcoholic liquor manufactured in or imported into
7this State is sold to a licensed manufacturer or importing
8distributor by a licensed manufacturer or importing
9distributor to be used solely as an ingredient in the
10manufacture of any beverage for human consumption, the tax
11imposed upon such purchasing manufacturer or importing
12distributor shall be reduced by the amount of the taxes which
13have been paid by the selling manufacturer or importing
14distributor under this Act as to such alcoholic liquor so used
15to the Department of Revenue.
16    If any person received any alcoholic liquors from a
17manufacturer or importing distributor, with respect to which
18alcoholic liquors no tax is imposed under this Article, and
19such alcoholic liquor shall thereafter be disposed of in such
20manner or under such circumstances as may cause the same to
21become the base for the tax imposed by this Article, such
22person shall make the same reports and returns, pay the same
23taxes and be subject to all other provisions of this Article
24relating to manufacturers and importing distributors.
25    Nothing in this Article shall be construed to require the
26payment to the Department of the taxes imposed by this Article

1more than once with respect to any quantity of alcoholic liquor
2sold or used within this State.
3    No tax is imposed by this Act on sales of alcoholic liquor
4by Illinois licensed foreign importers to Illinois licensed
5importing distributors.
6    All of the proceeds of the additional tax imposed by Public
7Act 96-34 shall be deposited by the Department into the Capital
8Projects Fund. The remainder of the tax imposed by this Act
9shall be deposited by the Department into the General Revenue
10Fund.
11    A manufacturer of beer that imports or transfers beer into
12this State must comply with the provisions of this Section with
13regard to the beer imported into this State.
14    The provisions of this Section 8-1 are severable under
15Section 1.31 of the Statute on Statutes.

19    Sec. 8-5. As soon as practicable after any return is filed,
20the Department shall examine such return and shall correct such
21return according to its best judgment and information, which
22return so corrected by the Department shall be prima facie
23correct and shall be prima facie evidence of the correctness of
24the amount of tax due, as shown therein. Instead of requiring
25the licensee to file an amended return, the Department may

2has made. Proof of such correction by the Department, or of the
3determination of the amount of tax due as provided in Sections
48-4 and 8-10, may be made at any hearing before the Department
5or in any legal proceeding by a reproduced copy of the
6Department's record relating thereto in the name of the
7Department under the certificate of the Director of Revenue.
8Such reproduced copy shall, without further proof, be admitted
9into evidence before the Department or in any legal proceeding
10and shall be prima facie proof of the correctness of the amount
11of tax due, as shown therein. If the return so corrected by the
12Department discloses the sale or use, by a licensed
13manufacturer or importing distributor, of alcoholic liquors as
14to which the tax provided for in this Article should have been
15paid, but has not been paid, in excess of the alcoholic liquors
16reported as being taxable by the licensee, and as to which the
17proper tax was paid the Department shall notify the licensee
18that it shall issue the taxpayer a notice of tax liability for
19the amount of tax claimed by the Department to be due, together
20with penalties at the rates prescribed by Sections 3-3, 3-5 and
213-6 of the Uniform Penalty and Interest Act, which amount of
22tax shall be equivalent to the amount of tax which, at the
23prescribed rate per gallon, should have been paid with respect
24to the alcoholic liquors disposed of in excess of those
25reported as being taxable. No earlier than 90 days after the
26due date of the return, the Department may compare filed

1returns, or any amendments thereto, against reports of sales of
2alcoholic liquor submitted to the Department by other
3manufacturers and distributors. If a return or amended return
4is corrected by the Department because the return or amended
5return failed to disclose the purchase of alcoholic liquor from
6manufacturers or distributors on which the tax provided for in
7this Article should have been paid, but has not been paid, the
8Department shall issue the taxpayer a notice of tax liability
9for the amount of tax claimed by the Department to be due,
10together with penalties at the rates prescribed by Sections
113-3, 3-5, and 3-6 of the Uniform Penalty and Interest Act. In a
12case where no return has been filed, the Department shall
13determine the amount of tax due according to its best judgment
14and information and shall issue the taxpayer a notice of tax
15liability for the amount of tax claimed by the Department to be
16due as herein provided together with penalties at the rates
17prescribed by Sections 3-3, 3-5 and 3-6 of the Uniform Penalty
18and Interest Act. If, in administering the provisions of this
19Act, a comparison of a licensee's return or returns with the
20books, records and physical inventories of such licensee
21discloses a deficiency which cannot be allocated by the
22Department to a particular month or months, the Department
23shall issue the taxpayer a notice of tax liability for the
24amount of tax claimed by the Department to be due for a given
25period, but without any obligation upon the Department to
26allocate such deficiency to any particular month or months,

