AMENDMENT TO HOUSE BILL 2748

2    AMENDMENT NO. ______. Amend House Bill 2748 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by adding Section
514-17 as follows:
 
6    (105 ILCS 5/14-17 new)
7    Sec. 14-17. COVID-19 recovery post-secondary transition
8recovery eligibility.
9    (a) If a student with an individualized education program
10(IEP) reaches the age of 22 during the time in which the
11student's in-person instruction, services, or activities are
12suspended for a period of 3 months or more during the school
13year as a result of the COVID-19 pandemic, the student is
14eligible for such services up to the end of the regular
152021-2022 school year.
16    (b) This Section does not apply to any student who is no

1longer a resident of the school district that was responsible
2for the student's IEP at the time the student reached the
3student's 22nd birthday.
4    (c) The IEP goals in effect when the student reached the
5student's 22nd birthday shall be resumed unless there is an
6agreement that the goals should be revised to appropriately
7meet the student's current transition needs.
8    (d) If a student was in a private therapeutic day or
9residential program when the student reached the student's
1022nd birthday, the school district is not required to resume
11that program for the student if the student has aged out of the
12program or the funding for supporting the student's placement
13in the facility is no longer available.
14    (e) Within 30 days after the effective date of this
15amendatory Act of the 102nd General Assembly, each school
16district shall provide notification of the availability of
17services under this Section to each student covered by this
18Section by regular mail sent to the last known address of the
19student or the student's parent or guardian.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.".
