AMENDMENT TO HOUSE BILL 2776

2    AMENDMENT NO. ______. Amend House Bill 2776 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Civil Administrative Code of Illinois is
5amended by changing Section 5-715 as follows:
 
6    (20 ILCS 5/5-715)
7    Sec. 5-715. Expedited licensure for service members and
8spouses.
9    (a) In this Section, "service member" means any person
10who, at the time of application under this Section, is an
11active duty member of the United States Armed Forces or any
12reserve component of the United States Armed Forces, the Coast
13Guard, or the National Guard of any state, commonwealth, or
14territory of the United States or the District of Columbia or
15whose active duty service concluded within the preceding 2
16years before application.

1    (a-5) The Department of Financial and Professional
2Regulation shall within 180 days after January 1, 2020 (the
3effective date of Public Act 101-240) the effective date of
4this amendatory Act of the 101st General Assembly designate
5one staff member as the military liaison within the Department
6of Financial and Professional Regulation to ensure proper
7enactment of the requirements of this Section. The military
8liaison's responsibilities shall also include, but are not
9limited to: (1) the management of all expedited applications
10to ensure processing within 30 60 days after receipt of a
11completed application; (2) coordination with all military
12installation military and family support center directors
13within this State, including virtual, phone, or in-person
14periodic meetings with each military installation military and
15family support center; and (3) training by the military
16liaison to all directors of each division that issues an
17occupational or professional license to ensure proper
18application of this Section. At Beginning in 2020, and at the
19end of each calendar year thereafter, the military liaison
20shall provide an annual report documenting the expedited
21licensure program for service members and spouses, and shall
22deliver that report to the Secretary of Financial and
23Professional Regulation and the Lieutenant Governor.
24    (b) Each director of a department that issues an
25occupational or professional license is authorized to and
26shall issue an expedited license to a service member who meets

1the requirements under this Section. Review and determination
2of an application for a license issued by the department shall
3be expedited by the department within 30 60 days after the date
4on which the applicant provides the department receives with
5all necessary documentation required for licensure, including
6any required information from State and federal agencies. An
7expedited license shall be issued by the department to any
8service members meeting the application requirements of this
9Section, regardless of whether the service member currently
10resides in this State. The service member shall apply to the
11department on forms provided by the department. An application
12must include proof that:
13        (1) the applicant is a service member;
14        (2) the applicant holds a valid license in good
15    standing for the occupation or profession issued by
16    another state, commonwealth, possession, or territory of
17    the United States, the District of Columbia, or any
18    foreign jurisdiction and the requirements for licensure in
19    the other jurisdiction are determined by the department to
20    be substantially equivalent to the standards for licensure
21    of this State;
22        (2.5) the applicant meets the requirements and
23    standards for licensure through endorsement or reciprocity
24    for the occupation or profession for which the applicant
25    is applying;
26        (3) the applicant is assigned to a duty station in

1    this State, has established legal residence in this State,
2    or will reside in this State within 6 months after the date
3    of application for licensure;
4        (4) a complete set of the applicant's fingerprints has
5    been submitted to the Department of State Police for
6    statewide and national criminal history checks, if
7    applicable to the requirements of the department issuing
8    the license; the applicant shall pay the fee to the
9    Department of State Police or to the fingerprint vendor
10    for electronic fingerprint processing; no temporary
11    occupational or professional license shall be issued to an
12    applicant if the statewide or national criminal history
13    check discloses information that would cause the denial of
14    an application for licensure under any applicable
15    occupational or professional licensing Act;
16        (5) the applicant is not ineligible for licensure
17    pursuant to Section 2105-165 of the Civil Administrative
18    Code of Illinois;
19        (6) the applicant has submitted an application for
20    full licensure; and
21        (7) the applicant has paid the required fee; fees
22    shall not be refundable.
23    (c) Each director of a department that issues an
24occupational or professional license is authorized to and
25shall issue an expedited license to the spouse of a service
26member who meets the requirements under this Section. Review

1and determination of an application for a license shall be
2expedited by the department within 30 60 days after the date on
3which the applicant provides the department receives with all
4necessary documentation required for licensure, including
5information from State and federal agencies. An expedited

7service member meeting the application requirements of this
8Section, regardless of whether the spouse or the service
9member currently reside in this State. The spouse of a service
10member shall apply to the department on forms provided by the
11department. An application must include proof that:
12        (1) the applicant is the spouse of a service member;
13        (2) the applicant holds a valid license in good
14    standing for the occupation or profession issued by
15    another state, commonwealth, possession, or territory of
16    the United States, the District of Columbia, or any
17    foreign jurisdiction and the requirements for licensure in
18    the other jurisdiction are determined by the department to
19    be substantially equivalent to the standards for licensure
20    of this State;
21        (2.5) the applicant meets the requirements and
22    standards for licensure through endorsement or reciprocity
23    for the occupation or profession for which the applicant
24    is applying;
25        (3) the applicant's spouse is assigned to a duty

20        (7) the applicant has paid the required fee; fees

22    (c-5) If a service member or his or her spouse relocates
23from this State, he or she shall be provided an opportunity to
24place his or her license in inactive status through
25coordination with the military liaison. If the service member
26or his or her spouse returns to this State, he or she may

1reactivate the license in accordance with the statutory
2provisions regulating the profession and any applicable
3administrative rules. The license reactivation shall be
4expedited and completed within 30 days after receipt of a
5completed application to reactivate the license. A license
6reactivation is only applicable when the valid license for
7which the first issuance of a license was predicated is still
8valid and in good standing. An application to reactivate a
9license must include proof that the applicant still holds a
10valid license in good standing for the occupation or
11profession issued in another State, commonwealth, possession,
12or territory of the United States, the District of Columbia,
13or any foreign jurisdiction.
14    (d) All relevant experience of a service member or his or
15her spouse in the discharge of official duties, including
16full-time and part-time experience, shall be credited in the
17calculation of any years of practice in an occupation or
18profession as may be required under any applicable
19occupational or professional licensing Act. All relevant
20training provided by the military and completed by a service
21member shall be credited to that service member as meeting any
22training or education requirement under any applicable
23occupational or professional licensing Act, provided that the
24training or education is determined by the department to meet
25the requirements be substantially equivalent to that required
26under any applicable Act and is not otherwise contrary to any

1other licensure requirement.
2    (e) A department may adopt any rules necessary for the
3implementation and administration of this Section and shall by
4rule provide for fees for the administration of this Section.
