AMENDMENT TO SENATE BILL 2140

2    AMENDMENT NO. ______. Amend Senate Bill 2140 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Kyoto Protocol Act of 1998 is amended by
5changing Section 15 as follows:
 
6    (415 ILCS 140/15)
7    Sec. 15. Restrictions on State rules related to greenhouse
8gas emissions.
9    (a) Effective immediately, the the Environmental
10Protection Agency and the Pollution Control Board shall not
11propose or adopt any new rule for the intended purpose of
12addressing the adverse effects of climate change which in whole
13or in part reduces emissions of greenhouse gases, as those
14gases are defined by the Kyoto Protocol, from the residential,
15commercial, industrial, electric utility, or transportation
16sectors. In the absence of an Act of the General Assembly

1approving such rules, the Director of the Environmental
2Protection Agency shall not submit to the U.S. Environmental
3Protection Agency or to any other agency of the federal
4government any legally enforceable commitments related to the
5reduction of greenhouse gases, as those gases are defined by
6the Kyoto Protocol.
7    (b) Nothing in this Section shall be construed to (i) limit
8or impede the authority of the Illinois Environmental
9Protection Agency and Illinois Pollution Control Board to
10propose, adopt, or enforce rules and laws which implement the
11federal Clean Air Act or are intended to attain or maintain
12national ambient air quality standards; or (ii) limit or impede
13State or private participation in any on-going voluntary
14initiatives to reduce emissions of greenhouse gases,
15including, but not limited to, the U.S. Environmental
16Protection Agency's Green Lights program, the U.S. Department
17of Energy's Climate Challenge program, and similar State and
18federal initiatives relying on voluntary participation,
19provided, however, that said rule-making or participation does
20not involve any allocation or other distribution of greenhouse
21gas emission entitlements pursuant to or under color of the
22Kyoto Protocol.
