AMENDMENT TO HOUSE BILL 117

2    AMENDMENT NO. ______. Amend House Bill 117 as follows:
 
3on page 2, lines 1 and 2, by replacing "one employee" with "5
4employees"; and
 
5on page 2, lines 19 and 20, by replacing "or small employer"
6with "or small employer"; and
 
7on page 3, by replacing lines 1 through 8 with the following:
8    "Small employer" means a person or entity engaged in a
9business, industry, profession, trade, or other enterprise in
10Illinois, whether for profit or not for profit, that (i)
11employed less than 5 25 employees during any quarter of at any
12one time in the State throughout the previous calendar year,
13or (ii) has been in business less than 2 years, or both items
14(i) and (ii), but that notifies the Board that it is interested
15in being a participating employer."; and

1on page 9, by replacing lines 16 through 18 with the following:
2"The enrollment deadline for employers with fewer than 25
3employees and more than 15 employees shall be no sooner than
4September 1, 2022. The enrollment deadline for employers with
5at least 5 employees but not more than 15 employees shall be no
6sooner than September 1, 2023. Board's implementation timeline
7shall ensure that all employees are required to be enrolled in
8the Program by December 31, 2020. The provisions of this
9Section shall be in"; and
 
10on page 10, by replacing lines 5 through 12 with the following:
11"Program. Small employers may, but are not required to,
12provide payroll deduction retirement savings arrangements for
13each employee who elects to participate in the Program. Small
14employers' use of automatic enrollment for employees is
15subject to final rules from the United States Department of
16Labor. Utilization of automatic enrollment by small employers
17may be allowed only if it does not create employer liability
18under the federal Employee Retirement Income Security Act.";
19and
 
20on page 14, line 4, by replacing "90" with "120 90"; and
 
21on page 14, by replacing line 8 with the following:
22"subsection (c) of this Section or come into full compliance
