Amends the Firearm Dealer License Certification Act. Provides that packaging of any firearm and any descriptive materials that accompany any firearm sold or transferred by a certified licensee shall bear a label containing a specified warning statement. Contains requirements for the warning statement. Requires certified licensees to post conspicuously within the licensed premises an additional notice regarding suicide.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Firearm Dealer License Certification Act is | 5 | | amended by changing Section 5-20 as follows: | 6 | | (430 ILCS 68/5-20)
| 7 | | Sec. 5-20. Additional licensee requirements. | 8 | | (a) A certified licensee shall make a photo copy of a | 9 | | buyer's or transferee's valid photo identification card | 10 | | whenever a firearm sale transaction takes place. The photo | 11 | | copy shall be attached to the documentation detailing the | 12 | | record of sale. | 13 | | (b) A certified licensee shall post in a conspicuous | 14 | | position on the premises where the licensee conducts business | 15 | | a sign that contains the following warning in block letters | 16 | | not less than one inch in height: | 17 | | "With few exceptions enumerated in the Firearm Owners | 18 | | Identification Card Act, it is unlawful for you to: | 19 | | (A) store or leave an unsecured firearm in a place | 20 | | where a child can obtain access to it;
| 21 | | (B) sell or transfer your firearm to someone else | 22 | | without receiving approval for the transfer from the | 23 | | Department of State Police, or |

| 1 | | (C) fail to report the loss or theft of your | 2 | | firearm to local law enforcement within 72 hours.". | 3 | | This sign shall be created by the Department and made | 4 | | available for printing or downloading from the Department's | 5 | | website. | 6 | | (c) No retail location established after the effective | 7 | | date of this Act shall be located within 500 feet of any | 8 | | school, pre-school, or day care facility in existence at its | 9 | | location before the retail location is established as measured | 10 | | from the nearest corner of the building holding the retail | 11 | | location to the corner of the school, pre-school, or day care | 12 | | facility building nearest the retail location at the time the | 13 | | retail location seeks licensure. | 14 | | (d) The packaging of any firearm and any descriptive | 15 | | materials that accompany any firearm sold or transferred in | 16 | | this State, or delivered for sale in this State, by a certified | 17 | | licensee shall bear a label containing the following warning | 18 | | statement:
| 19 | | "WARNING | 20 | | Firearms must be handled responsibly and securely stored to | 21 | | prevent access by children and other unauthorized users. | 22 | | Illinois has strict laws pertaining to firearms, and you may | 23 | | be fined or imprisoned if you fail to comply with them. | 24 | | Prevent child access by always keeping guns locked away and |

| 1 | | unloaded when not in use. If you keep a loaded firearm where a | 2 | | child obtains and improperly uses it, you may be fined or sent | 3 | | to jail. | 4 | | If you or someone you know is contemplating suicide, please | 5 | | call the national suicide prevention lifeline at | 6 | | 1-800-273-TALK (8255)." | 7 | | A yellow triangle containing an exclamation mark shall | 8 | | appear immediately before the word "Warning" on the label. | 9 | | If the firearm is sold or transferred without accompanying | 10 | | packaging, the warning label or notice shall be affixed to the | 11 | | firearm itself by a method to be prescribed by the Illinois | 12 | | State Police. | 13 | | The warning statement required under this subsection shall | 14 | | satisfy both of the following requirements: | 15 | | (1) It shall be displayed in its entirety on the | 16 | | principal display panel of the firearm's package, and on | 17 | | any descriptive materials that accompany the firearm. | 18 | | (2) It shall be displayed in both English and Spanish, | 19 | | in conspicuous and legible type in contrast by typography, | 20 | | layout, or color with other printed matter on that package | 21 | | or descriptive materials, in a manner consistent with 16 | 22 | | CFR 1500.121, or successor regulations thereto. | 23 | | (e) A certified licensee shall post conspicuously within | 24 | | the licensed premises, in block letters not less than one inch | 25 | | in height, an additional notice, including, but not limited |

| 1 | | to, a notice provided by a suicide prevention program, | 2 | | containing the following statement: | 3 | | "IF YOU OR SOMEONE YOU KNOW IS CONTEMPLATING SUICIDE, PLEASE | 4 | | CALL THE NATIONAL SUICIDE PREVENTION LIFELINE AT | 5 | | 1-800-273-TALK (8255)." | 6 | | (Source: P.A. 100-1178, eff. 1-18-19.)
