AMENDMENT TO HOUSE BILL 3497

2    AMENDMENT NO. ______. Amend House Bill 3497 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Pharmacy Practice Act is amended by
5changing Section 10 as follows:
 
6    (225 ILCS 85/10)  (from Ch. 111, par. 4130)
7    (Section scheduled to be repealed on January 1, 2023)
8    Sec. 10. State Board of Pharmacy.
9    (a) There is created in the Department the State Board of
10Pharmacy. It shall consist of 11 9 members, 8 7 of whom shall
11be licensed pharmacists. One of the licensed pharmacists shall
12have a primary site for the practice of pharmacy at an
13inpatient hospital pharmacy. Each of those 8 7 members must be
14a licensed pharmacist in good standing in this State, a
15graduate of an accredited college of pharmacy or hold a
16Bachelor of Science degree in Pharmacy and have at least 5

1years' practical experience in the practice of pharmacy
2subsequent to the date of his licensure as a licensed
3pharmacist in the State of Illinois. There shall be one member
4who is a pharmacy technician. There shall be 2 public members,
5who shall be voting members, who shall not be engaged in any
6way, directly or indirectly, as providers of health care in
7this State or any other state.
8    (b) Each member shall be appointed by the Governor.
9    (c) Members shall be appointed to 5 year terms. The
10Governor shall fill any vacancy for the remainder of the
11unexpired term. Partial terms over 3 years in length shall be
12considered full terms. A member may be reappointed for a
13successive term, but no member shall serve more than 2 full
14terms in his or her lifetime.
15    (d) In making the appointment of members on the Board, the
16Governor shall give due consideration to recommendations by
17the members of the profession of pharmacy and by pharmacy
18organizations therein. The Governor shall notify the pharmacy
19organizations promptly of any vacancy of members on the Board
20and in appointing members shall give consideration to
21individuals engaged in all types and settings of pharmacy
22practice.
23    (e) The Governor may remove any member of the Board for
24misconduct, incapacity, or neglect of duty, and he or she
25shall be the sole judge of the sufficiency of the cause for
26removal.

1    (f) Each member of the Board shall be reimbursed for such
2actual and legitimate expenses as he or she may incur in going
3to and from the place of meeting and remaining there during
4sessions of the Board.
5    (g) The Board shall hold quarterly meetings at such times
6and places and upon notice as the Department may determine and
7as its business may require. A majority of the Board members
8currently appointed shall constitute a quorum. A vacancy in
9the membership of the Board shall not impair the right of a
10quorum to exercise all the rights and perform all the duties of
11the Board.
12    (h) The Board shall exercise the rights, powers and duties
13which have been vested in the Board under this Act, and any
14other duties conferred upon the Board by law.