1together with penalties at the rates prescribed by Sections
23-3, 3-5 and 3-6 of the Uniform Penalty and Interest Act, which
3amount of tax shall be equivalent to the amount of tax which,
4at the prescribed rate per gallon, should have been paid with
5respect to the alcoholic liquors disposed of in excess of those
6reported being taxable, with the tax thereon having been paid
7under which circumstances the aforesaid notice of tax liability
8shall be prima facie correct and shall be prima facie evidence
9of the correctness of the amount of tax due as shown therein;
10and proof of such correctness may be made in accordance with,
11and the admissibility of a reproduced copy of such notice of
12the Department's notice of tax liability shall be governed by,
13all the provisions of this Act applicable to corrected returns.
14    If the licensee dies or becomes a person under legal
15disability at any time before the Department issues its notice
16of tax liability, such notice shall be issued to the
17administrator, executor or other legal representative, as
18such, of the deceased or licensee who is under legal
19disability.
20    If such licensee or legal representative, within 60 days
21after such notice of tax liability, files a protest to such
22notice of tax liability and requests a hearing thereon, the
23Department shall give at least 7 days' notice to such licensee
24or legal representative, as the case may be, of the time and
25place fixed for such hearing and shall hold a hearing in
26conformity with the provisions of this Act, and pursuant

1thereto shall issue a final assessment to such licensee or
2legal representative for the amount found to be due as a result
3of such hearing.
4    If a protest to the notice of tax liability and a request
5for a hearing thereon is not filed within 60 days after such
6notice of tax liability, such notice of tax liability shall
7become final without the necessity of a final assessment being
8issued and shall be deemed to be a final assessment.
9    In case of failure to pay the tax, or any portion thereof,
10or any penalty provided for herein, when due, the Department
11may recover the amount of such tax, or portion thereof, or
12penalty in a civil action; or if the licensee dies or becomes a
13person under legal disability, by filing a claim therefor
14against his or her estate; provided that no such claim shall be
15filed against the estate of any deceased or of the licensee who
16is under legal disability for any tax or penalty or portion
17thereof except in the manner prescribed and within the time
18limited by the Probate Act of 1975, as amended.
19    The collection of any such tax and penalty, or either, by
20any means provided for herein, shall not be a bar to any
21prosecution under this Act.
22    In addition to any other penalty provided for in this
23Article, all provisions of the Uniform Penalty and Interest Act
24that are not inconsistent with this Act apply any licensee who
25fails to pay any tax within the time required by this Article

4    Sec. 8-5. As soon as practicable after any return is filed
5but not before 90 days after the return is filed, or any
6amendments to that return, whichever is later, the Department
7shall examine such return or amended return and shall correct
8such return according to its best judgment and information,
9which return so corrected by the Department shall be prima
10facie correct and shall be prima facie evidence of the
11correctness of the amount of tax due, as shown therein. Instead
12of requiring the licensee to file an amended return, the
13Department may simply notify the licensee of the correction or
14corrections it has made. Proof of such correction by the
15Department, or of the determination of the amount of tax due as
16provided in Sections 8-4 and 8-10, may be made at any hearing
17before the Department or in any legal proceeding by a
18reproduced copy of the Department's record relating thereto in
19the name of the Department under the certificate of the
20Director of Revenue. Such reproduced copy shall, without
21further proof, be admitted into evidence before the Department
22or in any legal proceeding and shall be prima facie proof of
23the correctness of the amount of tax due, as shown therein. If
24the return so corrected by the Department discloses the sale or
25use, by a licensed manufacturer or importing distributor, of

