AMENDMENT TO HOUSE BILL 2825

2    AMENDMENT NO. ______. Amend House Bill 2825 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois and Michigan Canal Development
5Act is amended by adding Section 14.1 as follows:
 
6    (615 ILCS 45/14.1 new)
7    Sec. 14.1. Exchange of property.
8    (a) Notwithstanding any other provision of law or
9restriction on the property, including, but not limited to,
10any State rights, easements, or conveyance and reversion
11clauses restricting sale, the Village of Lemont may exchange
12with a nongovernmental entity the Illinois and Michigan Canal
13lands that were purchased from the State for other real
14property of substantially equal or greater value, as
15determined by 2 MAI appraisals of the properties, and of
16substantially the same or greater suitability for

1recreational, park, and parking purposes without additional
2cost to the Village. However, the property being transferred
3to the Village must be continuous to other Illinois and
4Michigan Canal lands owned by the Village.
5    (b) Prior to an exchange under subsection (a) with a
6nongovernmental entity, the Village board shall hold a public
7hearing in order to consider the proposed exchange. Notice of
8such a meeting shall be published at least twice, with the
9first and last publication being at least 10 days apart, in a
10newspaper of general circulation within the Village.
11    (c) This Section applies only to the exchange of Parcel
12One owned by the Village for Parcel Two owned by a
13nongovernmental entity as follows:
 
14    PARCEL ONE:
 
15    THAT PART OF SECTION 20, TOWNSHIP 37 NORTH, RANGE 11 EAST
16    OF THE THIRD PRINCIPAL MERIDIAN, ALL IN COOK COUNTY,
17    ILLINOIS, DESCRIBED AS FOLLOWS:
 
18    BEGINNING AT THE INTERSECTION OF THE SOUTH LINE OF THE
19    SOUTHERLY 90 FOOT RESERVE STRIP OF THE ILLINOIS AND
20    MICHIGAN CANAL AND THE NORTHEAST CORNER OF LOT 1 IN BLOCK 1
21    IN THE PLAT OF THE VILLAGE OF LEMONT, RECORDED AUGUST 8,
22    1874 AS DOCUMENT 184242; THENCE ALONG A LINE 141 FEET
23    SOUTHWESTERLY ALONG THE SOUTH LINE OF THE SOUTHERLY 90

1    FOOT RESERVE STRIP OF THE ILLINOIS AND MICHIGAN CANAL;
2    THENCE ALONG A LINE 79 FEET NORTHWESTERLY (AS MEASURED AT
3    RIGHT ANGLES THERETO) AND PARALLEL WITH THE EASTERLY LINE
4    OF BLOCK 1 IN SAID VILLAGE OF LEMONT SUBDIVISION, EXTENDED
5    NORTHWESTERLY; THENCE ALONG A LINE 139 FEET PARALLEL WITH
6    CANAL STREET; THENCE ALONG A LINE 63 FEET SOUTHEASTERLY TO
7    THE POINT OF BEGINNING, ALL IN COOK COUNTY, ILLINOIS.
 
8    PARCEL TWO:
 
9    THAT PART OF SECTION 20, TOWNSHIP 37 NORTH, RANGE 11 EAST
10    OF THE THIRD PRINCIPAL MERIDIAN, ALL IN COOK COUNTY,
11    ILLINOIS, DESCRIBED AS FOLLOWS:
 
12    LOTS 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, AND THAT
13    PART OF LOT 20 LYING EAST OF THE LEMONT ROAD BRIDGE, ALL IN
14    BLOCK 1 IN THE PLAT OF THE VILLAGE OF LEMONT, RECORDED
15    AUGUST 8, 1874 AS DOCUMENT 184242; ALL IN COOK COUNTY,
16    ILLINOIS.
