AMENDMENT TO HOUSE BILL 245

2    AMENDMENT NO. ______. Amend House Bill 245 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Alternate Fuels Act is amended by changing
5Sections 5, 10, and 15 and by adding Section 27 as follows:
 
6    (415 ILCS 120/5)
7    Sec. 5. Purpose. The General Assembly declares that it is
8the public policy of the State to promote and encourage the use
9of electric alternate fuel in vehicles as a means to improve
10air quality and reduce the risks from global warming in the
11State and to meet the requirements of the federal Clean Air Act
12Amendments of 1990 and the federal Energy Policy Act of 1992.
13The General Assembly further declares that the State can play
14a leadership role in the development of vehicles powered by
15electricity alternate fuels, as well as in the establishment
16of the necessary charging infrastructure to support this

3    (415 ILCS 120/10)
4    Sec. 10. Definitions. As used in this Act:
5    "Agency" means the Environmental Protection Agency.
6    "Alternate fuel" means electricity, excluding on-board
7electric generation. liquid petroleum gas, natural gas, E85
8blend fuel, fuel composed of a minimum 80% ethanol, 80%
9bio-based methanol, fuels that are at least 80% derived from
10biomass, hydrogen fuel, or electricity, excluding on-board
11electric generation.
12    "Alternate fuel vehicle" means any vehicle that is
13operated in Illinois and is capable of using an alternate
14fuel.
15    "Biodiesel fuel" means a renewable fuel conforming to the
16industry standard ASTM-D6751 and registered with the U.S.
17Environmental Protection Agency.
18    "Car sharing organization" means an organization whose
19primary business is a membership-based service that allows
20members to drive cars by the hour in order to extend the public
21transit system, reduce personal car ownership, save consumers
22money, increase the use of alternative transportation, and
23improve environmental sustainability.
24    "Conventional", when used to modify the word "vehicle",
25"engine", or "fuel", means gasoline or diesel or any

1reformulations of those fuels.
2    "Covered Area" means the counties of Cook, DuPage, Kane,
3Lake, McHenry, and Will and those portions of Grundy County
4and Kendall County that are included in the following ZIP code
5areas, as designated by the U.S. Postal Service on the
6effective date of this amendatory Act of 1998: 60416, 60444,
760447, 60450, 60481, 60538, and 60543.
8    "Director" means the Director of the Environmental
9Protection Agency.
10    "Domestic renewable fuel" means a fuel, produced in the
11United States, composed of a minimum 80% ethanol, 80%
12bio-based methanol, or 20% biodiesel fuel.
13    "E85 blend fuel" means fuel that contains 85% ethanol and
1415% gasoline.
15    "Electric vehicle" means a vehicle that is licensed to
16drive on public roadways, is predominantly powered by, and
17primarily refueled with, electricity, and does not have
18restrictions confining it to operate on only certain types of
19streets or roads.
20    "Environmental justice community" has the same meaning,
21based on existing methodologies and findings, used and as may
22be updated by the Illinois Power Agency and its Program
23Administrator of the Illinois Solar for All Program.
24    "GVWR" means Gross Vehicle Weight Rating.
25    "Location" means (i) a parcel of real property or (ii)
26multiple, contiguous parcels of real property that are

1separated by private roadways, public roadways, or private or
2public rights-of-way and are owned, operated, leased, or under
3common control of one party.
4    "Low income" means persons and families whose income does
5not exceed 80% of area median income, adjusted for family size
6and revised every 2 years.
7    "Original equipment manufacturer" or "OEM" means a
8manufacturer of alternate fuel vehicles or a manufacturer or
9remanufacturer of alternate fuel engines used in vehicles
10greater than 8500 pounds GVWR.
11    "Rental vehicle" means any motor vehicle that is owned or
12controlled primarily for the purpose of short-term leasing or
13rental pursuant to a contract.

16    Sec. 15. Rulemaking. The Agency shall promulgate rules and
17dedicate sufficient resources to implement the purposes of
18Section 30 of this Act. Such rules shall be consistent with the
19provisions of the Clean Air Act Amendments of 1990 and any
20regulations promulgated pursuant thereto. The Secretary of
21State may promulgate rules to implement Section 27 Section 35
22of this Act. The Department of Commerce and Economic
23Opportunity may promulgate rules to implement Section 25 of
24this Act.

1    (415 ILCS 120/27 new)
2    Sec. 27. Environmental justice communities; low income
3rebate.
4    (a) Beginning January 1, 2022, and continuing as long as
5funds are available, the Agency shall administer $4,000
6rebates to environmental justice community low income
7residents.
8    (b) Beginning January 1, 2026, the Agency shall administer
9$2,000 rebates to environmental justice community low income
10residents.
11    (c) Beginning January 1, 2028, the Agency shall administer
12$1,000 rebates to environmental justice community low income
13residents.
14    (d) Rebates administered under this Section shall only be
15available for new passenger battery electric vehicles at a
16prerebate cost of $45,000 or less or for used battery electric
17vehicles at a prerebate cost of $35,000 or less. This cost cut
18off is exclusive of any electric vehicle-specific rebate
19offered by any level of government. If the cost of the electric
20vehicle would be higher than the cost cut off without any
21electric vehicle-specific rebate, the vehicle is not eligible
22for a rebate under this Section.
23    (e) A rebate administered under this Section may be
24combined with other rebates for eligible vehicles and drivers.
25The rebate may only be applied one time per Vehicle

1Identification Number. The rebate may only be used once per
2person in any 5-year period. To be eligible for the low income
3rebate, a purchaser must be a resident of Illinois and provide
4proof of residence at the time of purchase. The State shall
5direct rebate recipients to local electric utilities where
6additional charging equipment rebates may be available.

15repealing Sections 20, 22, 24, 30, 31, 32, and 40.

17becoming law.".