1alcoholic liquors as to which the tax provided for in this
2Article should have been paid, but has not been paid, in excess
3of the alcoholic liquors reported as being taxable by the
4licensee, and as to which the proper tax was paid the
5Department shall notify the licensee that it shall issue the
6taxpayer a notice of tax liability for the amount of tax
7claimed by the Department to be due, together with penalties at
8the rates prescribed by Sections 3-3, 3-5 and 3-6 of the
9Uniform Penalty and Interest Act, which amount of tax shall be
10equivalent to the amount of tax which, at the prescribed rate
11per gallon, should have been paid with respect to the alcoholic
12liquors disposed of in excess of those reported as being
13taxable. No earlier than 90 days after the due date of the
14return, the Department may compare filed returns, or any
15amendments thereto, against reports of sales of alcoholic
16liquor submitted to the Department by other manufacturers and
17distributors. If a return or amended return is corrected by the
18Department because the return or amended return failed to
19disclose the purchase of alcoholic liquor from manufacturers or
20distributors on which the tax provided for in this Article
21should have been paid, but has not been paid, the Department
22shall issue the taxpayer a notice of tax liability for the
23amount of tax claimed by the Department to be due, together
24with penalties at the rates prescribed by Sections 3-3, 3-5,
25and 3-6 of the Uniform Penalty and Interest Act. In a case
26where no return has been filed, the Department shall determine

1the amount of tax due according to its best judgment and
2information and shall issue the taxpayer a notice of tax
3liability for the amount of tax claimed by the Department to be
4due as herein provided together with penalties at the rates
5prescribed by Sections 3-3, 3-5 and 3-6 of the Uniform Penalty
6and Interest Act. If, in administering the provisions of this
7Act, a comparison of a licensee's return or returns with the
8books, records and physical inventories of such licensee
9discloses a deficiency which cannot be allocated by the
10Department to a particular month or months, the Department
11shall issue the taxpayer a notice of tax liability for the
12amount of tax claimed by the Department to be due for a given
13period, but without any obligation upon the Department to
14allocate such deficiency to any particular month or months,
15together with penalties at the rates prescribed by Sections
163-3, 3-5 and 3-6 of the Uniform Penalty and Interest Act, which
17amount of tax shall be equivalent to the amount of tax which,
18at the prescribed rate per gallon, should have been paid with
19respect to the alcoholic liquors disposed of in excess of those
20reported being taxable, with the tax thereon having been paid
21under which circumstances the aforesaid notice of tax liability
22shall be prima facie correct and shall be prima facie evidence
23of the correctness of the amount of tax due as shown therein;
24and proof of such correctness may be made in accordance with,
25and the admissibility of a reproduced copy of such notice of
26the Department's notice of tax liability shall be governed by,

1all the provisions of this Act applicable to corrected returns.
2    If the licensee dies or becomes a person under legal
3disability at any time before the Department issues its notice
4of tax liability, such notice shall be issued to the
5administrator, executor or other legal representative, as
6such, of the deceased or licensee who is under legal
7disability.
8    If such licensee or legal representative, within 60 days
9after such notice of tax liability, files a protest to such
10notice of tax liability and requests a hearing thereon, the
11Department shall give at least 7 days' notice to such licensee
12or legal representative, as the case may be, of the time and
13place fixed for such hearing and shall hold a hearing in
14conformity with the provisions of this Act, and pursuant
15thereto shall issue a final assessment to such licensee or
16legal representative for the amount found to be due as a result
17of such hearing.
18    If a protest to the notice of tax liability and a request
19for a hearing thereon is not filed within 60 days after such
20notice of tax liability, such notice of tax liability shall
21become final without the necessity of a final assessment being
22issued and shall be deemed to be a final assessment.
23    In case of failure to pay the tax, or any portion thereof,
24or any penalty provided for herein, when due, the Department
25may recover the amount of such tax, or portion thereof, or
26penalty in a civil action; or if the licensee dies or becomes a

17    Section 95. No acceleration or delay. Where this Act makes
18changes in a statute that is represented in this Act by text
19that is not yet or no longer in effect (for example, a Section
20represented by multiple versions), the use of that text does
21not accelerate or delay the taking effect of (i) the changes
22made by this Act or (ii) provisions derived from any other
23Public Act.
